Internet Bidding Disclaimer The Auctioneer and Seller accept no responsibility for disruptions to internet connectivity or technical failures. Missed bids due to disconnections, audio delays, or internet latency are not the responsibility of the Auctioneer. Audio streams may be delayed; bidders are strongly advised to place bids using the on-screen prompts and not to wait for verbal confirmation. Legal action against John Sisk Auctioneers, if any, must be filed and resolved exclusively in Beeville, Bee County, Texas. Please note that the system may display an internet bidder as the high bidder when, in fact, the item has already been sold on the auction floor. Invoices for successful internet bidders will be sent on the Saturday following the auction.??If you place a maximum bid (e.g., $300), the system will bid incrementally on your behalf up to that limit. However, this does not guarantee that your maximum bid will win the item, even if the final price matches your limit. For example, if your bid is at $225 and a floor bidder places a bid at $250, your automatic bid will rise to $275. If the floor bidder then bids $300, you will be outbid. If you are actively monitoring the auction and see your maximum bid has been exceeded, you may choose to place a higher bid manually. 2. Authority of the Auctioneer The Auctioneer retains complete authority over the conduct of the auction and has the sole discretion to resolve any disputes between bidders. Bid increments are determined by the Auctioneer and may vary to ensure the orderly flow of the auction. 3. Condition of Items All items are sold “As Is – Where Is,” with no guarantees expressed or implied. Descriptions, lists, and other information are provided for convenience only and may contain inaccuracies. It is the responsibility of the buyer to inspect each item during the designated inspection period and to verify the year, make, model, and condition of any item or vehicle before placing a bid. No refunds will be issued based on incorrect descriptions, regardless of whether the error was written or spoken. The seller has attempted to disclose known defects; however, unknown issues may still exist. Odometer and hour meter readings are shown as displayed on the equipment and may not reflect actual usage. All provided information is believed to be accurate but is not guaranteed. 4. Payment Terms Internet bidders must remit payment by U.S.-based credit card (Visa, MasterCard, American Express, Discover; subject to a 3% fee) no later than 2 hours after the close of the auction on Saturday, May 30th. If you attend in person on the day of the auction, payment may be made by cash, local check (only if the name and address on the check match the name and address on the driver's license), or U.S. credit card. All checks from non-local buyers must be accompanied by a bank letter of credit specifically made out to John Sisk Auctioneers, Inc. 5. Non-Compliance Failure to comply with any of these terms and conditions will result in forfeiture of purchases, permanent banning from future sales, and potential legal action. The Auctioneer may, at its discretion, resell any forfeited items publicly or privately. The original buyer shall be liable for any associated losses, costs, attorney fees, and court expenses, in accordance with Section 2 of the Texas Business and Commerce Code. Any individual who issues a non-sufficient funds (NSF) check will be prosecuted to the fullest extent permitted by law. 6. Buyer’s Premium and Taxes A buyer’s premium is applicable to all sales: 10% Buyers Premium. For example, a $1,000 item would incur a $100 premium,(12% Online) depending on the purchase method. Sales tax applies to the total amount, including the buyer’s premium. To qualify for tax exemption, buyers must submit a valid 11-digit resale certificate or farm exemption number before the auction. If the item qualifies for the Texas Emissions Reduction Plan (TERP) tax, it must be paid unless an exemption is provided. Vehicle sales tax will not be collected at the auction; it must be paid when the title is registered at the purchaser’s county office. 7. Title Assignment Vehicle titles will be issued using the registration name provided at the time of bidder sign-up. If you wish for the title to reflect a company name, the registration must be completed under that company name. 8. Pickup and Removal of Purchases Local buyers may pick up their items Monday following the sale, from 10:00 AM to 4:00 PM. Internet buyers should coordinate with the Auction Company regarding pickup logistics. No items will be released without a paid invoice. If you are sending a third-party driver, they must present a copy of your paid invoice. Items will not be released without this documentation. If the wrong item is taken, the buyer is responsible for returning it to its rightful owner. Neither the Auctioneer nor the Seller is responsible for items left overnight. 9. Licensing and Regulation This auctioneer is licensed and regulated by the State of Texas under License No. 18090. The Auctioneer operates under a State-issued Recovery Fund designed to protect both buyers and sellers from fraudulent or inappropriate actions.
