Terms of Sale:
1. All purchases are subject to the terms and conditions set forth in Buyer's Contract.
2. Statements made by CMA on day of auction and represented as a term and condition of the sale become a part of the Buyer's Contract.
3. All purchases must be paid in full 5 days after the sale, and prior to the removal of items from the premises.
4. If a dispute arises between 2 or more bidders, or for any other reason, the auctioneer will decide the dispute or resell the items.
5. All items are sold "AS-IS, Where is." CMA assumes no liability for any guarantee made by the seller, the condition of the item, or transport cost for any item. All items are purchased with all faults and no guarantees or warranties of any kind.
6. The auctioneer & CMA are not liable for any direct, indirect, injury, damage, or loss incurred in connection with the sale or purchased items. If the auctioneer is unable to deliver any purchase or deliver such purchase free and clear of a lien, auctioneer may terminate the purchase agreement with only the obligation to return the purchase money.
7. Purchaser assumes responsibility for items when "sold" or upon delivery to purchaser.
8. Auctioneer makes no representations concerning and assumes no responsibility for the validity or timing of proving title to equipment or vehicles.
9. All items must be removed from premises after 14 days of the sale. If items are not removed 30 days after, CMA will resell the items or charge lot rent.
