Glass Vault Auction House Terms & Conditions This is an Online Only Auction - Bidding will start to close Monday, November 17th at 7:00 p.m. (soft close in effect) By placing a bid, you (hereinafter the “Bidder”) agree to the Terms and Conditions contained herein. 1. Fees: You will be charged a 15% Buyers Premium plus HST (calculated based on the purchase price of the item you are purchasing), plus a $0.95 handling fee is applied for each item purchased. 2. Payment: Payment of invoices for won bids will be charged to the credit card on file within 24 hours of the close of the final lot of the auction. Bidders are responsible for paying for their purchases prior to picking up their purchases. If a bidder does not pay for their purchased items, the bidder will not be permitted to bid on future listings. 3. Pick-up: Pick-up of purchased items is at Unit 3 - 485 Romeo Street S, Stratford, ON (the “Premise”). Curbside pick-up within 7 days of the close of the auction is required during specified pick-up hours. Any items not picked up during the specified 7 day pick-up window will be considered abandoned and will be resold (“Abandoned Items”). No refunds will be given for Abandoned Items. Buyers should inspect all items prior to leaving the Premises. Buyers need to make sure they have all their purchased items before leaving the Premise. Glass Vault Auction House employees cannot assist with the loading of your vehicle when you pick-up purchased item(s). Bidders need to be sure to bring appropriate help as may be required to load their vehicle with purchased item(s). 4. Shipping: At this time we do not offer shipping of purchased items. We only accept pick-up pursuant the terms in the Pick-up section herein. 5. Returns: If you have not left the Premises, we are happy to examine and discuss any issues you may have with your purchased items before you leave. If you have an issue with a purchased item after leaving the Premises, you must email info@glassvault.ca within seven (7) days of pick-up of the purchased item(s) for an appointment time to bring the purchased item(s) back. All returns are subject to review before a refund is agreed to. Refunds are issued at the sole discretion of Glass Vault Auction House, and are not guaranteed. If you are bringing back a purchased item(s) more than one week from the sale date, you will be charged an admin fee equivalent to 30% of the purchase price of the returned purchased item(s) on the return. We do not accept returns after 14 days of time have passed since the auction started to close. Please note, returns will be denied if a suitable reasoning for the return is not deemed to have occurred at the sole discretion of Glass Vault Auction House. 6. Final Sale: All purchased items are FINAL SALE. All items are sold as is and un-inspected. The items are returned merchandise items and sold without warranty or guarantee. Items may be missing parts, used, broken, damaged, or not be the correct item in the box. When placing a bid, you acknowledge this risk. There are no exceptions to the Final Sale policy. Glass Vault Auction House makes their best effort to represent all items accurately in descriptions and photographs, however Glass Vault Auction House does not make any warranties or representations of any kind, implied or otherwise, with respect to the purchased item(s), and in no event shall be held responsible for having made or implied any warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin and condition of purchased item(s). If a description does not match a picture in a lot, the description takes precedence. 7. Bidding Terms: New Bidders with Glass Vault Auction House must be registered and approved to bid before 5pm EST on the day of the auction. By accepting the terms and conditions of Glass Vault Auction House, you agree that we have the right to request photo ID and Credit Card from you. Bidders must ensure that they are registered with their own credit card. Bidders are not allowed to register with credit cards that are not in their own name. If it is discovered by Glass Vault Auction House that a credit card is not in the Bidders name, we reserve the right to block the account and restrict bidding abilities on said account. Bid cancellations are not permitted. Do not place a bid on any item unless you intend to bid on the item or items in question. We will not cancel bids placed for any reason. By agreeing to the Glass Vault Auction House terms and conditions, all Bidders agree that they are held responsible for their account. If other people use the account without the permission of the Bidder, the Bidder whose name is on the account is still responsible for paying for successfully purchased items. Do not share your account information or password with others. Do not stay logged in to your computer. Bidders are responsible for their account. At the time of registration, Glass Vault Auction House collects information about Bidders to verify who they are before they can bid. We collect credit card information to ensure that they are qualified buyers. All Bidders must be of legal age to bid. There is no cost to register for an auction. Bidders’ credit cards will not be charged unless they win. When an auction closes, all winning Bidders will receive an e-mail with an attached invoice or receipt from info@glassvault.ca During an auction Bidders can check the status of their bids at any time. Note that no bids can be withdrawn after the auction for any reason. All items are sold as is, where is, with all faults accepted by the Bidder. Bidders can choose to be notified by e-mail during the auction if they have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale. Glass Vault Auction House reserves the right to remove and/or add lots and/or items to the sale at any point during the auction. In the unlikely event of a dispute, Bidders agree to accept as true the information that we have in our records. Items close at regular intervals. To prevent a Bidder from 'sniping', all bids made in the last minute of the auction will force an item to stay open for an additional 1 minute. This will continue until all bidding has ceased. Glass Vault Auction House recommends that all Bidders put in their maximum bid when placing a bid online. This does not mean Bidders will have to pay the amount they bid; they only pay one bid more than the next highest bid, and only up to their maximum bid. The software system will play out the bids as they would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment. 8. Liability and Indemnity: Bidders hereby covenant and agree that should any claim, action, proceeding, or otherwise (hereinafter “Claim”), be levied against Glass Vault Auction House, its employees, agents or assigns by any third party as a result of a bid or purchase, the Bidder will indemnify and save harmless Glass Vault Auction House, its employees, successors, agents or assigns for all costs and/or damages that arise from such Claim including, but not limited to, any incidental costs that arise thereto including legal costs. Bidders hereby waive, release, hold harmless and forever discharge Glass Vault Auction House, its employees, successors, agents or assigns of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that they may ever have, arising from or in any way related to the placing of a bid or the purchase of an item using Glass Vault Auction House services or platforms. 9. Email Communications: As per Canada’s new anti-spam legislation (effective date July 1, 2014), Glass Vault Auction House is required to secure a Bidder’s consent to communicate with them electronically. By registering for this auction, Bidders are opting in to receive auction notices from Glass Vault Auction House (info@glassvault.ca). Bidders may withdraw their consent at any time by clicking on the unsubscribe link contained within each auction notice. Bidders’ privacy is important to us. A Bidder’s email address will not be shared with any other party. By bidding, Bidders are acknowledging agreement with the terms above. Do not bid unless you agree to all of these terms. 10. General The parties agree that in the event that any provision, or clause herein, or part thereof, which form part of these terms and conditions, are deemed void, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions, clauses, or parts thereof, shall be and remain in full force and effect. These terms and conditions shall be governed by and constructed in accordance with the laws of the Province of Ontario, Canada.
