Registration: You may use the Services without registration; however, prior to placing any bids, you must register an account. Upon registration, you agree to all terms and conditions applicable to bidders and buyers. We may deny registration to you at anytime at our sole discretion. A valid credit card is required to register and bid on an item. We will be using Stripe as our credit card processor. All payments must clear processing before any items will be released. The Auction: Conditions of items sold: All items are sold "as is, where is" and we do not guarantee the quality, accuracy, legality, safety, availability or regulatory compliance of any items, which may include infant and child products. Unless authentication is provided, all items are sold without a certificate of authenticity. Buyer beware. Auction: Each auction consists of a single "lot", which may consist of one (1) or more items. Description of the lot is provided with photos. Please review them carefully before making any bid. If a description does not match a picture in a lot, the description takes precedence. Prior to bidding, review descriptions and images for any damage to the item. Thoroughly inspect the items at Preview. (Preview available by appointment only. Usual hours available are 2PM-7PM up to the day before closing begins. All items are kept offsite, so we need at least a 24 hours notice to set up for viewing. Call Joe at 781 985-0978 to request a preview.) Again inspect your items at pickup and report any concerns immediately. Bidding: By placing a bid on a lot, you are making an irrevocable offer to buy all of the items in the lot at the price you bid unless or until it is outbid by another prospective buyer. Such bids cannot be removed/altered/retracted by you. At the end of the auction, if your bid is the highest offer, above a minimum reserve set by the Seller, if any, your offered price is considered accepted by the Seller and becomes a binding contract to purchase the lot at the price accepted plus any buyer premium and all applicable taxes. If you enter the maximum amount you are willing to offer on a lot, you are agreeing to have your bid automatically increased up to your maximum bid amount entered. The Auction program will automatically increase the bid for you to the lesser of your maximum bid amount or one (1) minimum bid increment amount above the next highest bid. Until your maximum is outbid. Soft close: Each bid made in the last two minutes of the auction will add two minutes to the bid period. This will continue until the extended time has run out without new bids being placed. This is done to ensure transparency and fairness of bidding and enable the highest bidder to win. If you plan to rebid after being outbid, be prepared to monitor your bids during the final minutes of closing. Kelley's Auction, in its sole discretion, reserves the right to remove a lot or reset bids on a lot in an auction. Shipping/Pickup of items: Shipping is available on all coins, jewelry, and other easily packaged items. There is a MINIMUM $6.00 Shipping charge. We do not offer shipping on larger items unless specifically noted in the description.. Do not bid if you cannot attend (or arrange for) pickup at the published pickup date/time/location. We do not supply tools, packing material or assist with moving your purchases. Please bring help to move large items. You are responsible for damage to property caused directly by you or your help with the repair costs being your responsibility. Do not bring pets and young children to the pickup as the movement of items may present a high risk and dangerous environment that could result in injury or death. If you're moving any heavy, fragile or specialty items, we recommend that you hire professional movers. At time of pickup, prior to releasing any items, all buyers must (i) show a copy of the PAID invoice (digital or hard copy), (ii) show a valid government approved photo ID, (iii) be ready to show the credit card used for purchases for verification purposes, and (iv) provide proof that any requirements specific to the auction have been met. If you are unable or fail, to pickup the item(s) on the date/time/location stated on you invoice, you will be considered to have abandoned such item(s). You may make a special request for an alternative pickup date/time/location, which we will try to accommodate. Ensure you inspect the items at pickup (and preview if available) and immediately inform the Seller or its representative of any issues related to mis-cataloging. Please note that the vast majority of items will be in used condition and all items are offered in "as is, where is" condition. By departing from the pickup site, you are deemed to have all your items and that you are satisfied with them. No refunds or claims are permitted after removing items from the premises as item condition issues cannot be validated once items are released into your possession. If required for your own satisfaction, bring an expert to validate purchases at pickup. Billing/invoicing: For all Winning Bids, a 15% buyer's premium shall be charged on the Hammer Price. You will receive a "Settlement" statement listing all item won and the Buyer Premium of 15%. This statement WILL NOT include shipping charges (which must be determined next day). Your invoice including all shipping and taxes (if applicable) will be sent within 24 hours of closing. All amounts are due on the invoice date. Invoices greater than $500.00 or deemed to be high risk may require identity verification by the payment processing provider. If your invoice remains unpaid 72 hours after invoiced date and time, you will be deemed to have forfeited the applicable auction and be noted as a non-paying bidder. All amounts due hereunder are subject to applicable taxes.
