THORSTENSON AUCTION COMPANY LLC TERMS & CONDITIONS By registering and placing a bid through HiBid, you agree to all terms and conditions set forth below. These terms form a legally binding agreement between the bidder and Thorstenson Auction Company LLC. 1. GENERAL TERMS All items are sold AS-IS, WHERE-IS with no guarantees or warranties, expressed or implied. All sales are final. 2. REGISTRATION & BIDDER RESPONSIBILITY All bidders must provide accurate contact and payment information. Bidders are responsible for all bids placed under their account. The auction company reserves the right to refuse or revoke bidding privileges at any time. Bidders are responsible for ensuring they are able to pay for all items they bid on, including shipping and applicable fees. Bidder Eligibility By registering, bidders certify they are at least 18 years of age and legally capable of entering into binding contracts. Bid Retractions / Bidding Errors Bidders are responsible for reviewing bids before submission. Once placed, bids cannot be retracted except at the sole discretion of the auction company. Technical issues, bidder inattention, accidental bids, or misunderstanding of the bidder platform do not invalidate bids. Right to Refuse Service Thorstenson Auction Company LLC reserves the right to deny bidding privileges, suspend accounts, cancel registrations, remove bids, or refuse service at its sole discretion for any reason including non-payment history, suspicious activity, abusive conduct, or policy violations. 3. CARD ON FILE REQUIREMENT All bidders must register with a valid credit or debit card through HiBid. The card on file may be automatically charged immediately following auction close unless alternative payment arrangements have been approved in advance by the auction company. If a card on file is declined, the bidder is responsible for providing an alternative payment immediately upon request. By registering and bidding, you authorize Thorstenson Auction Company LLC to charge your card for any unpaid invoices. This authorization includes any additional charges incurred after the auction, including but not limited to shipping, handling, insurance, storage fees, and applicable fees. You agree your card may be charged without additional notice after the payment deadline. Failure to maintain a valid card may result in account suspension or removal. Declined or disputed payments may result in additional processing fees, collection actions, account suspension, and bidder removal from future auctions. A temporary $1.00 charge may be placed on your card at registration to verify validity. This is not a charge from the Auction Company and may be released by your bank according to their policies. 4. BUYER’S PREMIUM A 12.5% buyer’s premium will be added to all winning bids. For example: if your bid is $100.00, your invoice will be $112.50 before any applicable taxes, shipping, or handling charges are added. 5. PAYMENT TERMS Local Pickup Buyers Accepted forms of payment: Card on file (default payment method) Cash at pickup ONLY with prior approval from the auction company NO CHECKS ACCEPTED. Unless prior cash payment arrangements are approved before auction close, the card on file will be automatically charged immediately following the auction for the full invoice amount, including buyer’s premium and applicable sales tax. Buyers wishing to pay cash at pickup must contact Thorstenson Auction Company LLC before the auction closes and receive approval. Requests made after auction close may be denied. If approved for cash payment and items are not picked up during the scheduled pickup times, the bidder authorizes Thorstenson Auction Company LLC to charge the card on file for the full invoice amount, including applicable buyer’s premium, taxes, storage fees, and other applicable charges. Shipping Buyers All shipped invoices will have the card on file automatically charged immediately following auction close for the invoice total, including buyer’s premium and applicable taxes. Shipping, handling, insurance, packaging materials, and related shipping charges will be calculated separately after the auction. Once shipping costs have been calculated, a separate shipping invoice will be sent to the buyer. Payment for shipping charges is due immediately upon receipt of the shipping invoice. Items will not be shipped until all shipping and handling charges have been paid in full. By requesting shipping, the bidder authorizes Thorstenson Auction Company LLC to charge the card on file for shipping, handling, insurance, packaging materials, and related shipping costs unless other payment arrangements are approved. Failure to pay shipping charges may result in forfeiture of items without refund, account suspension, denial of future bidding privileges, and/or collection actions. General Invoices may be sent electronically. South Dakota Sales Tax (6.2%) will be applied to all items picked up in South Dakota and all in-state shipments unless valid tax exemption documentation is provided. Items shipped outside of South Dakota will not be charged sales tax unless required by law. Failure to pay within the stated timeframe will result in enforcement actions outlined in these terms. 6. SALES TAX Applicable sales tax will be collected per South Dakota law unless valid exemption documentation is provided. Select coins, currency, and precious metals are exempt in South Dakota. 7. PICKUP POLICY Pickup: Wednesday 7AM–10AM MST & Thursday 4PM–7PM MST Pickup will take place in Spearfish, South Dakota. The exact pickup address will be provided on the winning bidder’s invoice after auction close. All pickup invoices must be paid in full prior to item release. Buyers must bring their own help, tools, and transportation. Auction company is not responsible for loading. Pickup Liability and Safety All persons entering the pickup location do so at their own risk. Buyers are responsible for loading, securing, and transporting their purchases. Thorstenson Auction Company LLC, the property owner, property tenants, business operators, employees, agents, and affiliates shall not be liable for any injuries, accidents, damages, losses, or claims arising from: Loading or unloading items Use of tools or equipment Slips, trips, falls, or any other accident Vehicle damage Broken items Any activities occurring on the pickup premises Buyers assume all responsibility for the removal and transportation of purchased items. Children must be supervised at all times. Storage Fees Items not removed during scheduled pickup times may incur storage or handling fees at the discretion of the auction company. By participating in the auction and attending pickup, buyers agree to release and hold harmless Thorstenson Auction Company LLC, the property owner, and all affiliated parties from liabilities to the fullest extent permitted by law. 8. LATE PICKUP POLICY Late pickups are not guaranteed. Approved late pickups may incur additional fees at the discretion of the auction company. 9. ABANDONED ITEMS POLICY Items not picked up by the end of the scheduled pickup time (or approved time) are considered abandoned. No refunds or chargebacks will be issued for abandoned items. Auction company may resell, dispose of, or retain items. 10. SHIPPING TERMS Shipping is available on select items. US only. No international shipping. Buyer is responsible for all shipping, handling, packaging, insurance, and material costs. The card on file will be automatically charged immediately following auction close for the auction invoice total only, including buyer’s premium and applicable taxes. Shipping and handling charges will be calculated separately after the auction based on package weight, dimensions, destination, insurance requirements, packaging materials, and handling needs. A separate shipping invoice will be sent once shipping charges are calculated. Items will not ship until shipping charges have been paid in full. A $5.00 handling fee will be applied to each shipped order. Shipping insurance may be included at the auction company’s discretion or upon buyer request, and any associated costs will be added to the shipping invoice. Thorstenson Auction Company LLC reserves the right to adjust handling fees for oversized, fragile, high-volume, or specialty shipments. Shipping may take several days after payment due to auction volume, packing requirements, weather conditions, or carrier scheduling. Once packages are transferred to the shipping carrier, risk of loss or damage transfers to the buyer. Once delivered to the carrier, risk transfers to the buyer. Thorstenson Auction Company LLC is not responsible for delays, loss, or damage during transit. 11. NON-PAYING BIDDERS Declined cards, failed payments, unpaid shipping invoices, chargebacks, or failure to complete payment obligations may result in: Card on file being charged Suspension or removal of bidding privileges Permanent ban from future auctions Collection actions Forfeiture of unpaid items Reporting to HiBid and other auction platforms 12. ITEM CONDITIONS & DESCRIPTIONS Descriptions are believed accurate but not guaranteed. Items may be tested to the best of the auction company’s abilities; however, functionality is not guaranteed unless specifically stated. Photos are part of the description. Buyers are responsible for reviewing all information prior to bidding. Coin Grading Disclaimer - All coin grades, descriptions, and identifications provided by Thorstenson Auction Company LLC are opinions only and are not guaranteed. The only grading recognized as definitive is that performed by independent third-party grading services such as Professional Coin Grading Service (PCGS) or Numismatic Guaranty Company (NGC). Unless specifically stated otherwise, raw coins and currency are not authenticated or certified by third-party grading services. Opinions regarding authenticity, grade, attribution, and condition are subjective. Bidders are responsible for evaluating all items prior to bidding and should not rely solely on auction descriptions or stated grades. No refunds, chargebacks, or adjustments will be made based on differences of opinion in grading. All measurements, weights, and descriptions are approximate. 13. DISPUTES & LIABILITY All sales are final. No returns or refunds will be issued except at the sole discretion of the auction company. By bidding, you agree not to initiate chargebacks on valid purchases and understand disputed charges will be contested using auction records, invoices, registration data, pickup records, payment records, shipping documentation, and related records. Separate shipping invoices and shipping-related charges are considered part of the final auction transaction and are subject to these terms and conditions. Any disputes must be brought to the attention of the auction company prior to item removal or shipment. Buyers assume all responsibility for loading, removal, and transport. Thorstenson Auction Company LLC, the property owner, and any affiliates are not liable for injuries during pickup or damage after items leave premises. See Pickup Terms above. 14. ADA / SPECIAL ACCOMMODATIONS Reasonable accommodations may be made upon request.Buyers must contact the auction company in advance of auction close. 15. AUCTION ENDING & SOFT CLOSE Auctions may use a soft close system.Bids placed near closing extend time.Auction company may extend, pause, or cancel auctions. Thorstenson Auction Company LLC reserves the right to add or remove items, split or combine lots, correct errors, modify descriptions, change terms, extend bidding, or cancel auction without prior notice. 16. TECHNICAL ISSUES Internet bidding: Bidders acknowledge that internet bidding may be subject to interruptions, delays, errors, or failures beyond the auction company’s control. Thorstenson Auction Company LLC is not responsible for missed bids, delayed bids, platform malfunctions, software issues, or internet connectivity problems. 17. AGREEMENT TO TERMS By placing a bid, you acknowledge that you have read and understood these terms and agree to be legally bound by them.
