By participating in our auction, you agree to the following terms and conditions: 1) Bidding requirements: Bidders must provide Happy Jay Auctions with full legal name, address, phone number and a driver's license. Online auction bidders must provide a valid credit card in order to bid. 2) Buyer's premium and taxes: A 17% buyer's premium (Dropped to offset tax increase) is added to all purchased lots. Local and state sales tax will be charged when required. There is sales tax on the buyer's premium. The current rate in St. Paul, MN is 9.88%. Tax exempt individuals and organizations must fill out the required forms. Vehicles: An excise tax of $20 will be charged to the buyer. It is the buyer's responsibility to pay sales tax at the time of title transfer. 3) All lots sold AS IS, WHERE IS. ALL SALES FINAL: Happy Jay Auctions is not responsible for the accurate description, authenticity, condition, genuineness or any defects whatsoever of items sold at auction. We will not give refunds or discounts for any inaccurately described, erroneously catalogued, defective or damaged items. Bidders should determine an item's description primarily by viewing in person and secondarily by viewing catalog photos. The written description is our opinion and absolutely no guarantee of what an item is. By placing a bid, the bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. 4) Happy Jay Auctions reserves the right to remove any item from sale for any reason before items are sold. Happy Jay Auctions reserves the right to cancel, reschedule or pause any sale of any or all items in the event of catastrophe, mass outage or other instance which prohibits the auction to function as intended. Example: a regional weather emergency, auction software failure or power grid failure the day of the auction. A rainy day or community ISP failure would not qualify as a mass outage or catastrophe. Be sure to bid early! 5) Payment: Happy Jay Auctions accepts cash, wire transfer, and all major credit cards. Checks are accepted with a valid driver's license that matches the information on the check; we reserve the right to hold merchandise until the check clears. Cash or wire transfer is required for all payments over $1,000, as well as for all Gold and Silver purchases. Payments must be made at the time of pickup during scheduled pickup times. Your credit card on file will be charged for all unpaid invoices that are not paid during scheduled pickup times. 6) Pickup: Your invoice must be paid in full before removal of any items. Bring help to load items if you cannot move them yourself. Do not start removing items without approval from our staff. Items must be picked up during scheduled pickup times. Pickups outside scheduled times can be arranged for an additional fee. Please notify us before bidding if you cannot pick up during scheduled pickup times. 7) Shipping: The minimum fee to ship is about $20. Expect Similar Costs to the UPS or Fedex Stores. At Happy Jay Auctions, we have complete in-house packing and shipping service. If you require shipping and are out of state, please pay your invoice after the auction and we will send a separate invoice for shipping charges the following week. There is no need to call and schedule shipping, but a message or email is recommended. A good estimate for handling rates will be approximately $40/hr plus materials. It is possible for a $15 lot to cost hundreds of dollars to ship. A large group of fragile items can take several hours to pack, double box and cost $150 to print just one label. Bidders are welcome to have a 3rd party handle the shipping of their item(s). For larger items / lots, we offer freight service. The shipping address must match the registered billing address of the credit card used for the payment. If you need the item shipped to alternative address, payment must be made by wire transfer. 8) Storage: Items not picked up or arranged for shipping will be forfeited and become the property of Happy Jay Auctions after 5 days. Items that are not picked up during scheduled pickup times will incur a storage fee of no less than $20. There is no guarantee that items will be available for pickup after scheduled pickup times. Please communicate with us if you cannot pick up during scheduled times.
