Description
Absolute Auction of an 11.81 acre vacant parcel just outside the City of Petoskey in Bear Creek Twp., Emmet County, MI. This parcel is heavily wooded with the most likely building site near Atkins Rd. Prior approval was granted for a pond, but never proceeded. A perk test was never attempted by seller. *Property selling AS-IS. A 5% Buyer's Premium, or flat fee of $1000 (whichever is greater) is assessed to the final bid price to achieve the final selling price for the property. *A $5,000 Earnest Money Deposit will be required of the successful bidder by end of business on Tuesday, October 2, 2018. Leist Auctioneers will contact the successful bidder at close of bidding on October 1 to coordinate the deposit and signatures for the Purchase Agreement. *This and all properties sell "AS IS WHERE IS" with no warranties or guarantees of any type expressed or implied as to the merchantability, usability, fitness for a particular purpose, condition, quality, quantity, value or any matter of whatsoever type or nature. Potential buyers should inspect all properties before placing any bids. Any improvements which may need to be done will be the responsibility of the purchaser. Buyers will have inspection opportunity prior to the auction conclusion and it is recommended they take advantage of said opportunities. Acceptable inspection after the auction is not a contingency of your bidding so be sure you have inspected the property prior to the auction. *The balance of the purchase price will be due within 30 days of the auction closing, or 10 days after all closing paperwork has been prepared. Closing fees will be the sole responsibility of the Buyer for this auction. *Property taxes due on the property on or before the close of the auction will be paid by the Seller. All property taxes due after the date of the auction will be the Buyer's responsibility. The Buyer will assume any dues or assessment balance which remain after the close of the auction. *Seller will provide a deed to the property at their cost. Sller also will provide an owners title insurance policy in the amount of the purchase price at closing. *If you are the successful bidder, you will be required to sign all the purchase agreements and make your $5,000 deposit on the property on October 2, 2018. The ability to obtain financing is not a contingency of the sale. Properties will be sold, for this auction, to the highest bidder, regardless of bid price. The auction will be concluded at the sole discretion of Leist Auctioneers and any bids may be recognized at their discretion. Any exceptions to the above terms will be noted in auction announcements throughout stated terms. *Posted closing times and dates and displays of Leist Auctioneers current time are approximate. Leist Auctioneers reserves the right to close the auction early, or to extend the auction at any time at their discretion. We recommend bidders place bids early to avoid losing the bid due to an ill-timed, last minute bid, or software/computer hardware malfunction. All times are based on Eastern Standard Time. *This auction features a SOFT CLOSE which means the bidding will be extended by 10 minutes for any bids received within the final 10 minutes of bidding. For example, a bid for this auction that occurs at 6:55pm on October 1, 2018 will cause the bidding to extend until 7:10pm on October 1, 2018. This process will continue as necessary until no further bidding occurs for a period of 10 minutes after the preset auction time or extensions.
