INTERNET ONLY AUCTION TERMS AND CONDITIONS
Sharp Auction Company LLC
1) CONDITION OF ITEMS
All items are sold “AS IS, WHERE IS,” with all faults and without warranty of any kind.
Sharp Auction Company LLC makes no representations or warranties, expressed or implied, including but not limited to merchantability or fitness for a particular purpose.
Descriptions are believed to be accurate but are not guaranteed. Sharp Auction is not responsible for errors, omissions, discrepancies, or advertising inaccuracies.
Buyers are solely responsible for conducting their own inspections during preview periods. Most items are pre-owned and may not undergo functional testing prior to sale.
Motorized and titled lots are sold strictly AS-IS.
All sales are final.
2) BUYER’S PREMIUM
A 10% Buyer’s Premium will be added to the final hammer price of each lot unless otherwise stated in the specific auction listing.
Buyer’s Premium terms may vary by auction and will be disclosed in each individual auction.
3) PAYMENT TERMS
All purchases must be paid in full at the conclusion of the auction.
Accepted forms of payment:
- Cash
- Approved Check (with bank letter of guarantee)
- Debit/Credit Card (3% Convenience Fee Applies)
- Wire Transfer
Outstanding balances shall accrue interest at a rate of 18% per annum (1.5% per month) until paid in full.
Your credit card on file may be charged automatically unless alternative arrangements are made within four (4) calendar days of auction close.
4) DECLINED PAYMENTS / NSF
If payment is declined, a $25.00 non-sufficient funds (NSF) fee will apply per attempt. Buyer will have 24 hours to provide alternative payment.
If payment is not honored for any reason (including NSF, stop payment, or chargeback), Buyer agrees to pay a $75 returned payment fee in addition to any collection costs.
5) CHARGEBACKS
Buyer agrees not to initiate credit card chargebacks. Any disputed charges must be addressed directly with Sharp Auction Company LLC. Initiating a chargeback may result in collection proceedings and additional fees.
Credit card processing fees are non-refundable once processed.
6) INSPECTION & BIDDER RESPONSIBILITY
By placing a bid, the bidder acknowledges they have inspected the item(s) to their satisfaction or have chosen not to inspect.
Bidders assume all responsibility for condition, authenticity, and value upon submission of a bid.
7) PICKUP, STORAGE & ABANDONMENT
All items must be removed within three (3) business days following the auction unless prior written arrangements are made.
Storage fees may apply beginning on the fourth (4th) business day
Items not removed within seven (7) business days shall be deemed abandoned and become the property of Sharp Auction Company LLC without refund.
Sharp Auction is not responsible for items left beyond the designated pickup period.
8) SALES TAX
Applicable Nevada state and local sales tax will be collected unless valid exemption documentation is provided prior to invoice payment.
9) LOAD OUT POLICY
Sharp Auction Company LLC provides staff and equipment to assist with loading.
Customers are responsible for bringing proper hauling equipment, tie-down straps, pallets, blocking, or tools required.
Sharp Auction Company LLC reserves the right to refuse or discontinue load-out if a vehicle or method is deemed unsafe.
10) FIREARMS & AMMUNITION
Buyer is solely responsible for complying with all applicable federal, state, and local laws regarding the purchase, transfer, and possession of firearms and ammunition.
11) VEHICLES & TITLED PROPERTY
Vehicles and titled items are sold with titles where available. Buyer is responsible for title transfer, registration, licensing, and any associated fees.
12) RESERVES
Certain items may carry reserve pricing. Reserve status will be disclosed where applicable. Sharp Auction Company LLC may place bids on behalf of sellers up to reserve amounts as permitted by law.
13) FRAUDULENT BIDDING / COLLECTION
By bidding, Buyer enters into a legally binding contract.
Sharp Auction Company LLC reserves the right to report non-paying or fraudulent bidders to credit bureaus, other auction companies, collection agencies, and law enforcement where applicable.
Buyer consents to the sharing of identifying information for collection purposes.
14) LEGAL & VENUE
If action is necessary to enforce this agreement, Buyer agrees to pay all attorney fees, court costs, and collection expenses.
Venue for any legal action shall lie exclusively in Humboldt County, Nevada, and shall be governed by the laws of the State of Nevada.
15) GOVERNMENT CONSIGNMENTS
In the event items are sold on behalf of a governmental entity, the terms of the consignment agreement between Sharp Auction Company LLC and that entity shall control where applicable.
17) AI-GENERATED DESCRIPTIONS DISCLAIMER
Sharp Auction may utilize artificial intelligence (AI) tools to assist in generating lot titles, descriptions, and categorization. While every effort is made to ensure accuracy, AI-assisted descriptions may contain errors, omissions, or inaccuracies.
All written descriptions, photographs, and representations are provided for convenience only and are not guarantees of condition, authenticity, completeness, or functionality.
Buyers are solely responsible for inspecting items during preview periods and verifying all information prior to bidding. By placing a bid, Buyer acknowledges that they have relied upon their own inspection and judgment and not solely upon any employee or AI-generated or written description.
