By registering and placing a bid in this auction, you agree to the following:
1. Online Auction Format
- This auction is an ONLINE Auction. All bids that are placed via the internet are treated as absentee bids and are integrated into the online auction platform known as HiBid. Bids are executed on behalf of the bidder in competition with other live or absentee bidders. Walley & Sons Auctions reserves the right to place bids on behalf of the seller in order to meet reserve prices.
2. Bidding Process
- All bids must be submitted by registered bidders. Registration requires proof of identification and contact information.
- As of October, we will be requiring manual approval of anybody BELOW 30 Reputation Score. This does not mean you will be denied - we understand some people don't religiously use this site. We've had plenty of great first time participants!
- The Auctioneer reserves the right to reject any bid or bidder at their discretion for any or no reason in order to protect the integrity of the auction.
3. Item Description & Condition
- All items are sold "AS IS, WHERE IS". We do our absolute best to disclose any issues with the items listed.
- The Auctioneer's description at the time of sale is final.
- Items listed as gold, silver, or other precious materials are described as "marked as" such. We do not test every item.
- Bidders are responsible for conducting their own due diligence and inspecting items prior to bidding. Images and descriptions are adequately provided. All images and descriptions are for reference only and sometimes don't capture all defects. IT IS THE BIDDER'S RESPONSIBILITY TO REACH OUT AND ASK FOR FURTHER DETAIL OR MORE PICTURES! We do not hide defects or set items up in a way that would otherwise deceive our bidders. IF YOU EXPERIENCE THIS, CONTACT US AND BE RESPECTFUL. We will absolutely try to work with you. Sometimes things slip by and we get in a rush. Nobody is perfect. Part of our name mattering includes making sure people aren't walking all over us. Please keep this in mind.
4. Buyer's Premium
- We charge 15% buyer's premium. 12% for Cash Buyers.
5. Payment Terms
- All purchases must be paid in full prior to picking up.
- All purchases requiring shipping must have shipping & handling paid for prior to said item being shipped.
- Walley & Sons Auctions reserves the right to require a wire transfer for any or all transactions at their discretion.
6. Shipping & Pickup
- Walley & Sons Auctions offers inhouse shipping to keep rates low!
- All items must be picked up during the stated pickup days / times. Shipping arrangements must be made during pickup days. Failure to do so may result in additional storage fees or forfeiture of said item WITHOUT REFUND.
- Walley & Sons Auctions will clearly indicate whether an item is eligible for shipping through HiBids system (Truck icon in the upper right of a lot will be crossed out if Shipping is not allowed).
- High-value items will only be shipped to the billing address associated with the payment method. The billing and shipping addresses MUST match.
- Walley & Sons Auctions is not responsible for any loss or damage to items during shipping.
7. Additional Information Requests
- Bidders are encouraged to request information or clarification about items prior to bidding. Requests should be made as early as possible to ensure timely responses.
- Walley & Sons Auctions will make REASONABLE efforts to provide additional information or details but is not obligated. Most of the time, we're working behind schedule. We try our hardest to get to these requests but don't always land on the mark.
8. Non-Payment and Default
- If a buyer fails to pay for or collect their items within the specified amount of time provided, Walley & Sons Auctions reserves the right to cancel the sale, retain any deposits, and/or resell the items without further notice.
- Buyers who default on payment may be banned from future auctions and may be liable for any losses incurred.
9. Disputes & Governing Law
- Any and all disputes arising from this auction will be resolved under the laws of the State of Illinois in the jurisdiction of Macoupin County.
- Walley & Sons Auctions is not responsible for technical issues, including but not limited to internet connectivity issues, that may affect bidding.
10. Limitation of Liability
- Walley & Sons Auctions shall not be liable for any errors or omissions in the auction process, including but not limited to incorrect descriptions, technical failures, or bidding disputes.
- Walley & Sons Auctions liability, if any, is limited to the refund of the purchase price paid for the item in question.
11. Auctioneer's Discretion
- The auctioneer reserves the right to withdraw any lot, postpone the auction, or change these terms and conditions at any time without prior notice.
- In the event of a tie bid, the Auctioneer has the sole discretion to determine the winning bidder or reopen the bidding
12. Acceptance of Terms
By simply participating in this auction, bidders acknowledge that they have read, understood, and agree to be bound by these Terms & Conditions
