# **Allen's Auctions - Terms and Conditions**
## **Quick Points to Keep in Mind (Please Read All Terms Below)**
1. **We Can Assist in Shipping.** Buyers are responsible for arranging packing and shipping through third-party services, but Allen’s Auctions can provide assistance.
2. **All Items Sold As Is / Where Is.** Ask questions before bidding.
3. **Payment Due Within 72 Hours.** Failure to pay within 72 hours may result in cancellation and re-listing.
4. **All Terms Are Non-Negotiable.** Bidders are legally bound by these terms when participating in our auctions.

## **1. General Terms**
1.1. By registering and bidding, participants agree to these legally binding terms.
1.2. Allen's Auctions reserves the right to modify these terms at any time.
1.3. Errors in bidding cannot be reversed; bidders are responsible for reading and understanding all terms.
1.4. All questions regarding items or terms must be asked **at least 48 hours prior** to the auction.
1.5. All sales are **final** with no returns, refunds, or exchanges.
1.6. **Allen’s Auctions is not an authenticator.** As we handle estates and consignments, we **cannot guarantee authenticity** of any item. Buyers are responsible for inspecting items prior to bidding or sending a representative to do so.
1.7. Employees of Allen’s Auctions may bid on items during the auction with the intent to purchase and pay for items as any customer would. Employees are bound by the same terms and conditions as any other bidder.

## **2. Registration and Bidding**
2.1. All bidders must register with accurate information before participating.
2.2. A bid constitutes a **legal contract** to purchase the item if won.
2.3. Bids cannot be retracted or canceled once placed.
2.4. The auctioneer determines the winning bid, including resolving disputes between bidders.
2.5. Live, phone, absentee, and online bids are accepted; **the auctioneer's decision is final** in case of bid conflicts.
2.6. **During live auctions, the auctioneer will be selling items quickly. Bidders must place their bids promptly to avoid missing out.**

## **3. Payment and Fees**
3.1. Payments must be made **within 72 hours** of winning an item.
3.2. Accepted payment methods:
- Cash, check, money order, bank check, wire transfer. credit cards
- **Credit card payments are only accepted for invoices under \$500.**
- Personal checks will be held for **10 business days** before item release.
- A **\$25 fee** applies for any bounced checks.
3.3. A **15% buyer’s premium** will be added to the hammer price of each lot. 4% discounted for cash or check
3.4. A **7% NC sales tax** applies unless the buyer provides a valid exemption number.

## **4. Shipping and Pickup**
4.1. **Allen’s Auctions can assist in shipping; however, it is limited by size and weight.**
4.2. **Shipping costs may be expensive; please consider this before bidding.**
4.3. **Shipping costs are the responsibility of the buyer.**
4.4. Buyers may use **any** shipper of their choice, but items must be collected within **1 week** of the auction.
4.5. **Winning bidders must remove items before the last pickup day listed or have items shipped.**
4.6. **Storage fees of \$50 per item per week** apply if items are not collected on time.

## **5. Item Descriptions and Condition**
5.1. **All items are sold "As Is / Where Is" with no warranties.**
5.2. Descriptions are opinions and do not constitute guarantees.
5.3. Condition reports are not provided for multiple-piece lots.
5.4. **Mechanical items (e.g., clocks, watches, music boxes) are assumed non-working unless specified otherwise.**
5.5. **Allen’s Auctions is not responsible for authentication of any item.** Buyers must inspect items themselves or send a representative prior to bidding.

## **6. Auctioneer’s Discretion**
6.1. The auctioneer reserves the right to:
- Withdraw or combine items.
- Reject any bid deemed unacceptable.
- Determine bid increments and settle disputes.
- Cancel or resell an item if payment is not received.
6.2. In live auctions, **floor bids take precedence over online bids** due to transmission delays.
6.3. **During live auctions, the auctioneer will be selling items quickly. Bidders must place their bids promptly to avoid missing out.**

## **7. Liability and Disputes**
7.1. Allen’s Auctions is not responsible for missed bids or technical issues affecting online bidding.
7.2. **Once an item is sold, risk and responsibility transfer to the buyer.**
7.3. Allen’s Auctions reserves the right to refuse service to anyone.
7.4. **Any legal disputes shall be governed by the laws of North Carolina.**

## **8. Additional Terms**
8.1. Invoices not paid within **72 hours** will result in the bidder being reported as a **non-paying bidder (NPB).**
8.2. **Winning bidders must remove items within one week**, or storage fees apply.
8.3. **Auctioneer decisions are final.**
8.4. **Bidding constitutes acceptance of these terms.**
