The property namely, all and singular that certain parcel and tract of land and premises, situated, lying, and being in 35 Macdonald Avenue, West, in the city of North Bay, in the district of Nipissing, will be put up in one lot subject to a reserve price. 2. The highest bidder over the reserve price shall be the purchaser. In the case of a dispute between two bidders as to the last and highest bidder, the property shall be put up at a former bidding. No person shall retract their bidding. No person shall advance less than $500.00 (five hundred dollars). 3. The purchaser shall at the time of sale pay a deposit of $8,000.00 (eight thousand dollars) of the amount of the purchase money, and the sale shall be completed in 60 days or sooner, when possession shall be given and when the balance of the said purchase money shall be paid. 4. Immediately after the sale, the purchaser shall sign this contract to complete the sale according to these conditions. 5. All adjustments of insurance, rents, taxes, local improvements, rates, and other assessments, to be apportioned to the date of completion of the sale, when possession shall be given. 6. The purchaser shall not call for abstracts or other evidence of title not in possession of the vendor, and shall make any objections to the title in writing to the vendor's solicitors within 10 days from the date of the sale, and in default of making such objections, the purchaser shall be deemed to have accepted the title. 7. If any valid objections shall be made which the vendor shall be unable or unwilling to remove, the vendor shall be at liberty to rescind the sale, in which case the purchaser shall receive back the amount paid in full satisfaction of all claims. 8. If the purchaser fails to comply with any of the terms and conditions aforesaid, or any of them, the deposit and all other payments made therein shall be forfeited, and the property may be resold and the deficiency, if any, by such resale, together with all charges attending the same, are to be made good by the defaulter. 9. The purchaser acknowledges that this property will be sold as is where is. 10. If applicable, the Harmonized Sales Tax (HST) will be in addition to the purchase price.
