By registering for this auction you agree to the following terms and conditions. This is a legal binding contract between you, referred to as the “Bidder” and A TOPHAT AUCTION LLC referred to as the “Auction House”. Pick-up/Shipping: SHIPPING is provided for most of the items, limited to the United States. It is imperative that the accurate shipping address is included during the registration process. For pick up items, a scheduled appointment is mandatory, and pick up is restricted to the specified location, which will be communicated to you subsequently at the conclusion of the auction via email. The appointment period is scheduled to commence the week following the conclusion of the auction. The pick-up location will be 5311 S. PENNSYLVANIA AVE Lansing, MI.48911 Should you prefer to have your item shipped or delivered, please inform us at the end of auction. Upon notification, we will calculate and provide you with the applicable shipping fee. Please note, payment of the shipping fee is required in advance of the item's dispatch. Payment Method: Payment is accepted through debit or credit cards. You agree to pay for your entire invoice in full. After the auction has been completed, the Auction House is going to charge the card on file for the items. Please notify us if paying by cash at pickup. Buyer's Premium: The bidder acknowledges that a buyer’s premium of 18% will be applied to the hammer price of each auction item. When submitting a bid, it is important to factor in this buyer’s premium and bid accordingly. For instance, if an item is successfully auctioned for $100, the buyer’s premium would amount to $18, resulting in a total of $118 (excluding Michigan’s 6% sales tax). Registration: Prospective bidders are required to complete the registration process with A TOPHAT AUCTION LLC, which necessitates the provision of valid debit or credit card details and charges $1 which is returned to you. Card Validity: Bidders are accountable for ensuring the accuracy and validity of their debit or credit card information. To avoid overdraft fees, ensure your billing address for debit/credit cards used on https://atophatauction.hibid.com matches your bank records. While registration is $1,(refunded) you need a card to bid. It stays registered until expiry, replacement, or stricter fraud checks trigger its removal. ITEM CONDITION: The condition of the merchandise being offered varies. Buyer understands and agrees: (1) that any description or sample of the merchandise given or furnished by Auctioneer is solely for identification, and does not create any warranty, express or implied, that the merchandise actually conforms to such description or sample; (2) that all merchandise is purchased and accepted by Buyer "AS IS-WHERE IS," 'IN PLACE" and "WITH ALL FAULTS, KNOWN AND UNKNOWN." AUCTIONEER MAKES NO WARRANTIES OR GUARANTEES WHATSOEVER WHETHER WRITTEN, ORAL OR IMPLIED AS TO QUALITY, QUANTITY, CONDITION, LOCATION, USEABILITY, SALEABILITY, WEIGHT, MEASUREMENT, BRAND, MAKE, STYLE, YEAR, MODEL, MECHANICAL CONDITION, PERFORMANCE, AND FITNESS FOR A PARTICULAR PURPOSE OR OTHER SPECIFICATIONS. MANUFACTURERS WARRANTIES MAY BE IN EFFECT. NO SALE SHALL BE INVALIDATED AND AUCTIONEER SHALL HAVE NO LIABILITY FOR A MISDESCRIPTION OF ANY ARTICLE OR LOT WHETHER CONTAINED IN A CATALOGUE, ADVERTISEMENT OR OTHERWISE. Descriptions have been prepared for guide purposes only and shall not be relied upon by Buyer for accuracy or completeness. By submitting a bid, Buyer/Bidder affirms it has inspected all items or has waived its right to do so prior to bidding. Buyers shall be deemed to have relied entirely upon their own inspections and investigations. Final bids made from your account ARE NOT SUBJECT TO CANCELATION. AS DISCLAIMER: The buyer acknowledges and agrees that all sales are final. All items are sold on an "as-is, where-is" basis, with all faults and without warranties. Auctioneer's Authority: The auctioneer retains the right to amalgamate, reduce, augment, or eliminate lots at their discretion. Minimum Bid and Offer Acceptance Each item listed for auction on our platform is subject to a minimum bid amount specified by the seller (the "Consigner"). This amount is established to ensure that offers start from a baseline value deemed acceptable by the Consigner. Making an Offer Below the Minimum Bid: In instances where a prospective buyer is interested in making an offer that is below the specified minimum bid ("Under-Minimum Offer"), such offer may be submitted directly to us via email for consideration. Upon receipt of an Under-Minimum Offer, we reserve the right, at our sole discretion, to present this offer to the Consigner. The Consigner shall then have the option, but not the obligation, to accept the Under-Minimum Offer. Should the Consigner decide to accept an Under-Minimum Offer, it is acknowledged that the sale price of the item will be less than the minimum bid previously established. Consequently, the Consigner will receive a reduced sale amount for their item. Notwithstanding the acceptance of any Under-Minimum Offer, A TOPHAT AUCTION LLC will retain its agreed-upon percentage of the sale price as commission for facilitating the sale. Acceptance of an Under-Minimum Offer by the Consigner and the completion of the sale transaction shall be considered final. By accepting the offer, the Consigner agrees to the sale terms and acknowledges that the item will be sold for the offered amount. It is at the sole discretion of A TOPHAT AUCTION LLC to determine which, if any, Under-Minimum Offers are presented to the Consigner for consideration. Not all Under-Minimum Offers may be communicated to the Consigner. A TOPHAT AUCTION LLC reserves the right to modify these terms and conditions at any time without prior notice. All participants in the auction process are encouraged to review these terms regularly to stay informed of any changes. CLAIMS LIABILITY: The bidder or purchaser agrees to save the Auction House from any and all actions, claims, debates, demands, judgements, liabilities, costs, and attorney's fees arising out of, claimed on account of, or in any manner predicated upon loss of or damage to property and injuries, illness or disabilities to or death of any and all persons whatsoever, including members of the general public, or to the property of any legal or political entity including state, local or interstate bodies, in any manner caused by or contributed by the bidder or purchaser, it agents, servants, employees, or any person subject to its control while in, upon or about the sale site and/or the site on which the property is located, or while the property is in the possession of or subject to the control or the bidder or purchaser, its agent, servant or employees after the property has been removed from Consignor's control. Storage Fees and Unclaimed Lots: All items won at our online auctions must be paid for and collected within 7 days from the last day of designated pick up dates sent via email. If not settled and collected within this period, a storage fee of $2 per lot, per day will accrue and items may be resold at the bidder's expense. Bidders agree to pay these storage fees. Items will not be held beyond 15 days post-auction. After this, items will be deemed abandoned and resold. Abandoned Product Policy: Abandoned items will incur a storage fee, restocking fee, and reshelving process. Accounts responsible for abandoned items will be suspended until further notice. Appeals for account reinstatement may be submitted in writing and will be reviewed on a case-by-case basis. Bidding Errors and Software Malfunctions: In the event of a bidding error, the bidder must promptly contact the Auction House. Bidding errors cannot be rectified after the bidding has concluded for those items. If a bidding error occurs on the last day of the auction, it may not be possible to address the issue in time, and the bidder may be responsible for paying the invoice amount. The Auction Houses will not assume any bid is an error. If there is a malfunction in the software and/or bidding system used by the Auction House, the bidder agrees not to hold the Auction House accountable. Lot Removal: We retain the right to withdraw any lots or items from the auction, even if there are already bids on them. This action can be taken at any time without prior notice, including, but not limited to, after the auction has concluded. SALES TAX: Buyers will be charged all applicable taxes unless SATISFACTORY PROOF OF EXEMPTION is provided to the Auctioneer prior to payment. If satisfactory proof is not provided, Buyer will pay all applicable taxes to the Auctioneer. No taxes will be refunded once the tax has been collected. Proof of exemption, subject to approval by Auctioneer, includes VALID RESALE CERTIFICATES, EXEMPTION CERTIFICATES, VALID CRS only, and any other documents as governed by applicable local, state, and federal laws deemed acceptable at Auctioneer's sole discretion. Taxes are calculated AFTER the buyer's premium. These Terms and Conditions can be changed at any time without notice. Please read these terms and conditions each time you register for one of our auctions. Payment Terms
Payment by credit card after auction ends with card that you registered with. We can take cash and or credit card at pickup.
Let us know if you need shipping after the auction and a price quote will be given and charged upon your approval for shipping. Packing materials $1.00, Box or envelope $2.00 will cover most items, Handling fee $10.00, & delivery fee from USPS, UPS will make up the shipping fee. We use Shipping Saint for most items and that is where the invoice for shipping will come from. We are also offering a delivery service for $25 for the Lansing area and we must be notified at the end of the auction to set it up, delivery is only on Sat and Sunday 4-6. If items are not picked up within time frame listed, there will be a storage fee of $2 per day till picked up & charged to card on file and forfeited after 7 days after pickup time frame ends.
