Wildfire Auctions – Terms & Conditions These Terms & Conditions apply to all sales conducted by Wildfire Auctions, whether held in-person or online. By registering to bid, you agree to these terms in full. Please read carefully. ? Online Bidding Disclaimer: Auction Company utilizes third party bidding platforms (herein “bidding platform”) to facilitate the collection and recording of online bidders. By agreeing to these terms, bidders agree to hold harmless Auction Company and all Bidding Platform providers for technical errors and mistakes that may arise from connectivity issues on the part of the Auction Company and the bidder. Errors may occur. ALL GOLD COINS AND JEWELRY: The Auction Company does not accept credit payment for the purchase of gold coins and any gold jewelry with purchase price over $250. If your invoice includes gold coins or jewelry, you will be required to tender payment by cash, money order, certified check, or wire transfer. ?? 1. Registration & Bidding • All bidders must be 18 years or older and provide valid identification and contact information. • Online bidders must register and be approved prior to bidding. • Wildfire Auctions reserves the right to refuse or revoke bidding privileges at any time. • Bids are binding. Once placed, bids cannot be retracted or canceled. ? ?? 2. Payment: The credit card on file with your online account via hibid will be charged automatically at the conclusion of the auction. If your card on file is declined or cannot be processed for any reason, you will be contacted within 24 hours to arrange alternate payment. Your invoice must be paid in full before taking possession of the items. You have 12 hours from the time Wildfire Auctions attempts to contact you to make payment. • All purchases must be paid in full within 24 hours of the auction’s end unless otherwise stated. • Accepted forms of payment include cash, credit/debit card, certified money order (items released after money is cleared), or approved online payment gateway. • Buyer’s Premium: A 15% buyer’s premium will be added to all winning bids. • Sales tax may apply where required by law. Tax-exempt buyers must provide a valid resale certificate prior to bidding. • Unpaid invoices after 48 hours may result in forfeiture of items and suspension of bidding privileges. • All purchases over $1000 must be sent via wire transfer transfer, cash, or zelle. •Charge backs by credit cards are known to be a form of scams/fraud and will be treated as such and criminal charges filed and prosecuted to the fullest. All items are sold as-is and represented to the best of the auction house’s ability and photos provided. If there are problems, the auction house must be notified in writing and can be emailed at WildfireAuction@gmail.com. By placing any bid, buyer agrees to all terms and conditions. ? ?? 3. Pickup, Shipping & Handling • Pickup: All items must be picked up on day of auction close unless prior arrangements are made. Pickup date will be listed in individual auction for all online winning bids. Items left for 24 hours after auction close or pickup date will revert to ownership of auction house and all rights will be forfeited from buyer. Items may be re-sold without any refund to buyer. • Shipping: Available on select items. Buyer is responsible for all shipping and handling costs.Shipping handled by 3rd party shipper, Wildfire Auctions releases all liability upon buyer purchase. • Wildfire Auctions is not responsible for damage or loss once items have been transferred to carrier or pickup has occurred. ? ?? 4. Item Descriptions & Authenticity • All items are sold AS IS, WHERE IS, with no warranties or guarantees expressed or implied. • Descriptions and photographs are provided in good faith, but errors or omissions may occur. • Jewelry and gemstone descriptions are based on visible characteristics and standard testing; no laboratory certification is implied unless stated. • Bidders are encouraged to inspect items in person during preview (one hour prior to auction start, in person) or contact us with questions prior to bidding. All bids are a legal binding contract and buyer understands that by placing a bid that they forfeit all rights for legal action against any person associated with Wildfire Auctions LLC and the auction house. ? ?? 5. Equipment & Vehicles • All equipment and vehicles are sold as-is with no guarantee of condition or operability. • Buyer assumes full responsibility for testing, inspection, and safe transport. ? ?? 6. Auction Format & Disputes • Wildfire Auctions reserves the right to: • Add or remove items at any time • Reject any bid • Set or alter bid increments • Cancel or reschedule an auction as needed • In case of a bidding dispute, the auctioneer’s decision is final. • All sales are considered final once declared “SOLD.” ? ?? 7. Liability Wildfire Auctions, its owners, and staff are not liable for any injury, loss, or damage resulting from participation in the auction or the purchase/use of items sold. ? Shipping: Shipping is done by a 3rd party. They will contact buyer directly to get shipping info. There is no in-house shipping. ?? 8. Consignors • Consignors must have a signed consignment agreement prior to auction. • Payment to consignors is typically made within 30 business days after buyer payments are collected and cleared. • Wildfire Auctions reserves the right to photograph and advertise all consigned items. By entering auction house grounds, you are agreeing to be videoed and photographed and images used at Wildfire Auctions, LLC discretion. ? ?? 9. Governing Law These terms are governed by the laws of the State of West Virginia. Any disputes shall be settled in Mason County, WV, unless otherwise agreed. ? ?? 10.
