By registering and placing bids in this auction, you agree to all terms and conditions set forth below. If you do not understand or accept these terms, please do not bid. Bidding constitutes a binding contract to purchase under the following conditions:

1. BUYER’S PREMIUM & TAXES
A 15% buyer’s premium will be added to all purchases. Oklahoma sales tax will also be applied to the final invoice.
If you have an Oklahoma resale permit or farm exemption, a copy must be emailed to the auction company before paying at the close of the auction to qualify for exemption.

2. PAYMENT TERMS
Payment must be made in full prior to the removal of any items. Accepted forms of payment include:
• Cash
• Cashier’s Check
• Major Credit Card. You will be contacted after the auction closes to arrange payment.
Credit card purchases are subject to bank verification prior to pickup.
There will be no charges to your card until a purchase is made.

3. ALL SALES FINAL / AS-IS CONDITION
All items are sold AS-IS, WHERE-IS, with all faults, imperfections, and errors of description.
No warranties, express or implied, are made by the auctioneer or seller.
Descriptions and statements are provided in good faith and believed to be accurate, but are matters of opinion only.
Due diligence is the sole responsibility of the bidder.

4. CATALOG ACCURACY
Every effort has been made to prepare accurate item descriptions. However, Hendren Auctioneers shall not be responsible for any errors, omissions, or inaccuracies in the catalog or online listings.

5. DEFAULT OF BUYER
Any successful bidder who fails to pay for items within the designated time frame will be considered in default.
Buyers in default may be prohibited from participating in future Hendren Auctioneers sales.
Both the Seller and Auction Company shall indemnify and hold Hendren Auctioneers harmless from any costs, losses, liabilities, or expenses, including attorney’s fees, arising from a Bidder’s or Seller’s failure to fulfill obligations under this agreement.

6. PICKUP & REMOVAL
Buyer is responsible for all pickup costs, loading, and transportation.
Pickup must occur within the specified pickup times on the pickup day unless other arrangements are made at the time of payment.
Pickup address will be provided to winning bidders.
Abandonment Policy:
Any item not removed by the published deadline may be deemed abandoned and resold at the discretion of the auctioneer.
Storage or disposal fees may apply, and no refunds will be issued for abandoned property.

7. BIDDING & REGISTRATION
Bidding rights are provisional. Hendren Auctioneers reserves the right to reject any registration or terminate bidding activity if identity or intent cannot be verified.
Bidders are responsible for maintaining the confidentiality of their username and password.
By using this site, bidders agree to comply with all local, state, and federal laws.
Violations will result in the termination of bidding privileges.

8. MAXIMUM BID FUNCTION
When you place a maximum bid, the system will automatically bid on your behalf up to your entered amount, but only if competing bids are placed.
The system does not automatically advance the price to your maximum unless outbid.

9. AUCTION CLOSING / SOFT CLOSE
This is an online-only auction.
A 2-minute soft close is in effect — if a bid is placed within the last two minutes, bidding will automatically extend until no further bids are received.

10. TECHNICAL ISSUES
In the event of server, software, or internet issues, Hendren Auctioneers reserves the right to extend, pause, or reopen bidding as needed.
Neither Hendren Auctioneers nor the software provider shall be held responsible for missed bids, connectivity failures, or technical malfunctions of any kind.

11. CONDUCT OF THE AUCTION
The conduct of the auction and all bidding increments are at the sole discretion of Hendren Auctioneers.
The auctioneer reserves the right to reject any and all bids, remove or withdraw any lot, or cancel an auction entirely prior to the close of bidding.
If any item is lost, damaged, or stolen prior to pickup, Hendren Auctioneers reserves the right to void or refund the winning bid at the auctioneer’s discretion.
All decisions of the auctioneer are final and binding.

12. RISK OF LOSS & TITLE
Title and risk of loss pass to the buyer immediately upon the close of the lot.
Once sold, all responsibility for the item, including theft, damage, or loss, transfers to the buyer.
Buyers should arrange for insurance or prompt removal to protect their purchases.

13. LIMITATION OF LIABILITY
Under no circumstances shall Hendren Auctioneers or the Seller be liable for any incidental, special, or consequential damages.
The total liability of Hendren Auctioneers shall not exceed the purchase price paid for any item.
Buyer agrees to hold harmless Hendren Auctioneers and its affiliates from any claims related to use, handling, or operation of purchased items.

14. HAZARDOUS MATERIALS DISCLAIMER
Some items may contain or have been exposed to hazardous materials (chemicals, refrigerants, batteries, etc.).
Buyer assumes all responsibility for inspection, handling, transport, and lawful disposal of such materials.
Hendren Auctioneers and the Seller make no representations that items are free of hazardous substances.

15. INSPECTION / DUE DILIGENCE
It is the Bidder’s responsibility to inspect all items and verify condition, completeness, and suitability before bidding.
Failure to inspect or ask questions does not relieve the Bidder of responsibility after purchase.

16. CHANGES & ANNOUNCEMENTS
Any terms, corrections, or announcements made by Hendren Auctioneers prior to or during the auction take precedence over any previously published terms or listings.

17. GOVERNING LAW & VENUE
These Terms and Conditions shall be governed by and construed under the laws of the State of Oklahoma.
Any legal action arising from this auction shall be brought exclusively in the courts of Delaware County, Oklahoma.
Bidders consent to jurisdiction and venue in those courts.

18. AGREEMENT TO TERMS
By placing a bid, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
Your bid constitutes a binding legal contract between yourself, the Seller, and Hendren Auctioneers.
