Ultimate Auctions Terms & Conditions 1. Registration & Eligibility All bidders must register and be approved prior to bidding. Bidders must be 18 years of age or older. You are responsible for maintaining the confidentiality of your bidding account. The auction company reserves the right to refuse or revoke bidding privileges at any time. 2. Bidding Agreement All bids are a legally binding contract. Placing a bid indicates you have read, understood, and agree to all auction terms. Winning bidders are obligated to complete the purchase. All sales are subject to sellers approval. The seller's right to bid is expressly reserved. The auctioneer may bid on behalf of the seller up to the reserve price, after which the highest successful bidder shall be the purchaser. Failure to pay for items won may result in legal action. 3. Buyer’s Premium A buyer’s premium of 3.5% will be added to the final hammer price unless otherwise stated. Buyer’s premium is taxable where applicable. CREDIT CARD TRANSACTIONS WILL COST AN ADDITIONAL 2.5% 4. Payment Terms Full payment or arrangements are due within 48 hours of auction close. Payment to be sent to consignor within 7 days after Ultimate Auctions has received payment for consignment items. Accepted payment methods may include: Credit/Debit Card E-Transfer Cash Wire transfer (for high-value items) The auction company reserves the right to charge the card on file if a bill remains unpaid after 48 hours. 5. Non-Payment / Default Failure to pay will result in: Cancellation of sale Forfeiture of bidding privileges The option to permanantly ban your account Unpaid items may be resold without notice. 6. Item Condition & Inspection All items are sold “AS IS, WHERE IS” with no warranties, expressed or implied. Descriptions and photos are provided as a guide only. Bidders are responsible for inspecting items prior to bidding. No refunds or exchanges. Ultimate Auctions is not responsible for any loss or damage to any items on the yard. 7. Pick-Up & Removal Items must be picked up (or arrangements made) during operating hours, within 7 days after the sale date. Items not picked up may be: Subject to storage fees Resold or disposed of at the auctioneer’s discretion 8. Shipping Buyer is responsible for all shipping and handling costs. 9. Sales Tax Applicable taxes will be charged unless valid tax exemption documentation is provided before bidding. 10. Bid Retraction & Errors Bid retractions are not permitted. Ultimate Auctions reserves the right to: Correct bidding errors Cancel bids Reopen or cancel lots due to system or clerical errors 11. Auctioneer Discretion The auctioneer reserves the right to: Add or remove items Cancel or reschedule auctions Resolve bidding disputes 12. Liability Ultimate Auctions is not liable for: Personal injury Theft Loss during preview or pickup 13.
