Terms & Conditions: Any person/s placing a bid within this auction are entering into a legally binding contract in which the following considerations and any auction-specific public notations apply: 1.All property is sold "AS IS', and ALL SALES ARE FINAL. It is the Bidder's responsibility to determine condition, age, value or any other determinative factor prior to placing a bid. Cox Estate Appraisals may attempt to describe the merchandise in advertising, on the Internet and within the auction but makes no representations. In no event shall Cox Estate Appraisals be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Please feel free to contact Cox Estate Appraisals with any specific questions on items prior to bidding. 2. Online bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Cox Estate Appraisals shall endeavor to describe in detail each item and any pertinent information about it. Cox Estate Appraisals will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. 3. Cox Estate Appraisals reserves the right to withdraw, add, or re-catalog items in this auction. Cox Estate Appraisals also reserves the right to reject a bid from any bidder. 4. Items/lots are to be paid in full prior to removal from auction site. All items are to be removed on the pickup date noted unless arrangement is made with the Auctioneer prior to bidding. Please bring physical or digital copy of your invoice at pickup. Bidder agrees not to stop payment on checks or disallow a sight draft and is responsible for any expenses due to collection of a bad check. In the event of a bad check the Auctioneer reserves the right to repossess, at any time, at your location, the merchandise involved. As always a bid is a contract and will be treated as such. 5.All auction sales will be settled using the bidders credit card on file with HiBid. You must notify Cox Estate Appraisals in advance if you wish to pay using any other method. 6. Cox Estate Appraisals and the property owner of the auction being held and any pickup location for lot/s therein are not responsible for accidents, personal or property-related. 7. All Bidders agree to pay stated Buyer's Premium of 15% (unless specifically noted otherwise in individual Auction notes). 8. Items may be sold with a "Reserve" (or minimum dollar amount allowing the item to sell). This Reserve and the amount may or may not be disclosed, but please contact Auctioneer with any questions including those post the auction conclusion as Reserve amounts may often be negotiable given further discussion with consignor. 9. Items not picked up at the stated local pickup time/date or at another pre-arranged time frame may be shipped at buyer's expense or considered forfeited. Forfeited items may still incur charges to the Credit Card on file, so please ensure that you pre-arrange an alternate pickup if available if the scheduled local pickup is not able to be attended. Also, lots are sold in their entirety and buyers may be assessed a fee for leaving any/all of a lot at the local pickup (the only exception to this consideration is if a lot if noted as "Picker's Rights", in which the winning bidder may select to leave items they deem undesireable at that time). Items not picked up and not paid for (bad card on file, etc.) are subject to forfeiture and suspension of bidding account. 10. SHIPPING: If bidders continually bid on items that are not "SHIPPING AVAILABLE" considerations that would require shipment, they may be barred from future bidding. ALSO: If *winning* bidder requires shipping on a lot that was not noted as available for shipping (and not discussed with the Auctioneer in advance of winning), there will be an inconvenience charge and if packagedshipped by a 3rd party this is in addition to their cost. Per Auctioneer determination, this may instead result in a forfeiture of lot/s, and barring from future bidding.
