Opportune Finds – Auction Terms & Conditions
IMPORTANT: By registering and participating in any auction hosted by Opportune Finds, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety. These Terms are legally binding and enforceable.
Opportune Finds reserves the right to modify these Terms at any time, without prior notice.

1. Registration & Bidder Eligibility
1.1 Registration Requirement
All bidders must register through our official website and/or HiBid platform. Bidders are responsible for maintaining accurate and up-to-date registration information, including payment details and contact information.
1.2 Credit Card Authorization
A temporary $1 authorization may be charged to verify credit card validity during registration. This is not a purchase charge and will be released after verification.
1.3 HiBid Reputation Requirement
Opportune Finds reserves the right to decline or revoke bidding privileges at its sole discretion, particularly for bidders with negative HiBid history. A refundable $300 CAD deposit may be required for bidders with prior negative auction activity.
1.4 Payment Preferences
Payment is charged on the provided credit card. If the bidder wishes to pay via cash or EMT, please indicate in comments section upon registration.
1.5 Shipping
Shipping is provided on certain lots. Shippable lot are indicated with a truck icon on lot page. Items are shipped at buyer's expense. Details can be agreed upon via follow up email post auction. All non shippable purchases must be picked up in person.

2. Auction Process & Bidding
2.1 Bids Are Final & Binding
ALL BIDS ARE FINAL AND NON-REVERSIBLE. By placing a bid, you are entering into a legally binding contract to purchase the item(s) if you are the successful bidder. Bid cancellations are not permitted under any circumstances.
2.2 Right to Adjust Auction Inventory
We reserve the right to add, remove, consolidate, or adjust lots or listings prior to auction close to correct errors or omissions.
2.3 Item Descriptions & Representations
All items are described and photographed with the intent to provide a general understanding of their condition. However, no guarantees are made regarding the accuracy, completeness, or detail of any description, photograph, or representation provided.
Items offered for sale may include returns, overstock, shelf-pulls, undelivered goods, or liquidation inventory and may present varying conditions, including but not limited to: new, open box, used, damaged, defective, or incomplete.
It is the sole responsibility of the bidder to carefully review all available photos and descriptions before placing a bid and inspect the item before pickup.
By bidding, you acknowledge and accept that all items are sold “AS-IS, WHERE-IS” with no guarantees expressed or implied regarding functionality, condition, completeness, merchantability, or fitness for a particular purpose.

3. Invoicing, Fees & Payment
3.1 Invoicing
Invoices will be issued within 24 hours post-auction. Invoices include:
• Hammer Price
• 15% Buyer’s Premium
• Handling charge $1 per lot
• Applicable Sales Tax (HST), if applicable
3.2 Payment Deadline
Full payment is deducted from provided credit card after auction and before sending invoice. The invoice will indicate “Paid in full.” If this is not indicated on the invoice, payment will be required upon pickup. We accept cash or e transfer as mode of payment. Failure to remit payment may result in forfeiture of items, cancellation of bidding privileges, and possible legal action.

4. Pickup, Removal, & Forfeiture
4.1 Pickup Policy
Pickup is by appointment only. No walk-ins. Upon auction close, email is sent with booking link. The winning bidder may choose preferred date and time of pickup of auction items from link provided. Appointments require 4 hours’ notice, exceptions can be made in some cases.
4.2 Unpaid / Uncollected Items
If the winning bidder is unable to pick up items during the provided pickup dates and time window, send us an email to opportunefinds@gmail.com. We will accommodate genuine requests to the best of our ability.
If no appointment is booked and no request received within 7 days of auction close, the invoice will be considered as abandoned. No refund will be issued for any abandoned order and items will restocked or resold without notice.
4.3 Verification at Pickup
Photo ID and the payment confirmation are required for release of goods.
4.4 Buyer’s Responsibility
Buyers are responsible for bringing appropriate help and equipment to safely remove purchases. Opportune Finds is not responsible for loading items.

5. Condition of Goods – AS-IS, WHERE-IS Disclaimer
ALL ITEMS ARE SOLD STRICTLY “AS-IS, WHERE-IS” WITHOUT WARRANTY OR GUARANTEE OF ANY KIND, EXPRESS OR IMPLIED.
This includes, but is not limited to, warranties of:
• Condition
• Functionality
• Merchantability
• Fitness for a particular purpose
• Completeness (parts/accessories/manuals may be missing)
Items may include Amazon returns, undelivered packages, liquidation, shelf-pulls, customer returns, or overstock. These goods may be new, open-box, damaged, defective, or incomplete.
NO GUARANTEES OF WORKING CONDITION OR RETAIL VALUE ARE PROVIDED.

6. Returns, Refunds & Credits
6.1 No Returns / Final Sale Policy
All sales are final. No refunds, exchanges, or credits will be issued except under the following narrow exceptions:
• Item received is materially different from the auction description (substantial misdescription only).
• Non-functional goods where a written “working” guarantee was explicitly provided.
6.2 7-Day Guarantee for Non-Inspected Items (Optional)
A 7-day guarantee applies only to buyers who do not have the opportunity to inspect items at pickup. This guarantee covers items received materially not as described. Once items are inspected at pickup, they are final sale.
6.3 No Returns for Buyer’s Remorse or Oversight.
Failure to read descriptions, view photos, or misunderstand condition is not grounds for return.

7. Abandonment of Items
Items not paid for or collected within 3 days of date agreed for pickup will be deemed abandoned without further notice. Abandoned items will be resold without credit or refund.

8. Fraud Prevention & Security
We reserve the right to request additional verification at any time. Identity, payment method, and registration details must match or we may refuse release of goods. Suspicious activity may be reported to authorities.

9. Limitation of Liability & Indemnification
Opportune Finds, its agents, employees, and affiliates shall not be held liable for any direct or indirect damages, losses, or injuries resulting from participation in auctions or pickup/removal of items.
All bidders agree to indemnify and hold harmless Opportune Finds from any claims arising from their participation or purchases.

10. Governing Law & Jurisdiction
These Terms shall be governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved exclusively in the courts of Ontario.

Acceptance of Terms
Your participation constitutes full acceptance of these Terms & Conditions. Non-compliance may result in revocation of bidding privileges and legal action.
