CHAOS ESTATE SALE AUCTION TERMS AND CONDITIONS OF SALE 1. SALES TAX. Pursuant to Nevada State law, sales tax is charged on the aggregate of the Bid Price and the Buyer’s Premium unless the purchaser is exempt by law. You may claim such an exemption by forwarding your Nevada State resellers number to CHAOS at debbie@chaosreno.com prior to the bid. No claims of exemption will be allowed at the time of settlement. If you do not process your resellers number in time, will be required to pay the tax to us and seek a refund from the State of Nevada. 2. BUYER’S PREMIUM. There will be a 15% Buyer’s Premium added to all Buyer’s totals for each item purchased. 3. IDENTIFICATION. All bidders are required to be ID verified to bid by registering with a valid credit or debit card. 4. PAYMENT TYPES. Only charge cards (Visa, MasterCard, and Discover) are accepted for payment at time of purchase. 5. PAYMENT AND PICK UP OF ITEMS. All Buyers must have a paid receipt from CHAOS at time of pickup. All items must be paid for at the conclusion of the auction and must be picked up no later than Thursday, August 13 between 10 am – 6 pm. Buyers are solely responsible for the loading of all items being picked up and must insure they provide the proper conveyances, packaging, and equipment for the removal of such items. CHAOS is not responsible or liable for damages to items caused employee assistance is provided to load items or for any accidents or personal injury which occur on CHAOS property while picking up items. 6. FORFEIT OF ITEMS. If items are not picked up by the deadline, they will be considered abandoned with title vesting back to CHAOS and subject to resale or removal from CHAOS premises. There will be no refunds for abandoned items and such items will be considered the property of CHAOS. 7. CONDITION OF PROPERTY. All merchandise is sold “As Is” and “Where Is” without warranties or guarantees of any kind. CHAOS nor any of its employees makes any representation of warranty, expressed or implied, as to the merchantability, fitness, completeness or conditions of any item as to the correctness of description, genuineness, attribution, provenance, or age of any item. 8. BUYER TRADING OR SALES. There will be no trading or sales between Buyers on CHAOS premises. 9. DISCREPANCIES. Buyer must report any discrepancies to items at the time of pick up on CHAOS premises. 10. PHOTOS AND DESCRIPTIONS. All photos and descriptions provided in the online auction are the property of CHAOS and may not be reused without the written permission of CHAOS. 11. LEGALLY BINDING AGREEMENT. By placing a bid through this website, you are entering into a legally binding contract and agree to follow through with the purchase of the item should you win the item. Buyer expressly agrees not to stop payment, dispute or contest this transaction. 12. REMOVAL OR CHANGING OF ITMS OR LOTS. CHAOS reserves the right to remove any and all items or lots from a sale at any time. CHAOS retains the right to combine and lots and/or divide any lot at any time prior to or during the sale. 13. STORAGE FEES. If CHAOS agrees to hold an item for a Buyer beyond the stated deadline, the Buyer agrees to pay CHAOS a storage charge of $15.00 per day per lot until the new pickup deadline date. If items are not picked up by the new deadline, they will be considered abandoned and the Buyer’s charge card will be charged the outstanding storage feeds. 14. PURCHASE TERMS. All sales are final and no returns are allowed. All winning bids will have the charge card on file charged for the full bid price plus Buyer’s Commission plus any stated ancillary fees at the conclusion of the auction. 15. RIGHTS AND RESPONSIBILITIES. CHAOS reserves the right to reject a bid from any bidder. The highest bidder acknowledged by CHAOS shall be the Buyer. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole discretion either to determine the successful bidder or to reoffer and resell the item in dispute. If any dispute arises after the sale, our sales records and recordings shall be conclusive in all respects.
