AUCTION TERMS & CONDITIONS Terms and conditions to bid and buy. Please read these terms carefully. These terms, as modified or amended from time to time, are a binding contract between Rightside Auctions ("Rightside Auctions") ("we" and/or "us", etc.) and you ("you", "bidder", "purchaser"). The act of registering for our auction is a legally binding contract pertaining to the Terms & Conditions outlined in Rightside Auctions Brantford AUCTION TERMS & CONDITIONS. The act of registering means that you have read fully and agree to all Terms & Conditions within. REGISTRATION & ELIGIBILITY TO BID To bid with Rightside Auctions, you must be at least 18 years of age and legally able to enter into binding contracts. During registration, you are required to provide accurate and complete personal information. Rightside Auctions reserves the right to request additional documentation to verify your identity. All bidding is conducted through HiBid, our third-party auction software provider. To register, click the "Register to Bid" button or link on our auction page, which will redirect you to HiBid. There, you must create an account, add a valid payment method, and agree to the seller's Terms & Conditions. HiBid may place a temporary $1.00 USD verification charge on your credit card to confirm payment details. This charge is automatically reversed. Once registration is complete, you will be eligible to place bids. PAYING FOR YOUR PURCHASES Rightside Auctions accepts the following forms of payment: E-Transfer, Cash, Visa, Mastercard, American Express, and PayPal. Payment Deadline: All invoices must be paid in full no later than 4:00 PM EST on the Sunday following the auction close. Any balance remaining after this deadline will be considered past due, and the credit card on file will be charged automatically. By registering to bid, you expressly authorize Rightside Auctions to charge your credit card for any purchases made. Payment Conditions: Customers may select from the accepted payment methods, subject to the following conditions: " Friday pick-ups must be paid by E-Transfer or Cash only. " Past-due balances will be charged automatically to the credit card on file. " Shipping and/or transfer invoices will be charged automatically to the credit card on file if unpaid at the time of order preparation. Security Notice: For your protection, credit card information will not be accepted via email or telephone. Detailed payment instructions for each payment method will be provided with your invoice. BUYER'S PREMIUM A 16% Buyer's Premium plus 13% HST is applied to all invoices. Additional charges may apply to items that are not picked up, held, or abandoned, as outlined in the Pickup & Removals section of these Terms & Conditions. BIDDING Rightside Auctions reserves the right, at its sole discretion, to void any bid-whether winning or not-that we believe: (i) was not made in good faith or in accordance with these Terms & Conditions; or (ii) was placed with the intent to manipulate or disrupt our services. Rightside Auctions also reserves the right to cancel, revert, or delete any bids and/or maximum bids, winning or otherwise, at any time and for any reason, whether a lot is open or closed. Maximum Bidding: You may place a maximum bid on listed items. When a maximum bid is submitted, our bidding system will automatically place bids on your behalf using the smallest bid increment necessary to maintain your position as the highest bidder, until your maximum bid is reached. If another bidder places the same bid before you or submits a higher maximum bid, you may be notified that you have been outbid and may place another bid within the auction's designated timeframe. Account Responsibility: Rightside Auctions is not responsible for the security of your HiBid account. Any bids placed from your account-whether authorized by you or not-that result in an invoice are binding and are the sole responsibility of the account holder. Use of your account by any third party, with or without your knowledge, is not the responsibility of Rightside Auctions. Any invoices issued as a result of unauthorized or improper account use remain the responsibility of the registered account holder and must be paid in full. Buyers are strongly advised to secure their accounts, protect login credentials, and never share account details to avoid unauthorized bidding or unexpected charges. All bidders are fully responsible for every bid placed from their account. Bid with caution. Carefully review item descriptions, photos, and bid amounts before placing any bid. It is the bidder's responsibility to ensure they are bidding on the correct item and at the intended amount. No exceptions, reversals, or requests related to bidding errors or account misuse will be accepted. All invoices remain due in full. PROHIBITED BIDDER CONDUCT Any deliberate attempt to artificially influence or manipulate the sale price of any listed item(s), whether directly or indirectly, is strictly prohibited. This includes, but is not limited to: bidding through a secondary account, agent, or representative; bidding on item(s) in which you have a financial or ownership interest; communicating or coordinating with other bidders; or engaging in shill bidding or any similar deceptive practice. REVIEWING THE STATUS OF YOUR BIDS During an auction, you may check the status of your bids at any time through your account. No bids may be withdrawn, cancelled, or reversed after they have been placed, for any reason. All items are sold "as is, where is," with all faults, and without any warranties or guarantees, express or implied, including but not limited to fitness for a particular purpose. All bids are legally binding and enforceable. BIDDING NOTIFICATIONS You may choose to receive email notifications during the auction if you have been outbid. Please note that outbid notifications are not sent during the final two hours of the auction. It is the bidder's responsibility to monitor their bids during this time. WINNING NOTIFICATION & INVOICING All winning bidders will receive an email invoice within 24 hours of the auction closing. Invoices are sent to the email address associated with your HiBid account. Rightside Auctions is not responsible for the security of your email account or for delivery issues caused by spam filters, junk folders, or email security settings. Invoices may be filtered into junk or spam folders. Bidders are encouraged to mark our email address as safe and to regularly monitor their email. Bidders are strongly advised to check their HiBid account to confirm whether they have won any items. A status of "May Have Won" means that you have won the item and applies only after the auction has officially closed and been finalized in our system. Once invoices have been issued, the auction is considered fully complete and closed. It is the sole responsibility of the bidder to determine whether they have won items and to ensure timely payment. PICKUPS & REMOVALS Pickup dates and times are posted in the auction details for each auction and will also appear on your invoice. It is the bidder's responsibility to review and understand the posted pickup schedule before placing any bids. Pickup hours listed on our website refer to auction pickup times, office hours may differ. Do not bid if you are unable to pick up all items within the posted pickup dates and times. Shipping may be available for select items-please refer to the Shipping section of the applicable auction for details. Any items not picked up during the scheduled pickup times will be considered abandoned. All items are sold "as is, where is," with all faults. Abandoned items will be forfeited without refund and will be disposed of promptly at the close of the final pickup day. Failure to pick up items or failure to pay an invoice will result in a ban from all future Rightside Auctions. Alternative Pickup Arrangements On occasion, alternative pickup dates or times may be requested. These requests must be made in advance and prior to the auction closing date and are subject to Rightside Auctions' availability and approval. Alternative pickup requests must be submitted by email to Rightsideauctions@gmail.com and are not guaranteed. It is the bidder's responsibility to ensure their request has been confirmed in writing. If approved, a taxable holding fee of $20.00 per week will apply (unless otherwise advised), in addition to the invoiced item cost. Alternative pickup arrangements cannot exceed fourteen (14) days from the auction closing date. Items not picked up within the approved alternative pickup period will be considered abandoned, disposed of, and the bidder will be banned from future auctions. Loading & Assistance Bidders are required to bring their own assistance and equipment for pickup. Rightside Auctions staff and affiliates do not assist with lifting, loading, packing, unpacking, dismantling, or securing items. Pickup Location Unless otherwise stated in the auction listing, all successful bidders must pick up their items at: 434 Lynden Road East, Building #3 Brantford, Ontario Alternate pickup locations cannot be arranged. SHIPPING Rightside Auctions currently offers Canada-wide shipping only. Shipping is available on all eligible lots. Shipping costs are determined by the destination, size, and weight of the package. A handling fee of $6.00 + applicable tax will be added to all shipping orders. Shipping costs are non-negotiable and are set by the shipping carrier. Bidders are strongly advised to consider shipping costs prior to bidding. All shipments are prepared and processed internally by Rightside Auctions and shipped using the most economical available option, which may include: " Purolator (with tracking) " FedEx (with tracking) " Canpar (with tracking) " NationEx (with tracking) United States Shipping Rightside Auctions has suspended all shipments to the United States. This policy supersedes any prior or conflicting information published on our website or other platforms. U.S.-based customers must provide a valid Canadian shipping address in advance. Rightside Auctions reserves the right to decline bids associated with U.S. accounts that do not meet this requirement. Requesting Shipping Shipping must be requested by: " Adding an auctioneer note at registration stating "SHIPPING REQUIRED", or " Emailing bid@rightsideauctions.com (invoice number required) Buyers are responsible for providing a correct and complete shipping address. If the shipping address differs from the address listed on your HiBid account, you must notify us immediately. We do not ship to P.O. Boxes, as all shipments require a signature upon delivery. Payment & Estimates By placing a successful bid, the buyer agrees to pay in full for both the invoice amount and all associated shipping and handling fees. These fees are non-negotiable and non-refundable. Shipping estimates may be requested up to 4:00 PM EST on the Wednesday prior to auction close by email or telephone. Requests must include the delivery address and item/lot numbers. Shipping quote requests received after this deadline will not be answered. Please note that some large or oversized items may not be eligible for shipping. Items that cannot be shipped will be clearly identified in the item description. Shipping Charges Shipping invoices will be automatically charged on the Monday following the auction close, unless payment has already been received. Shipping and handling fees will be charged as a separate transaction once items are prepared and ready for shipment. All shipping and handling costs are the sole responsibility of the buyer and will be charged automatically to the credit card on file. Any applicable duty or customs fees (where applicable) are the buyer's responsibility and may be billed separately. Refunds on Shipped Items Due to logistical constraints, shipped items that qualify under our refund procedures are eligible for auction credit only, and only in cases that strictly meet the requirements outlined in our Refund Policy. All refund decisions are made at the sole discretion of Rightside Auctions management. Shipping costs and handling fees are non-refundable under all circumstances. TRANSFER SERVICES Transfer services are available at select Rightside Auctions locations only. Currently, transfers are permitted only between the following locations: " Edmonton South and Edmonton NW " Brantford and Guelph and Hamilton Transfers cannot be arranged outside of these designated routes and requests outside of these setups will not be accepted. Upon request, your items can be transferred to our Guelph or Hamilton Location. This service has a fee of $10.00 plus tax per invoice. We must have received full payment before transfering can be processed. Transfers occur every other week. Must be requested via email or auctioneers notes. All transfer services are subject to a taxable transfer fee. Specific transfer terms, fees, and procedures may vary by location and bidders are required to refer to the applicable auction location for full details. Transfer dates are subject to change and may be amended without notice, including but not limited to delays caused by weather, holidays, or logistical constraints. Items will not be transferred until the invoice and all associated fees have been paid in full. CONDITIONS OF ITEMS SOLD & ONLINE CATALOG Rightside Auctions makes every reasonable effort to ensure that item descriptions and photographs are accurate and representative. However, all items are sold "as is, where is," with all faults, and no guarantees are made regarding condition, completeness, or functionality. Bidders are strongly encouraged to carefully read the full description of each lot and review all in-house photographs of the actual item(s) (typically shown after any retail or stock photos) before placing a bid. Neither Rightside Auctions nor the seller assumes responsibility for errors, omissions, or inaccuracies in descriptions or images. Please note that this is a Returned Merchandise Auction. Items may be missing parts, damaged, mismatched with packaging, or may show signs of prior use-though some items may have no issues at all. It is the bidder's responsibility to assess condition based on the information provided. Condition Descriptions Any reference to an item's condition reflects an opinion only, not a guarantee: " NEW - To the best of our knowledge, the item appears unused. This does not mean factory sealed. " USED - In our opinion, the item shows signs of prior use. " GENTLY USED-Not new, but in like-new condition " FACTORY SEALED/SEALED - The item arrived factory sealed. " No condition listed - No opinion is provided, or the condition is evident from the in-house photographs. It is the bidder's responsibility to form their own conclusions regarding condition based on the photos and description provided. While reasonable efforts are made to inspect items, not all items are tested or fully inspected. All items are sold AS IS and all sales are FINAL. Food & Beverage Items Rightside Auctions provides no warranty or representation regarding shelf life, freshness, or food safety for any food or beverage items. The buyer assumes full responsibility for ensuring food safety and compliance with all applicable laws and regulations. Neither Rightside Auctions nor the seller shall be liable for any loss, damage, illness, or injury-medical or otherwise-resulting from the purchase, handling, or consumption of any items sold. RETURNS POLICY By registering for and participating in our auctions, you agree to the following Returns Policy without exception. All items are non-refundable. Returns may be considered only in the form of auction credit, and only under the conditions outlined below. Eligible Returns Return requests will be considered solely in cases of: " Gross misrepresentation of item details, and/or " Complete non-functionality All return claims must be submitted within four (4) days of the auction close. Submitting a Return Request All return requests must be emailed to rightsideauctions@gmail.com and must include: " Invoice number " Item (lot) number " A clear and precise description of the issue " Supporting photos (where applicable) Requests that do not meet these requirements will not be considered. Auction Credit Only Approved returns will be settled exclusively as auction credit. " No cash refunds, chargebacks, or reversals will be issued under any circumstances. " Auction credits do not expire, are non-transferable, and may only be used at the Rightside Auctions location that issued the credit. All return decisions are made at the sole discretion of Rightside Auctions. Non-Returnable Items " Items marked "Sold As Is" in the lot details are strictly non-returnable. " Items cannot be returned due to personal preference or personal circumstance, including but not limited to: o Did not like the item o Did not match expectations o Colour differences o Incorrect size or fit o No longer needed " Items cannot be returned for missing hardware, missing instructions, cosmetic imperfections, or assembly-related issues. " Many items require assembly, which is the sole responsibility of the buyer. Return Process All approved returns require the physical return of the item to our facility. " Rightside Auctions will not retrieve returned items under any circumstances. " No auction credit will be issued until the item has been received and verified. " Buyers are responsible for inspecting all items before leaving our premises. " This policy applies regardless of distance from our warehouse or inability to return an item. " Any costs associated with returning or shipping items back to us are the sole responsibility of the buyer. Photos & Descriptions Bidders are strongly encouraged to carefully review all lot details and photos prior to bidding. Bids cannot be retracted. Retail photos are provided for illustrative purposes only and typically appear first in the listing. In-house photos depict the actual item being sold and accurately reflect what you are bidding on. In the event of any discrepancy, the written description and in-house photos take precedence. SHIPPING / TRANSFER RETURNS The following additional terms apply to shipped or transferred items and are to be read in conjunction with the Returns Policy. All refund or return requests must be submitted by email to rightsideauctions@gmail.com and must include a clear and precise description of the issue, along with supporting photographs where applicable. Requests must be made within four (4) days of receipt of the item(s). All standard return procedures and eligibility requirements continue to apply. Any approved return will be issued exclusively as auction credit. No refunds will be provided under any circumstances. Auction credits are non-transferable, have no cash value, and may only be used at the Rightside Auctions location that issued the credit. Shipping, handling, and transfer fees are strictly non-refundable. All return approvals remain at the sole discretion of Rightside Auctions. CLAIMS No claims regarding goods purchased will be accepted. All items are sold "as is, where is," with all faults, and without warranty or guarantee of any kind. PERSONAL & PROPERTY RISK The Buyer assumes all risk and expressly agrees to indemnify, defend, and hold harmless Rightside Auctions, together with its owners, officers, directors, employees, agents, representatives, affiliates, successors, assigns, and sellers/consignors (collectively, the "Indemnified Parties"), from and against any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses of every kind and nature whatsoever, whether known or unknown, foreseen or unforeseen, direct or indirect, including without limitation legal fees on a solicitor-and-client basis, arising out of or in any way related to: " the Buyer's registration for, participation in, or attendance at any auction; " the purchase, possession, handling, transportation, storage, use, or resale of any item purchased; or " any act or omission of the Buyer or any third party acting on the Buyer's behalf. This indemnity includes, without limitation, claims for personal injury, death, property damage, economic loss, or consequential damages, whether caused in whole or in part by the negligent acts or omissions of any of the Indemnified Parties, except to the extent prohibited by applicable law. This obligation shall survive the completion of the auction and any transfer of title or possession of the purchased items. ADDITIONS & DELETIONS Rightside Auctions reserves the right, at its sole discretion, to add, withdraw, modify, correct, extend, shorten, postpone, reschedule, or cancel any listed item(s), bids, or auction(s), in whole or in part, at any time, whether due to clerical errors, platform issues, system interruptions, technical difficulties, seller instructions, or any other reason, with or without notice. Rightside Auctions shall not be liable for any loss, damage, cost, expense, or claim arising directly or indirectly from any such action, including but not limited to claims related to bidding errors, lost bids, system delays, platform outages, or auction cancellation, to the fullest extent permitted by applicable law. All decisions made by Rightside Auctions in connection with additions, deletions, or modifications shall be final and binding. RESERVE Items are generally offered without reserve. In the event that an item is offered with a reserve, it will be clearly identified in the auction listing. For items subject to a reserve, a minimum bid amount must be met or exceeded in order for a bid to be accepted. All reserve prices are confidential, are established solely between the consignor and the auctioneer, and are subject to the consignor's approval. The Auctioneer reserves the right, at its sole and absolute discretion, to accept, reject, or invalidate any bid on a reserved item, whether before or after the reserve has been met. All decisions regarding reserve items shall be final and binding. AUCTION RECORDS In the event of any dispute, claim, or disagreement, the bidder and/or buyer expressly agrees that the records maintained by Rightside Auctions and/or the HiBid platform, including but not limited to bid histories, timestamps, transaction logs, and system data, shall be deemed accurate, conclusive, and binding for all purposes. ONLINE BIDDING When bidding online, please keep in mind that internet connections and auction software are not always reliable. Technical issues can occur at any time-whether with your device, your internet provider, the auction platform, or our systems. Rightside Auctions is not responsible for connection problems, technical glitches, system delays, or bids that fail to register for any reason. It is the bidder's responsibility to ensure bids are placed successfully. We recommend placing bids early and monitoring your bids closely. SOFT CLOSE Lots close at staggered intervals. To prevent last-second "sniping," any bid placed within the final minute of a lot's closing time will automatically extend the closing time by an additional three (3) minutes. This extension will continue until no further bids are placed and bidding has fully concluded. BIDDING STRATEGY We recommend that bidders enter their maximum bid when bidding online. This does not mean you will automatically pay your full maximum amount. Instead, the system will place bids on your behalf using the smallest bid increment necessary to keep you in the lead, up to your maximum bid. You will only pay one bid increment higher than the next highest bidder, or your maximum bid-whichever is lower. The bidding system works much like a live auction, automatically advancing bids as needed to remain competitive. CATALOG ERRORS & OMISSIONS All written and oral descriptions are opinions only and are not guarantees of authenticity, age, make, model, materials, condition, or value. While Rightside Auctions makes reasonable efforts to catalog items accurately, errors or omissions may occur, and no responsibility is assumed for the accuracy of descriptions, photographs, or catalog information. All items are sold "as is, where is," with all faults. Listed retail values or pricing references are approximate only, and bidders are responsible for conducting their own due diligence prior to bidding. By placing a bid, you acknowledge that you have reviewed the available information, had the opportunity to ask questions, and are satisfied with the condition and description of the item. Photographs may vary slightly from the actual item. In the event of a discrepancy, the written description and in-house photos prevail. Bids cannot be retracted, and dissatisfaction with descriptions, photos, or perceived value does not constitute grounds for return, except as expressly permitted under the Returns Policy. PRIVACY POLICY Rightside Auctions collects personal information only through voluntary contact and registration forms. This website does not use applications or programs that collect information from your computer without your knowledge or consent. Users may be asked to provide contact information, including name, address, phone number, email address, and limited demographic information such as postal code. This information is collected solely for identity verification, record-keeping, and communication related to our auctions. Rightside Auctions does not sell, trade, rent, or disclose your personal information, including your email address, phone number, or physical address, to third parties. In compliance with Canada's Anti-Spam Legislation (CASL), electronic communications sent by Rightside Auctions are used only to provide information related to our auctions, services, or transactional matters. You may withdraw your consent and unsubscribe from non-essential email communications at any time by using the unsubscribe option included in our emails or by contacting us at Rightsideauctions@gmail.com. Personal information is retained only for as long as necessary to fulfill its intended purpose or as required by law. All items sold "AS IS, WHERE IS" with all faults. Please note, failure to do so might lead to delays. PRE-PAID INVOICE PICK UP: Pay your invoice on the evening of auction close (E-Transfer). It will be ready for Friday Pick-up 1:00pm-4:00pm. Please note: No pymts will be accepted on premise on Friday. Orders not paid in advance by e-transfer will not be ready for pick-up until Saturday. Friday pick-up is for pre-paid e-transfer orders ONLY.
