Registration: All Buyers must register in advance of the auction prior to placing a bid. Registration can be done in the office. Live Bidding numbers are lifetime, unless otherwise stated.
All Sales Are Final: No credits or refunds are given.
Limit of Liability: The Bidding Barn LLC is not responsible for damages, theft, fire, or any other types of loss to items purchased or stored.
Bidding: Buyer that places the highest bid shall have the right and obligation to purchase the item.
Bidding is a legal binding contract between The Bidding Barn LLC and the buyer. If disputes arise, the auctioneer has the absolute discretion to settle them and to re-auction the merchandise if necessary.
Auctioneer and Staff Rights: The Auctioneer and the Auction Staff of The Bidding Barn LLC has the right to bid on items in the auction. The Auctioneer also has the right to bid on behalf of an absentee bidder.
Sold Means Sold: when the word “SOLD” or other term of selling is announced. The sale cannot be transferred and constitutes a valid and binding agreement.
Rejecting Bids: The Bidding Barn LLC has the right to refuse any bid, to divide, to combine and to withdraw any lots without given reason. Auctioneer and affiliates may consign items to sell and bid on any lot.
Bidding on multiple items: In cases where 2 or more items are sold, Buyer is bidding on one item only. If Buyer requests more than one of the items being sold, the bidding price will be multiplied by quantity.
Reserves: All items are sold with reserve unless otherwise stated by the auctioneer.
Sales Tax: All sales are subject to local sales tax unless a valid resale number is given.
Buyer Premium: A 10% buyer’s premium is added to all purchases. Internet Premium of 5% will be added to purchases made online.
Payment: All merchandise must be paid for on the day of the sale; unless otherwise noted by The Bidding Barn LLC. Unless other wise stated, all online winning bids will be charged on the HiBid Credit Card by the following Monday at 4 P.M. If the card declines, the winning bidder will be contacted and has 48 hours to pay for the items. If the items are not paid for by Wednesday at 4 P.M., the items will be forfitied. Any bidder who fails to pay for an item may be banned from future auctions.
Merchandise Pick-Up: All merchandise must be picked up on Monday following the auction between 10AM. and 4 P.M. If arrangements cannot be made this day, please call Dakota at 704-389-0104. After 10 day the items will be forfeited and no refunds shall be given.
Shipping is offered by The Bidding Barn LLC, please request shipping if you need it. Shipping will be through UPS or USPS, whichever is cheapest. We will pack the items and ship them out to your address. This is all included in the shipping surcharge. Please allow up to 10 days for your item to be shipped. Items will be automatically shipped
Notary Fee: A Notary Fee may be charged on documents; a Notary Fee may not exceed $10 per signature.
Forms of Payment: Payment is accepted in the form of Visa, MasterCard, American Express, Discover, cash or check. Valid identification is required for all forms of payment except cash. A 4% convenience fee will be charged on all credit card transactions.
Returned Checks: There is a $25.00 charge for all returned checks.
Warranties and Guarantees: All items are sold “As is, where is” with all faults, imperfections, and errors of description. The Bidding Barn LLC does not guarantee any warranties. The buyer assumes full responsibility for their purchased items.
Item Previews: All items can be previewed at a specified time prior to the sale. Motor vehicles or other equipment can be started and driven inside the lot under supervision of The Bidding Barn LLC.
Outside Sales: Outside sales are prohibited and will lead to a permanent ban from The Bidding Barn LLC and Seller and Buyer will be responsible for seller and buyer fees.
Arbitration and Disputes: In the event that a dispute may arise between the parties, it is hereby expressly agreed and understood that such dispute shall be determined by arbitration before the United States Arbitration Association, pursuant to the Commercial Arbitration Rules then in effect, such arbitration is to be conducted in the County of Anson, State of North Carolina, and not by a lawsuit or resort to court process. Buyer expressly agrees to such arbitration and gives up its constitutional right to have any such dispute decided in a court of law before a jury. Such arbitration award shall be final and binding and may be taken to a court of competent jurisdiction and judgment may be entered thereon. The prevailing party shall be awarded its reasonable attorney’s fees, and expenses incurred.
