Terms and Conditions
TERMS: A 13% buyer's premium applies to all purchases, capped at a maximum of $1,000 per lot.
PAYMENT: All purchases will be automatically charged to the credit card used for registration. To arrange an alternative form of payment (E-transfer, cash, or wire transfer), you must contact our office (905-779-3031 or fulsomauctions@gmail.com) to confirm before the auction closes.

1. ACCEPTANCE OF TERMS
By registering, clicking "Accept," or bidding, you enter into a binding legal agreement with FULSOM AUCTIONS LTD. Do not bid unless you agree to these terms. Your email will be added to our auction notification list; you may unsubscribe at any time.
2. WARRANTY AND INSPECTION ("AS-IS")
- ALL SALES ARE FINAL. Everything is sold "AS-IS, WHERE-IS" with all faults and errors.
- No Warranties: FULSOM AUCTIONS LTD provides no warranties of merchantability or fitness for a particular purpose.
- Bidder Responsibility: It is the Bidder's sole responsibility to determine condition, age, and value. We encourage in-person inspection during posted preview dates.
- Off-site Bidding: Bidders who do not inspect items in person acknowledge they are bidding based on descriptions alone. Failure to inspect is not grounds for a refund or bid retraction.
- Descriptions: We are not responsible for errors in descriptions unless they constitute a material and intentional misrepresentation.
3. REGISTRATION
- Bidders must be 18+ years old. All registration information must be current and accurate.
- We collect credit card information via a secure, SSL-encrypted, PCI-compliant site to verify bidding ability.
- We reserve the right to deny registration or deactivate accounts at our discretion without notice.
- Fraudulent information will result in a permanent ban. We do not sell or rent your data.
4. BIDDING PROCESS
- Finality: All bids are final, irrevocable, and cannot be retracted.
- Maximum Bids: Our software (Auction Flex) will bid on your behalf in minimum increments up to your maximum. You only pay the final bid amount, even if it is lower than your maximum.
- Right to Withdraw: FULSOM AUCTIONS LTD reserves the right to withdraw or re-catalog items at any time.
5. PAYMENTS AND PICK UP
- Costs: A 13% buyer's premium (capped at $1,000/lot) and 13% HST apply to all lots.
- Transfer of Risk: Items become the property of the Buyer at the "fall of the hammer." The Buyer assumes all risk of loss and is responsible for immediate insurance.
- Removal: Buyers are responsible for rigging, loading, and removal. FULSOM AUCTIONS LTD does not provide loading assistance.
- Abandonment: Items not picked up by the specified date are considered abandoned; the bidder's account will be banned.
- Holding Charges: Late pick-ups require full payment plus a holding fee based on the item's size/nature.
6. WEBSITE AND TECHNOLOGY
- Service Interruptions: We are not responsible for hardware/software malfunctions or lost internet connection.
- Missed Bids: We are not liable for missed bids or software failure.
- Proxy Bidding: We recommend leaving maximum bids at least 24 hours before the auction to ensure they are processed.
- Technical Issues: We reserve the right to extend or close bidding in the event of a system failure.
7. INDEMNITY
Bidders and consignors agree to indemnify and hold harmless FULSOM AUCTIONS LTD and its staff from any claims, losses, or damages (including personal injury or property damage) arising from the use of the site or attendance at the auction premises.
8. MODIFICATIONS
We reserve the right to amend this agreement at any time by updating this site. Use of the site constitutes acceptance of the current terms.
