1) By Bidding in this Auction all Bidders Acknowledge the have read and hereby Accept the Terms and Conditions as set forth for this Auction.
2) Internet Premium: 10% Buyers Premium will be added to the final bid price to arrive at the total sale price. The total sale price shall be the final bid price plus the buyer’s premium of 10%. (example: Bid price $100,000 x buyer’s premium 10% ($10,000) equals $110,000 the total sale price)
3) Winning Bidder hereby agrees to enter into an “Offer-to-Purchase, Deposit Reciept & Agreement-of-Sale” with NO Contingencies whatsoever. Upon being declared the Successful Bidder by the Auctioneer and with the Sellers approval of the final sale price, an Agreement-of-Sale will be forwarded via eMail, fax, or hand delivered to the winning bidder. The winning bidder will return a signed copy of the Agreement-of-Sale before 12:00 Noon CST, September 27, 2018 (by hand delivery, or by fax or by scanning & eMail). An “Offer-to-Purchase, Deposit Reciept & Agreement-of-Sale” will be provided to an “Active Bidder” prior to Auction closing, upon request. 4) Down Payment: The winning Bidder will make a “Non-Refundable” down payment in the amount of 10% of the total Sale Price (including the Buyers Premium). The down payment will be due by 12:00 Noon CST, September 27, 2018 and will be made payable to United Country Heartland Real Estate Trust Account.
5) Closing/Settlement will be “On or Before” October 31, 2018. The closing/settlement will be handled by the Seller’s Attorney or a Qualified Iowa Closing Agent to be determined by the Seller. Possession of the property will be given immediately following the closing/settlement.
6) Real Estate Property Taxes for the current tax year will be pro-rated to date of closing. Special Assessments (if any) that are spread on County books will be paid by Seller.
7) It is fully understood; that United Country Heartland Real Estate are Agents for the Seller and the Final Sale Price is Subject to Sellers’ Approval. Seller reserves the right to reject any bid for any reason. Seller reserves the right to cancel this Auction up to 24 hours prior to the Auction’s scheduled closing date & time without notice.
8) Bidders hereby agree that their bid shall NOT BE SUBJECT to the bidder’s ability to obtain financing. By placing a bid in this auction, bidders are making an all “cash offer” to purchase the property with NO contingencies.
9) Property Inspections will be made prior to 4:00 PM CST, September 23, 2018. All showings, inspections, etc. must be made by appointment only through the listing office. Bidders are responsible to form their own opinion as to the value of the Real Property and included Personal Property. The Real and Personal Property are being sold together as one lot and Sold “AS-IS Where-IS” with all Material Defects (if any).
