NO RETURNS ALLOWED REGARDLESS OF PICTURE, TITLE, AND DESCRIPTION. THERE ARE 2 IN-PERSON PREVIEW DAYS EACH AUCTION FOR A REASON. COME INSPECT AND TEST ITEMS, MEASURE ITEMS IF YOU WANT, TAKE CLOSE UP PICTURES. PAYMENT for winning invoices of ONLINE BIDS is DUE Monday, Tuesday and Wednesday immediately following the Sunday Auction. Hours of operation on those days are MONDAY 7:00 a.m. until 3:00PM, TUESDAY 7-11 & 1-5PM, and WEDNESDAY 7 – 11 & 1 – 3:00PM. If you are unable to come in person to pay for your winning items, you will need to call 254-432-4048 to pay and make arrangements for later removal of items/lots. We accept most major credit cards, debit cards, cash or local checks for payment. A buyer’s premium (12%) as well as any applicable taxes and 3% surcharge for use of a card are added to the closing price of all winning bids. Any purchases that have been paid for will be considered abandoned if not picked up within calendar month following the auction end date and will be disposed of by Killeen Auction House as we see fit including being resold as ours. Failure to pay for item/lots won on any Killeen Auction House online auction may result in legal action against Buyer by Killeen Auction House. NO REFUNDS ~ Killeen Auction House is unlike many other online or live auctions that limit the bidders time to preview the items in the auction. Killeen Auction House allows bidders ample time to inspect, test, and measure items in person prior to the start of the online auction. Because of that, we do not allow refunds. POSTED & ADVERTISED PREVIEW TIMES – During the week of an auction, Killeen Auction House is open for preview on Thursday from 7:00 am to 11:00 am and from 1:00 pm until 5:00 pm as well as auction day on Sunday from 8:00 am until 12:00 pm. We encourage buyers/bidders to come and preview, take pictures of items, examine items, and ask questions. Once again, all ITEMS/LOTS ARE SOLD AS IS – WHERE IS – HOW IS and WITH ALL FAULTS, known, apparent, or otherwise. Bidder acknowledges that all item/lots were available for inspection prior to the auction and, by these terms, Auctioneer and Killeen Auction House strongly encourages Bidder to carefully inspect each item/lot in which Bidder had any interest to determine the item/lot’s nature, quality, condition, quantity and size. All Bidders rely solely on their personal inspection and not on information listed on the Site. Bidder’s failure to inspect, or otherwise to be fully informed as to the nature, quality, condition quantity and size of any item/lot will not constitute grounds for any claim, adjustment, refund, termination of the contract for sale, or refusal to close the sale, against the Auctioneer or Killeen Auction House. ONLINE BIDDING –All registration information the Bidder provides to the Auctioneer and/or Killeen Auction House shall be current, complete, and accurate. All bidders must be 18 years of age or older. As a bidder, placing a bid is a binding contract between you and Killeen Auction House and the bid cannot be retracted. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. Placing a bid on this Site, and winning, then not paying for the product may have legal implications and could result in prosecution. As a bidder, you are responsible for any bids placed under your bidding number and password. The security of your Bidder information is your sole responsibility as you, the buyer/bidder will be responsible for any and all bids placed under your number. If at any time you feel that your Bidder number and password have been compromised due to lack of security on your part, you must notify Auctioneer immediately. The Auctioneer and Killeen Auction House cannot, and will not, be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that his auction is conducted electronically and relies on hardware and software and internet service that may malfunction without warning. The Auctioneer, in his/her sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final. All sales are subject to appropriate Texas Sales Tax laws. If you are exempt from paying sale tax, you must complete and sign the tax exemption form with your Sales and Use Tax Number. THE LEGAL STUFF – The Auctioneer reserves the right to: a) Accept bids in any increment he/she feels is in the best interest of his client, the seller; and/or b) Reject bids from anyone whose conduct, actions, bidding, or adverse comments that are not in the best interest of; KILLEEN AUCTION HOUSE and/or c) Withdraw from the online auction sale any items not listed and pictured. Persons attending during preview times or on any day in-between, or during the time of removal of goods, assume all risks of damage or loss to person and/or property and specifically releases the auctioneer, partners, volunteers, and Killeen Auction House from liability therefore. Regardless of any circumstance whether written or as a verbal statement from any source, the Auctioneer is acting as Agent only and is not responsible for acts of its principals.
