Terms and Conditions
• The terms of sale are non-negotiable. Registering to bid either live, online or absentee signifies your acceptance of the terms. Your bid is a binding agreement. Do not place a bid unless you intend to honor it.
• Inspection: All items are located at Southern Rail Fabrications, 85 Saddle Club Rd, Blountsville AL 35031. Inspection is 10am-4pm, Thurs March 21st. You are advised to inspect items BEFORE bidding. We do our best to describe and photograph items, but we are by no means perfect and may miss something that is important to you. If the item was tested, it will say so in the description - time does not allow for testing of most items. All Sales Are Final With No Refunds/Returns/Exchanges.
• General: 'AS IS, WHERE IS, WITH ALL FAULTS'. All Sales Are Final With No Refunds/Returns/Exchanges. Full Payment due at end of auction. Area sales tax collected (Alabama State, Blount County) - 2.5% on welders/rotary cutter, 7% on all else. Dealers present your resale certificate to avoid sales tax. All times stated are Central. Bid retraction will result in suspension of bidding privileges. No international bidders accepted without prior approval from Heritage.
• Removal: Buyers are responsible for removal of purchases from auction site. Buyers must provide their own moving equipment and personnel. Appointments are required for pickup and are available 9am-4pm Wed-Fri Mar 27th-29th. NO ALTERNATIVE DATES/TIMES are available. If you do not have an appointment, the facility may not be open. All items are located at, must be paid for at and must be picked up from Southern Rail Fabrications, 85 Saddle Club Rd, Blountsville AL 35031. Each item left past this deadline will be assessed a $10/day late pickup fee and after 10days will be considered abandoned and may be immediately resold with no notice or credit given to you. You must present a printed copy of your PAID receipt to pick up items (PAID receipt available at pickup site). Forklift driver is available, however some items in this auction are in excess of the forklift's capacity. The link to sign up for a pickup date/time will be sent after the auction is completely over. If you miss your pickup appointment, your credit card on file will be charged. If you have not scheduled a pickup appointment in the online scheduler by 4pm Fri Mar 29th, your credit card on file will be charged.

(A) CASH or CERTIFIED FUNDS, due by 4pm Fri Mar 29th, otherwise your credit card on file will be charged. (B) VISA, MASTERCARD, DISCOVER, AMERICAN EXPRESS due by 4pm Fri Mar 29th. Card must be present and in users name. Bidder waives their right to initiate a charge-back on their credit card for any reason.. (C) WIRE TRANSFER, due by 4pm Fri Mar 29th, otherwise your credit card on file will be charged. Keep in mind that most bank's wire departments are not open on the weekend/holidays and it usually takes 24hrs for a wire to be completed. (D) PERSONAL/COMPANY CHECK, due by 4pm Fri Mar 29th, otherwise your credit card on file will be charged. Heritage accepts Checks ONLY with a verifiable Bank Letter of Guarantee. Letter must contain wording that your bank will "guarantee payment" of your check. This is not the same as a letter of available funds or of good standing. We will need to receive the letter during banking hours, when we can verify it through a publicly published number or your items will be held until the letter can be verified. If you cannot meet these requirements, please choose another form of payment. Sample Guarantee Letter (NOT same as letter of available funds or of good standing): As a customer of our bank, we will guarantee payment of (insert customer name here)'s checks drawn on account #_____ not to exceed the aggregate amount of $_____ for purchases at the auction of Heritage Realty & Auction Co Inc ending on March 26, 2024. (E) If you miss your pickup appointment, your credit card on file will be charged regardless of your preferred payment method. (E) All payments accepted after the removal deadlines must be in the form of cash or wire transfer. • ONLINE Buyer's Premium & Convenience Fee: For all ONLINE bidders, a 10% internet premium will be added to all items, with an additional 3.5% convenience fee for use of credit/debit card.
• Shipping: Is NOT AVAILABLE for this auction.
