AUCTION TERMS AND CONDITIONS By registering for and participating in any AK Lots auction, all bidders acknowledge that they have read, understood, and agreed to the following Terms and Conditions. 1. REGISTRATION All bidders must register with valid and accurate contact information. AK Lots reserves the right to approve, deny, suspend, or revoke bidder registration at its sole discretion. AK Lots also reserves the right to permanently ban any bidder who violates auction policies, fails to complete transactions, abuses staff, or engages in fraudulent activity. 2. AS-IS / WHERE-IS All items are sold AS-IS, WHERE-IS with no warranties or guarantees, expressed or implied. AK Lots makes no guarantees or representations regarding the condition, completeness, functionality, merchantability, or fitness for a particular purpose of any item. Inventory may include: * Overstock merchandise * Shelf pulls * Retail returns * Liquidation inventory Due to the nature of liquidation inventory, item conditions may vary significantly and may include missing parts, cosmetic damage, prior use, incomplete packaging, or other imperfections. Packaging may be damaged or missing entirely. AK Lots tests many items for basic functionality when possible. Any testing performed is limited and does not guarantee full functionality, completeness, or long-term performance. Listing photos may include stock images for reference purposes and may not depict the exact item received. Bidders are solely responsible for reviewing all photos, descriptions, and available information prior to placing a bid. No refunds, returns, exchanges, or credits will be issued unless otherwise determined solely by AK Lots. 3. BIDDING AGREEMENT By placing a bid, you are entering into a legally binding agreement to purchase the item if you are the winning bidder. AK Lots reserves the right to: * Reject any bid * Withdraw, modify, or combine lots * Reopen bidding if a dispute arises * Cancel any sale at its sole discretion The auctioneer's decision shall be final in the event of any dispute. 4. SOFT CLOSE This auction utilizes a soft close format. If a bid is placed shortly before a lot closes, additional time may be added to allow continued bidding activity. 5. PAYMENT Payment is due immediately upon conclusion of the auction unless otherwise approved by AK Lots. Accepted payment methods may include: * Credit Card * Debit Card * Cash * Cash App * Zelle Cards on file may be automatically charged after the auction closes unless the bidder has been approved as a cash buyer prior to auction end. Failure to complete payment may result in: * Cancellation of the sale * Suspension or permanent banning of bidding privileges * Reporting to HiBid or other auction platforms * Collection efforts or legal action if necessary 6. BUYER'S PREMIUM AND CREDIT CARD FEE A 15% buyer's premium will be added to the final bid price on all purchases. Example: Final Bid + 15% Buyer's Premium = Subtotal A 3% credit card processing fee will be applied to all credit card transactions. If a bidder wishes to pay with cash, they must contact AK Lots before the auction closes so they may be marked as a cash buyer. This prevents the card on file from being automatically charged after the auction. The 15% buyer's premium still applies to all cash payments. 7. SALES TAX Applicable Texas sales tax will be charged on all purchases unless a valid resale certificate is submitted and approved prior to bidding. 8. PICKUP LOCATION AK Lots 520 County Road 108, Suite 40 Hutto, TX 78634 9. PICKUP SCHEDULE Pickup begins on Monday following the auction close. Pickup hours: Monday - Friday 10:00 AM - 6:00 PM Saturday 10:00 AM - 2:00 PM Sunday Closed Winning bidders are responsible for picking up their items within the designated pickup period. Buyers are responsible for bringing any necessary tools, equipment, labor, or assistance required for item removal and loading. 10. ABANDONED ITEMS Any items not removed within 7 calendar days following auction settlement shall be deemed abandoned property. AK Lots reserves the right to: * Resell the items * Dispose of the items * Relist the items without notice No refunds, credits, or compensation will be issued for abandoned items. 11. SHIPPING Shipping is available for eligible items to both domestic and international customers. If shipping is requested, AK Lots will contact the customer with a separate shipping and handling invoice. Handling fees are calculated as 10% of the combined total of: * Auction settlement * Shipping label cost This fee helps cover: * Packaging materials * Labor and handling * Shipping label costs * Settlement processing Shipping costs may be significantly higher for oversized, irregular, fragile, or heavy items. Once the shipping invoice has been paid, AK Lots will package and ship the order. Tracking information will be provided once the shipment has been processed. AK Lots is not responsible for delays, damage, loss, or mishandling caused by shipping carriers. Once an item has been released to a shipping carrier or removed from our facility, all responsibility transfers to the buyer and/or carrier. 12. FAILURE TO PAY Winning bidders who fail to complete payment may have their bidding privileges suspended or permanently revoked. AK Lots reserves the right to relist unpaid items and recover any losses, fees, or damages associated with unpaid transactions. 13. CHARGEBACK POLICY Any bidder initiating a payment dispute, chargeback, or reversal without first contacting AK Lots to attempt resolution may be permanently suspended from all future auctions. AK Lots reserves the right to pursue collections, legal remedies, and recovery of all associated fees and damages related to fraudulent or unjustified chargebacks. 14. BIDDING ERRORS Bidders are responsible for monitoring and reviewing their own bidding activity. If a bidder accidentally places a bid, they remain responsible for honoring the purchase if they are the winning bidder. 15. LIMITATION OF LIABILITY AK Lots shall not be held liable for any damages, losses, injuries, or claims resulting from: * The purchase of any auction item * The use or misuse of purchased items * The pickup, loading, transport, or shipping of items * Inaccuracies, omissions, or errors in item descriptions or photographs 16. AGREEMENT By registering for, bidding in, or participating in any AK Lots auction, bidders acknowledge and agree to all Terms and Conditions stated herein.
