Welcome to Landmark Auction Co.'s "Last Minute Christmas Gift Auction." By participating in this auction, bidders agree to the following Terms and Conditions. Please read carefully.
1. General Information
This is a timed, online-only auction. Bidding begins December 12th at 8:00 PM and closes at 8:00 PM on Thursday, December 19th, 2024.
All items are sold as-is, where-is, with no warranties expressed or implied.
2. Registration and Bidding
All participants must register with accurate contact information to bid. By registering, you confirm that you are 18 years or older and legally able to enter into binding contracts.
Bids cannot be retracted, and all sales are final. Bidders are encouraged to read descriptions carefully and contact us with any questions before placing bids.
3. Payment Terms
Buyer’s Premium: An 18% buyer’s premium will be added to the final hammer price of each item. This premium covers administrative and operational costs associated with hosting the auction.
Credit Card Payment: All credit cards on file will be charged immediately following the auction's close.

Discount for Alternative Payments: If you prefer to pay via cash, Zelle, or Venmo, you are eligible for a 3% discount. Please notify us in advance to arrange payment.
Sales Tax Exemption: If you are tax-exempt, please send your tax-exempt documentation to mark@landmauctions.com before the auction closes.
Items will not be released for pick-up or shipping until payment is received in full.
4. Item Condition and Descriptions
We strive to provide accurate descriptions and photographs of all items. However, we do not guarantee the accuracy of these descriptions.
It is the bidder's responsibility to inspect items via the descriptions and images provided.
5. Pick-Up and Shipping
Pick-Up Location: 1231 Space Park Dr, Ste B6, Houston, TX 77058.
Pick-Up Times:
Friday, December 20th, from 9:00 AM to 3:00 PM
Saturday, December 21st, from 9:00 AM to 3:00 PM
Following the auction, winners will receive a text and email to choose between shipping or pick-up:
Shipping: Shipping costs will be invoiced separately and must be paid before items are shipped. Please note that shipping can be expensive, with a minimum cost of $10. While we strive to keep shipping costs as low as possible, we do not receive discounted shipping rates like large retailers and cannot absorb the cost of shipping.
Pick-Up: Winners will receive an email and a text with an option to choose shipping or pick-up. If they choose pick-up, they will be able to select a convenient pick-up window at that time. We strive to be as flexible as possible and appreciate the courtesy of notifying us if your plans change, ensuring a smoother transaction for everyone.
Items not picked up by the designated time will be considered abandoned and may be resold or discarded without refund unless previously notified as stated in the previous point.
6. Liability Disclaimer
Landmark Auction Co. is not responsible for any damages or losses incurred during shipping or pick-up.
Buyers assume all responsibility for transporting items safely from our location.
In no event shall Landmark Auction Co. be held liable for any incidental, indirect, or consequential damages, including but not limited to loss of use, loss of revenue, or loss of data.
7. Taxes and Fees
Sales tax will be applied to all purchases in accordance with Texas law unless a valid resale certificate is provided prior to the auction close.
8. Dispute Resolution
Any disputes arising from this auction shall be governed by the laws of the state of Texas.
All legal claims must be filed in the courts located in Harris County, Texas.
9. Amendments
Landmark Auction Co. reserves the right to update or modify these Terms and Conditions at any time without prior notice.
