Auction Terms & Conditions: NOTE: ANNOUCEMENTS MADE THE DAY OF THE AUCTION TAKE PRECEDENCE OVER ANY OTHER INFORMATION. Auction Items are being sold "AS IS", with no warranties expressed or implied. Regardless of any information given by the auction agents, the purchasers have examined these items and are relying solely upon such examination with reference to any condition, character, defects and sizes of the auction items and all other information. Inspection and Guarantee: Auction Items are available for inspection during dates and times set by the auctioneer. It is the bidder's responsibility to determine the usability or condition of auction items. All personal property is sold in "AS IS" and "WHERE IS" condition. All description information has been gathered from sources which we believe to be reliable but are not guaranteed. Auctioneer makes no warranty or guarantee of any kind with respect to condition, authenticity, provenance, source, condition, suitability for a particular purpose, etc. Bidder's failure to inspect any item or lot will not constitute grounds for any claim, refund, adjustment, charge back, etc. There are no warranties or guarantees of any kind. Auctioneer reserves the right to change, modify, delete any item or lot or description in the auction as may be necessary until the close of the auction. Preview dates are Sunday November 1 and 8, 2020 from 1pm-4pm. Age Requirement: All bidders must be 18 years of age or older. Minimum Bid: Several items are being sold for a minimum price. Minimum price announced day of sale. Payment: Cash, check, and credit card will be accepted. Thwaites Realtors is not liable for technical credit card processing issues. A 3% convenience fee will be added to the total for all credit card purchases. Sales Tax: Kentucky Sales Tax (6.0%) will be added to all taxable items sold. The total high bid, including the buyer's premium rate, will be added to determine the final selling price for the auction lot. Bidder Default: Failure to complete a purchase is illegal and will result in one or more of the following (1) prosecution (2) loss of bidding privileges for Thwaites Realtors, LLC. and all other HiBid auctions. Auctioneer is the one and only judge regarding the determination of winning bidders, and the single deciding authority if disputes should arise, and accepts no liability for any errors or omissions. Limit of Liability: In no event shall the auctioneer be liable for lost profits or any special, incidental, or consequential damages whatsoever arising out of or in connection with any sale or transaction. Thwaites Realtors reserves the right to postpone or cancel a sale without notice; if it is determined that such action is appropriate for whatever reason in our sole discretion. Thwaites Realtors or our agents will neither have liability nor obligation to the intended bidders as a result of any withdrawal, cancellation, or postponement of any sale. Buyer's Premium: A buyer's premium of ten percent (10%) of the high bid will be added to the high bid to determine the price for the auction lot. Only 5% buyer’s premium added to vehicle sales and sales tax does apply. Absentee Bidding: Absentee bidding for vehicles only that can be arranged by contacting Sarah at 859-473-3729. Absentee bidders must pay a 5% deposit paid by credit card via phone. Balance to be paid with a cashier’s check or wired funds within 2 business days. Title to vehicle’s will be transferred after payment by Bourbon County clerk. All items must be removed by Sunday, November 15 at 9pm unless prior arrangements are made. Any item not removed returns to the seller and can be resold. ***Covid-19 Policy*** Face masks required by order of the governor of Kentucky.
