Ownership Disclosure
All merchandise offered in this auction is owned and sold by Spendwise Liquidations. This is not a consignment auction.
Spendwise Liquidations is solely responsible for cataloging, photographing, listing, payment processing, customer service, and pickup for this auction.
By registering, bidding, or participating in this auction, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
Registration & Bidding
By registering to bid, you certify that all information provided is accurate and complete.
Spendwise Liquidations reserves the right to approve, deny, suspend, or revoke any bidder registration at its sole discretion.
Accounts may be denied or removed for reasons including, but not limited to:
Suspected fraudulent activity
Duplicate accounts
Invalid contact information
Non-payment history
Abuse of the bidding platform
Violation of these Terms & Conditions
All bids are legally binding.
Once a bid has been placed, it cannot be withdrawn or canceled.
Auction Format
This is an online auction utilizing a Soft Close.
Lots begin closing at the advertised closing time.
If a bid is placed during the final moments of bidding, bidding for that lot will automatically extend in accordance with the auction platform's Soft Close settings.
Lots close in staggered intervals.
Bidders are responsible for monitoring the auction until all desired lots have closed.
Payment
Winning bidders are responsible for payment of all purchases.
Invoices include:
Winning Bid Amount
15% Buyer's Premium
Applicable North Carolina Sales Tax (unless tax exempt)
Accepted Payment Methods
Credit or Debit Card
Cash at Pickup
Buyers wishing to pay with cash should notify Spendwise Liquidations before the auction closes to prevent automatic processing of the card on file.
Failure to pay for purchased items may result in:
Suspension or permanent removal from future auctions
Cancellation of bidding privileges
Collection efforts
Recovery of associated collection costs where permitted by law
Partial payments and payment plans are not accepted.
Sales Tax
North Carolina sales tax will be collected unless a valid resale or tax exemption certificate has been received and approved before payment is processed.
Buyers are responsible for ensuring their exemption documentation is current and submitted prior to bidding whenever possible.
Pickup Policy
This is a pickup-only auction unless otherwise stated in the auction description.
Buyers are responsible for reviewing the published pickup location, dates, and hours before placing a bid.
Winning bidders are responsible for removing all purchased items during the published pickup period.
Late Pickup Fee
A $15 per day Storage & Handling Fee will be charged for any invoice not picked up before the published pickup deadline.
This fee begins immediately after the scheduled pickup window closes and must be paid in full before any items will be released.
Payment of the Storage & Handling Fee does not extend the pickup deadline or guarantee storage of purchased items.
Abandonment & Forfeiture
Failure to remove purchased items by the published pickup deadline constitutes abandonment of the property by the buyer.
Items not removed within the advertised pickup period will be considered abandoned and forfeited without refund.
Abandoned property immediately becomes the property of Spendwise Liquidations and may be resold, donated, recycled, scrapped, or otherwise disposed of at our sole discretion without further notice.
No refunds or credits will be issued for abandoned items.
Buyers are responsible for removing all purchased items during the pickup period. Items left behind after a partial pickup are subject to the same Storage & Handling Fee, abandonment, and forfeiture provisions.
Requests for shipping, alternate pickup dates, transfers to another location, or extended storage made after the auction closes may be declined at the sole discretion of Spendwise Liquidations.
Buyers are responsible for bringing adequate help, equipment, and vehicles to remove purchased items safely.
Loading assistance may not be available.
Merchandise Condition
Spendwise Liquidations acquires merchandise from major retailers, distributors, manufacturers, and other commercial sources.
Inventory may include:
Overstock
Shelf Pulls
Customer Returns
Open Box Merchandise
Refurbished Merchandise
Salvage Merchandise
Undeliverable Freight
Items are sold in varying conditions ranging from New to Used, Damaged, Incomplete, or For Parts.
Each listing includes the condition believed to be accurate at the time of cataloging.
Photographs & Descriptions
Listings may include:
Manufacturer stock photographs
Manufacturer descriptions
Actual photographs of the item
Stock photographs are provided for product reference only.
Actual photographs are the primary representation of the item being sold and take precedence over stock photographs and manufacturer descriptions.
Manufacturer descriptions may describe the original retail package and should not be interpreted as a guarantee that every accessory or component is included.
If an accessory, attachment, manual, remote, battery, charger, cable, mounting hardware, packaging, or other component is not visible in the actual photographs or specifically stated in the listing, buyers should not assume it is included.
Buyer's Responsibility
Buyers are responsible for carefully reviewing:

Specifications
before placing a bid.
Failure to inspect the listing or read these Terms & Conditions does not relieve the buyer of their responsibility.
Questions should be asked before bidding.
Inspection
Items are available for inspection only when specifically advertised.
Failure to inspect an item before bidding does not constitute grounds for cancellation or refund.
All Sales Final
All property is sold AS IS, WHERE IS, WITH ALL FAULTS, AND WITH NO GUARANTEE OF COMPLETENESS OR FUNCTIONALITY, unless expressly stated otherwise in the individual listing.
No guarantees or warranties, expressed or implied, are provided unless specifically stated in the listing.
All sales are final.
No refunds, returns, exchanges, or bid cancellations will be granted except where required by applicable law.
Catalog Accuracy
While every effort is made to provide accurate descriptions and photographs, errors may occur.
Spendwise Liquidations reserves the right to:
Correct listing errors
Correct photographs
Correct descriptions
Correct quantities
Withdraw items
Cancel lots
Void sales resulting from clerical, technical, or cataloging errors
Technology Disclaimer
Spendwise Liquidations is not responsible for:
Internet interruptions
Website outages
Software errors
Platform failures
Delayed bids
Missed bids
Device or browser issues
Power or communication failures
Bidders are encouraged to place bids early and utilize Max Bids whenever appropriate.
Limitation of Liability
Buyers assume all responsibility for the removal, transportation, installation, operation, and use of purchased items.
Spendwise Liquidations shall not be liable for:
Personal injury
Property damage
Lost profits
Consequential damages
Transportation damage
Improper installation or use of purchased items
Chargebacks & Payment Disputes
By participating in this auction, buyers acknowledge that purchases are governed by these Terms & Conditions.
Initiating a chargeback or payment dispute does not relieve the buyer of any contractual obligations, including payment, pickup, Storage & Handling Fees, abandonment, or forfeiture of purchased property.
Any payment dispute or chargeback initiated contrary to these Terms may be contested using auction records, registration records, invoices, photographs, payment records, email communications, and bidder acceptance of these Terms.
Accounts with unresolved payment disputes may be suspended or permanently removed from future participation.
Governing Law
These Terms & Conditions shall be governed by the laws of the State of North Carolina.
Any disputes arising from this auction shall be subject to the applicable laws and courts of North Carolina.
