TERMS AND CONDITIONS OF AUCTION
Detroit Metro Auctions – Main Street Storage – New Haven, MI
Auction Closes: April 16, 2025
Clean-Out Deadline: April 30, 2025
Notice to Bidders
This agreement serves as a binding contract for all bidders participating in this auction and all future auctions held by Detroit Metro Auctions. By registering and bidding, bidders agree to the following rules and conditions:
1. Registration Required
All bidders must register through Detroit Metro Auctions’ approved platform and agree to these terms prior to bidding.
2. Eligibility
Bidders must be at least 18 years of age with a valid government-issued photo ID.
3. Auction Format
This is an online auction. No in-person preview is available. Photos and descriptions are provided to the best of our ability, but all items are sold AS IS, WHERE IS, with no warranties or guarantees, expressed or implied.
4. Legal Compliance
This auction is conducted in accordance with the lien laws of the State of Michigan. Detroit Metro Auctions is selling the storage unit contents pursuant to a lien or abandonment process. The seller has lawful possession and the legal right to sell all items contained within.
5. Sales Are Final
All sales are final. No refunds or exchanges will be granted for any reason.
6. With Reserve
All units are sold with reserve and may be removed from auction at any time before payment is made.
7. Discretion of Seller
Detroit Metro Auctions reserves the right to cancel any bid or refuse sale if bids are deemed unreasonable or if a bidder fails to comply with terms.
8. Sale Completion
A sale is not complete until full payment is received and the winning bidder has cleared the unit in accordance with the timeline below.
9. Right to Cure
Tenants may pay their balance in full up until payment is received from the winning bidder and the unit is vacated.
10. Binding Bids
Each bid placed is considered a binding agreement to purchase the entire contents of the unit. Once a bid is placed, and if you win, you are obligated to purchase the unit at your winning bid amount. Chargebacks are strictly prohibited.
11. Unit Access & Clean-Out
Winning bidders will have seven (7) days to remove all items from the unit after payment is made. All units must be completely emptied and swept clean no later than April 30, 2025. No trash or items may be left behind.
12. Penalties
Failure to remove all contents or clean the unit by the deadline may result in penalties, loss of bidding privileges, and/or charges for clean-out and disposal.
13. No On-Site Disposal
Dumpsters are not available. All contents must be removed from the premises.
14. Buyer’s Premium & Tax
A fifteen percent (15%) buyer’s premium will be added to all purchases. Sales tax will be charged unless a valid tax-exempt/reseller certificate is provided at the time of payment.
15. Security of Unit
Buyers are responsible for securing units during the clean-out period.
16. Prohibited Conduct
Reselling items on-site, collusion, bid-rigging, or disruptive behavior is strictly prohibited and may result in suspension or legal action.
17. Indemnity
All bidders agree to indemnify and hold harmless Detroit Metro Auctions, facility owners, and staff from any claims or damages arising from participation in the auction.
18. Photography
Photography or video recording on-site is not permitted without prior written consent.
19. Employees & Conflict of Interest
Employees of Detroit Metro Auctions or the storage facility—and their immediate family—are not permitted to bid.
20. Return of Items
In rare legal circumstances, bidders may be asked to return specific items to avoid legal disputes. In such cases, Detroit Metro Auctions agrees to reimburse the bidder for the cost of those items and any reasonable expenses incurred.
21. Clean-Out Deposit (If Applicable) Detroit Metro Auctions reserves the right to require a refundable clean-out deposit(\$250 for each locker). This deposit will be returned after confirmation that the unit has been completely emptied and swept clean to the satisfaction of the facility manager.
22. No Children or Pets on Premises
For safety reasons, children and pets are not allowed on facility grounds during the clean-out or inspection process.
23. Handling of Personal or Legal Documents
If any personal items such as legal documents, photographs, tax records, or identification cards are found within the unit, they must be returned immediately to the storage facility manager. These items are not to be kept or discarded by the buyer.
24. Vehicle Title Disclaimer
Any vehicles found in storage units may not include a title. It is the buyer’s responsibility to pursue a title through the appropriate state channels. Detroit Metro Auctions makes no guarantees regarding vehicle ownership or title status.
25. Surveillance Notice
Buyers acknowledge that the storage facility may be under 24-hour video surveillance. All actions on the premises are subject to review, and buyers must comply with all posted facility rules during clean-out.
26. Payment Terms
Payment methods include Cash, Wire Transfer, Certified Check or Credit Card. When you register and place your first bid, your credit card on file will be authorized for \$1 to validate the card.
27. Extended Bidding
This auction uses extended bidding. The closing time of a lot is extended 5 minutes whenever a bid is placed in the last 5 minutes. The lot will close once 10 minutes pass without an additional bid.
28. Bidder Responsibilities
Bidder is responsible for all bids placed under their account. If you feel your bidder number has been compromised, notify us immediately.
29. Maximum Bid Feature
When using the Maximum Bid feature, understand how it works. To increase your max bid, you may need to bid again at the next increment.
30. Use of Site & Risk
Use of the site is at your own risk. Detroit Metro Auctions is not responsible for interruptions, errors, or omissions. Auctioneer may void sales affected by tech issues.
31. Legal Jurisdiction
Only the laws of the State of Michigan shall apply. Disputes will be governed by Michigan law.
32. Dangerous Premises Disclaimer
Auction sites may be hazardous. You waive any claims against Detroit Metro Auctions for injury or damage not caused by their negligence.
33. No Warranty
All items sold "as is, where is." There are no guarantees of condition, authenticity, completeness, or fitness for a particular purpose.
34. Catalog Discrepancies
Bidders are bidding on described items, not necessarily the photo. Rely on the written description.
35. Privacy & Communication
Detroit Metro Auctions will use your contact info to conduct auctions. Your data will not be sold or rented.
36. Amendment of Terms
Terms may be updated periodically. It is the bidder's responsibility to review terms prior to each auction.
