Auction Terms & Conditions Please review this information carefully!! This document establishes legally binding contractual obligations. To register and access the online bidding platform, a Bidder must accept and acknowledge these Terms and Conditions. 1. Sales Tax Information: West Virginia is the only state in the U.S. that does not charge sales tax on firearms and ammunition. Items categorized as non-firearms or non-serialized lower receivers are subject to a 6% sales tax. Bidders with tax-exempt status must provide the necessary documentation to Valley Auctions LLC prior to registration. 2. Registration and Bidding: Bidders must register and obtain approval from Valley Auctions LLC before placing bids. Each lot’s closing hammer price is subject to an 18.00% Buyer's Premium. All bids are legally binding offers to purchase the identified firearms and remain valid until the Seller declares the item "Sold." 3. Bid Rejection: The Auctioneer reserves the right to reject any bid. Early registration is encouraged, and account approvals are reviewed daily. Failure to respond to communications may result in declined bids. Prompt registration is advised as approvals during active auctions are not guaranteed. 4. Winning Bidder Responsibilities: The Winning Bidder agrees to purchase the firearm at the winning bid price plus the 18% Buyer's Premium. Within 48 hours of the auction's close, the Winning Bidder will receive an email detailing pickup or shipping options. The email will provide the option for in-store pickup or shipping. Once all items are paid for, Valley Outdoors, a fully licensed FFL Dealer, will protectively wrap, pack, and box each firearm to prepare the invoice for shipping. Firearms that must be shipped shall incur a $25 transfer fee from the FFL Dealer, plus all packaging, shipping, and insurance costs. Each shipped firearm will have shipping insurance added matching the hammer price of the gun at a rate of 1per1 per1per100. Auctioneer, Seller, and the FFL Dealer shall not be held responsible for any damage after the lot closes, regardless of whether it occurs in transit or otherwise. All required documentation and a separate invoice, which will include sales tax if applicable, will be forwarded via email for payment, subject to a 4% credit card processing fee. These costs will be paid prior to shipping using the buyers credit card on file with Hibid. All FFL licenses must be valid and submitted to FFL@VALLEYAUCTIONSUSA.COM prior to shipment. 5. Pick Up and Shipping: Winning Bidders who opt for in-store pickup must do so within 10 days from the auction's close at Valley Outdoors, located at 3034 Mount Vernon Rd, Hurricane, WV 25526. Pickup hours are 10 AM to 7 PM daily, except Wednesdays and Saturdays (closing at 5 PM), and we are closed all day on Sundays in respect of the Lord's Day. A storage fee of $10 per day will be charged after the 10-day period unless other arrangements have been made. 6. Payment Policy: Immediately following the auction (around 12/21/2025), the Winning Bidder’s registered credit card will be charged for the final hammer price plus the 18%. A 4% processing fee applies to all credit/debit card transactions. Legal Compliance: Bidders agree to abide by all Federal, State, and Local laws regarding firearm purchases and transfers. The Winning Bidder is responsible for ensuring compliance with local laws in their jurisdiction. Any bid placed indicates the Bidder's representation of their legal eligibility to purchase firearms. 7. Liquidated Damages: If a firearm sale fails due to misrepresentation by the Winning Bidder, they will be liable to the Seller for $250. Bidder acknowledges that failure to pick up or respond may result in legal action and liability for associated costs, including attorneys' fees. 8. Inspection and Condition: All firearms are sold "AS IS" without warranties. Bidders are encouraged to inspect all applicable items before placing bids. No guarantees regarding item authenticity or performance are made. 9. Indemnification and Limitations of Liability: Seller, Broker, and Auctioneer are not liable for errors or omissions in listings. The online auction is conducted electronically and may be subject to interruptions outside their control. 10. Acceptance of Terms: By registering and participating in this auction, the Bidder acknowledges receipt and understanding of these Terms and Conditions. Participation binds the Bidder to all provisions outlined herein and grants jurisdiction to the State of West Virginia for any disputes. 12. C&R License are NOT recognized, transfers to registered FFL Dealers with active license is required If shipping a Firearms or Black Powder Guns. 13. WE will not ship where illegal. Firearms Auction Safety & Liability Disclaimer All firearms are sold strictly AS-IS, WHERE-IS, with no warranties expressed or implied regarding safety, function, performance, or fitness for any purpose. Descriptions and photographs are provided in good faith, and every effort has been made to accurately represent each firearm, but it is the Buyer’s sole responsibility to review all information, images, and disclosures before placing a bid. Bidding constitutes acceptance of the item in its current condition. Valley Auctions LLC, the auctioneer Glenn Yeager, and the designated FFL dealer Valley Outdoors assume no liability for the condition, function, safety, use, or misuse of any firearm sold. All risk transfers to the Buyer at the time of purchase. All pre-owned firearms should be inspected by a certified gunsmith prior to loading or firing. The Buyer agrees to obtain such inspection and assumes full responsibility for safe handling, storage, and operation. All firearm transfers will be completed through Valley Outdoors or another licensed FFL in accordance with federal, state, and local laws. Failure to meet legal eligibility requirements does not void the sale, and all premiums and fees remain the responsibility of the Buyer. By participating in this auction, the Buyer waives any and all claims against Valley Auctions LLC, Glenn Yeager, Valley Outdoors, and their employees or agents arising from the purchase, possession, transfer, or use of any firearm.
