TERMS & CONDITIONS
Warranty and Condition of Items Sold: All items are sold 'AS IS, WHERE IS', with NO WARRANTY expressed or implied. It is the responsibility of the buyer to determine the condition of the items and bid accordingly. Descriptions are believed to be accurate but not guaranteed. When you are not certain of the condition or use of an item please bid accordingly. By registering to bid and/or placing a bid, you agree to be legally bound by all terms & conditions and any other announced terms and conditions of sale or rules of the site. All internet bidders agree that bids placed on the internet shall have the same legal effect as if they attended the auction in person. ASK QUESTIONS BEFORE YOU BID. THERE ARE NO REFUNDS AND NO RETURNS!!!
RELEASE OF LIABILITY:
Bidder and his or her agents / employees are responsible for any damage they may cause or liability that may attach from any of their actions on or around the auction site and premises during removal of merchandise. Bidder and his or her agents and employees agree to assume all risks of damage to person or property. Bidder and his or her agents and employees specifically release and indemnify NFN Auctions and / or seller / consignor from any liability and causes of action.
2) BIDDER AGREES:
That this agreement shall be governed by the laws of the state of Nebraska and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Adams County or Lancaster County, Nebraska. Both parties waive any right to a jury trial and hereby agree to a bench trial before a judge. This agreement shall be governed in all respects by the laws of the State of Nebraska. If for any reason, a court of competent jurisdiction finds any part of this agreement to be invalid or unenforceable, that part will be enforced to the maximum extent permissible to affect the original intent of this agreement. If a part is found to be invalid or unenforceable, the remainder of this agreement shall continue in full force and effect. Such invalid or unenforceable parts will be deemed severable from the other parts here and will not affect the validity or enforceability of the remaining parts. In the event of any litigation arising out of this Contract, the court shall award the prevailing party all reasonable costs and expenses, including reasonable attorney's fees. All sales final.
CATALOG DISCREPANCIES:
NFN Auctions will make every attempt to give the best and accurate description of the items on the auction. NFN Auctions will not be responsible for any errors or omissions in the description of the merchandise. Any statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tears, imperfections or the effects of aging. We make no guarantees to the item being complete, in working order or any guarantee of the above. You may come inspect the items for your own judgement by appt. Most electronics are tested to determine if the unit powers and operates but is not tested for a long period of time. If NFN Auctions find faults in any item it will be noted in the description. You are bidding on the item described not the photograph, occasionally the wrong photo may be displayed, always read the item description. For demonstration purposes various equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.
STAGGERED / SOFT CLOSE:
The auction will begin closing at the time stated in the auction details (typically 7 pm CST). One item ends every 12-15 seconds as stated in the auction details. Exact closing time is stated on each lot. The closing time of each lot will be automatically extended an additional 2 minutes whenever a bid is placed within the last 2 minutes of any lot (simulating a live auction). When auction is broadcasted LIVE the stagger will vary depending on the in-house bidding. Server & Software Technical Issues: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, NFN Auctions reserves the right to extend bidding, continue the bidding, restart the bidding entirely or close the bidding. NOTE - Lots are not considered sold until the ENTIRE auction has been closed and invoiced. NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR NFN AUCTIONS SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON.
VEHICLE TITLES:
All titled vehicles are sold AS-IS. It is the buyer's sole responsibility to determine if a titled vehicle is legal and able to be registered where buyer lives. If vehicle is paid in full, with cash or credit card, the title may be given to the Buyer at time of purchase. If a check is used for payment, the title will be held for 10 business days.
PAYMENTS:
All payments must be made within or before 72 hours of being invoiced after the close of the auction. Acceptable forms of payment include Cash, Personal Check (if over $1,000 it needs to be accompanied by Bank Letter of credit, Cashier’s Check accompanied by Bank Letter of credit, major credit cards on purchases less than $20,000, Bank Wire Transfer ($25 Service fee applies). If payment is not made within the stated period, the item will be considered in default and may be turned over to a collection agency. No Partial payments will be accepted.
State sales tax, transfer, license fees & document fees will be charged where applicable. No items will be released until full payment clears our controller’s office. Once full payment is received, items will be available for pick up or turned over to our shipping department if requested.
SHIPPING & PICK UP:
Shipping: Buyer pays all shipping and handling costs. NFN Auctions will handle all shipping and use the cheapest rate found with major carriers. All items will be insured through shipping company unless requested not to be insured by buyer. No items will be shipped without insurance unless requested by buyer in an email to NFN Auctions. NFN AUCTIONS WILL NOT ISSUE ANY REFUNDS OR ACCEPT ANY RETURNS ON BROKEN MERCHANDISE, YOU MUST FILE A CLAIM WITH CARRIER ON YOUR SIDE. WE WILL ASSIST IN HELPING PROVIDE ANY INFORMATION YOU MAY NEED TO FILE THE CLAIM. ALL ITEMS WILL BE IN GOOD CONDITION & WELL PACKAGED WHEN THEY LEAVE OUR FACILITY. PLEASE INSPECT THE SHIPMENT CAREFULLY UPON ARRIVAL. All shipping will be completed within 10 business days of full payment being received after the auction for the purchased items and the shipping and handling fees. Buyers will receive an email notice when their item(s) have been shipped and the tracking numbers for each package. All our shipping is done by either USPS, UPS, or FedEx unless otherwise directed by buyer. Every package that is shipped will be charged a minimum $5 handling fee to help pay for materials & time (boxes, packing peanuts, bubble wrap, etc.). YOU WILL RECEIVE TWO INVOICES IF YOU REQUEST SHIPPING: 1- Invoice for item(s) won on auction 2- Invoice for shipping and handling on item(s). All invoices will come from info@nfnauctions.com NOT HIBID. Check your spam folder for invoice if you haven’t received an invoice from us in the past.
If you want to pick up your items locally after the auction there will be dates and times for pick-up in the information for the auction. If unable to make the pick-up time and date you may schedule another date and time with NFN Auctions, but invoice must be paid within 72 hours of invoice being sent. Our warehouse addresses are 105 Road 3167, Hastings, NE 68901 and 4700 S 19th St, Lincoln, NE 68512. Local pickup location will be in the auction description. Bring your own items to package and wrap your won lots. We will transport items to and from both locations for pick up. If you request to pick up your items at our location that is not the site for the auction (Request by email) you will receive an email with details on the date and time your item(s) will be at the alternative location. Please then call 402-413-2017 or email us at info@nfnauctions.com with a date and time on when you want to pick up your item(s). If you are picking up your purchases from our location that is not home site of the auction, you will have to pay your invoice online within 72 hours of invoice receipt for your item(s) will be transported. This service is offered as a free service currently for our customers to make things more convenient.
FEES AND TAXES:
NE Sales tax will be charged to all purchases and will be determined by the location of the auction. If you have a SALES TAX RESALE CERTIFICATE you will be exempt, but we must have a copy of the certificate. All auctions will have a 15% Buyer’s Premium unless noted otherwise in auction description.
BIDDERS MUST READ:
All bidders hereby certify that they have read and fully understand the terms and conditions listed below and they agree to be bound thereby. Each auction may have additional terms that are not listed here. It is the buyer’s responsibility to understand all the terms and conditions prior to submitting any/all bids.
Internet bidders who desire to make certain their bid is acknowledged should use the pre-bidding feature and leave their maximum bid 24 hours before the ending of the auction.
Bidders agree to keep their username and password confidential as they are responsible for ALL activity involving their account. NFN Auctions acts as agents for the seller. All auctions are sold with reserve unless otherwise stated. Reserves, if there are any, will not be disclosed. All final bids are subject to seller’s confirmation. Only the top bidder will be contacted to the status of his/her bid.
By bidding on an item you have agreed to accept that item in its present condition and its present location and with the description provided whether accurate or not. Personal inspection of the property is strongly encouraged.
Additional Conditions: When using our online auction services, you are making firm commitments to purchase said items and are entering into a legal and binding contract. Bids may not be cancelled or retracted for any reason. Non-Paying bidders or fraudulent bidding will subject you to legal recourse and possible criminal charges including any fraud and/or interstate commerce violations. You also acknowledge that the Internet may be an unreliable and error-prone network. NFN Auctions will not guarantee that bids placed online will always be transmitted to or received by the auctioneer in a timely fashion. You agree to hold NFN Auctions and their employees harmless for any interruptions in online bidding. Further, the auctioneer has sole discretion to accept or refuse any bid. NFN Auctions retains the right to add, delete or change some or all our online services and the terms and conditions governing their online auctions at any time without notice. NFN Auctions reserves the right to remove a bidder for not complying with the terms and conditions. NFN Auctions reserves the right to cancel and/or remove a listing at any time for any reason.
