These terms outline the policies for participation in auctions conducted by the firm. All bidders must agree to these conditions upon registration.
Payment must be made in full at the conclusion of the auction. Accepted forms include cash (with exact change appreciated), personal checks (requiring a bank letter of credit if the bidder is unknown to the auction firm, and must be paid within 24 hours of auction close or the card on file will be charged), cashier's checks, and credit/debit cards (MasterCard, Visa, American Express, and Discover). A 3% convenience fee applies to all credit and debit card purchases, including those by online bidders. Online bidders will be automatically charged at the auction's end unless prior arrangements are made with the auctioneer via email at redriverauctioneer@gmail.com. Cash payments can be accepted the following day only if prior arrangements are confirmed. A 10% buyer's premium is added to the high bid to determine the final sales price for each lot. Sales tax will be collected on all items unless a valid resale certificate is provided.
Merchandise becomes the full responsibility of the bidder once the auctioneer declares it "SOLD," at which point the bidder assumes all risk of loss and damage to the property. Red River Auctions reserves the right to resell any property not paid for in full by the end of the stated pickup period, with the original bidder remaining liable for the purchase price, collection costs, and any damages from the resale.For removal, items may be picked up only after full payment is received and acknowledged. Bidders are solely responsible for rigging, loading, and moving their purchases, without assistance from Red River Auctions, which assumes no liability for injuries or damages during this process. Items not removed by the pickup deadline are considered abandoned, allowing Red River Auctions to resell them and retain proceeds to cover unpaid storage and handling fees. Items not picked up within 15 days will be resold.If a third party is picking up purchases, the bidder must notify Red River Auctions in advance by emailing redriverauctioneer@gmail.com to authorize the release.
Shipping is handled by Red River Auctions using Priority Mail USPS by default, though other carriers can be requested via email at redriverauctioneer@gmail.com. Handling charges range from a minimum of $5 to a maximum of $40, separate from actual shipping costs, which depend on item quantity and package weight. Artwork and large items may require special boxes, incurring additional costs not covered by handling fees. Furniture cannot be shipped. Ammunition is shipped via UPS to the continental United States only, excluding Hawaii and Alaska.
All lots are sold "as is, where is," with all faults and without any guarantees or warranties, express or implied, from Red River Auctions or the seller. Bidders are encouraged to inspect items in person before bidding, as the auction firm is not responsible for any inaccuracies in descriptions, which are provided in good faith as opinions. Sellers are contractually prohibited from bidding on their own consigned lots. All sales are final, with no returns, refunds, or adjustments.Bidding software will notify participants when they have been outbid. In case of buyer default after the payment period, items will be relisted in an online auction, and a 15% relisting fee (based on the original selling price) will be charged to the bidder's account as a reasonable estimate of damages. By registering a credit card, the bidder authorizes Red River Auctions to charge this fee.The bidder agrees to cover all reasonable attorney fees and costs for debt collection, plus a 2% monthly interest on any unpaid balance. Disputes will be resolved in Montgomery County, Tennessee. Individuals bidding on behalf of a business entity personally guarantee payment, including collection expenses and attorney fees.
If Red River Auctions cannot deliver a purchase for any reason, its sole liability is limited to refunding the paid amount upon return of the item. All bidders must be 18 years of age or older. Registration information provided must be current, complete, and accurate, with bidders responsible for securing their bidding numbers and passwords, and notifying the auction firm if compromised.
