LLC d/b/a Back to the Past Collectibles (”BTTP”), its licensors, or partners ("Company," "we," "us," "our"). Company and its affiliates provide the Site to you (the "user", "you", and "your", as applicable) for your personal use only and subject to your acceptance of and compliance with these Terms. These Terms are effective as of the time you register for this auction. Acceptance is required to register for each event. This version of these Terms replaces and supersedes any prior terms of use applicable to the Site for this auction event. You may use the Site for lawful purposes only, in accordance with these Terms. You agree to abide by all applicable international, federal, state, and local laws and regulations in your use of the Site. - - - - - - - - - - TERMS OF SALE: • All lots are offered for sale AS-IS WHERE-IS, with a provided option for shipping. Bidders must establish to their own satisfaction the authenticity and condition of the item before bidding. No special warranty is made or implied by Back to the Past Collectibles regarding authenticity or era of described items. • All prices are in U.S. Dollars. Buyer's Premium is 19%. Michigan 6% sales tax is assessed for bidders within the state of Michigan at time of billing unless a tax exemption is on file. • BTTP is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against BTTP if the Internet service fails to work correctly before or during the live auction. • BTTP will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. • All items offered for sale are offered for sale by auction only. There are no presales. • All sales are final at the close of the internet bidding - no chargebacks or negotiations after the close of the auction. • BTTP reserves the right to withdraw or re-catalog items in this auction. - - - - - - - - - - LIABILITY: • Purchaser shall hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the receipt or shipping of items purchased. - - - - - - - - - - BUYER’S PREMIUM: • A buyer’s premium of 19% will be charged for each lot. - - - - - - - - - - SALES TAX: • Michigan sales tax of 6% of the total amount (bid price plus buyer’s premium) will be collected for items picked up or shipped to a Michigan address. • Non-Michigan bidders who pick up in person WILL be charged Michigan sales tax. • No sales tax will be collected for items shipped out of Michigan. • Buyers exempt from sales tax must provide a valid form 3372 for tax-exempt status. • For more information about Michigan sales tax and reseller exemptions, please visit the official page on the Michigan.gov website here: https://www.michigan.gov/taxes/business-taxes/sales-use-tax/information/exemptions-faq - - - - - - - - - - BIDDING: • The Auctioneer reserves the right to refuse any bid not believed to be in good faith. Should any disputes arise between bidders, the decision of the Auctioneer in the exercise of judgment as to the successful bidder will be final and binding. • Consignors are not allowed to bid on their own merchandise nor have any agent bid on their behalf. If the Auctioneer recognizes such bidding or is advised of the same, he may withdraw any or all lots consigned by the offender and will publicly recognize that consignor and/or will block that offender's bidding account. • Bidders with a poor reputation through HiBid™ will be approved only at the Auctioneer's sole discretion and requirements and may be required to place a deposit. - - - - - - - - - - INSPECTION / CONDITION / DESCRIPTIONS: • Auction items are available for inspection <by appointment only> before every auction. Call us at 313-533-3130 Monday through Friday, 9 AM to 5 PM with questions on lots. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Back to the Past (BTTP) may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall BTTP be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. • Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. • BTTP shall endeavor to describe in detail each item and any pertinent information about it. BTTP will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. - - - - - - - - - - RETURNS & REFUNDS • If there is a discrepancy between the description and the picture in a lot, the description will be considered the primary reference. If there is an error listed in the description, a refund will be issued upon notification and confirmation. • We do not accept returns or offer refunds related to buyer’s remorse. However, your satisfaction is important to us. If you’ve received an item that is damaged, or significantly different from how it was described or pictured and you are not satisfied, please call us.
