AUCTION TERMS & CONDITIONS
By registering, bidding, or participating in this auction (online or in-person), you agree to the following Terms & Conditions:
1. Property Condition & Due Diligence
All property is sold “AS IS, WHERE IS,” with all faults and without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
All descriptions, hours, mileage, photographs, images, maps, dimensions, acreage figures, taxes, school districts, utility information, or other details are believed to be accurate but are not guaranteed. Lines drawn on maps are approximate.
All announcements made by the Auctioneer on auction day, whether in-person or online, shall supersede any prior advertising, printed material, online listings, or oral statements.
Bidders are strongly encouraged to conduct their own inspections and due diligence prior to bidding. By placing a bid, you acknowledge that you have inspected the property to your satisfaction or have chosen not to do so.
2. Registration & Bidding
• All bidders must register with accurate and complete information.
• All bids are binding and irrevocable.
• The Auction Company reserves the right to reject bids suspected to be fraudulent or not made in good faith.
• In the event of technical issues or last-minute bidding activity, the auction closing may be extended to ensure a fair opportunity for all bidders.
3. Reserve & Seller Confirmation
Certain items and/or real properties may be offered subject to reserve, unless specifically advertised as Absolute.
A reserve is the confidential minimum price the Seller is willing to accept. If the highest bid does not meet or exceed the reserve, the Seller reserves the right to accept or reject the final bid.
Final bids are subject to Seller confirmation unless expressly stated otherwise. No sale shall be deemed final until accepted by the Seller and/or Auction closes, whichever occurs first.
4. Buyer’s Premium
A 10% Buyer’s Premium will be added to the final bid price to determine the total contract price.
5. Real Estate Payment Terms (If Applicable)
• A non-refundable deposit of 15% of the purchase price is due the day of auction (or by wire within the stated deadline for online bidders).
•A 3% buyer’s premium will be added to the final bid price and is paid by the buyer.
• The balance is due at closing, within 30 days unless specified otherwise.
• The sale is not contingent upon financing, appraisal, or inspection unless specifically stated otherwise in writing.
• Closing shall occur with the designated title company.

Buyers’ agents may be eligible for a 3% cooperating compensation provided the agent shows the property and registers the buyer with the auction company at least 48 hours prior to the auction. Agents are encouraged to contact us with any questions. We welcome the opportunity to work with you.
6. Personal Property Payment Terms (If Applicable)
• Payment in full is due at the conclusion of the auction
• Accepted payment methods: Cash, Wire Transfer (must be arranged ahead of auction), Approved Credit Card (limits may apply).
•Credit card payments will incur a 4% convenience fee.
• Credit cards on file may be automatically charged at auction close unless prior arrangements are made.
7. Pickup & Removal (Personal Property)
• All items must be picked up by 4:00 PM on the day of the auction, unless prior arrangements are made and an appointment is scheduled.
• All purchased items must be claimed and removed within 7 calendar days following the auction date.
• The Auction Company does not provide shipping services.
• Buyers are responsible for bringing their own labor, tools, and equipment necessary for removal.
• Any items not removed within 7 days may be considered abandoned and may be resold or disposed of without refund.
Once an item is sold, it becomes the sole responsibility of the purchaser. Seller and auction company shall not be responsible for any loss, theft, or damage occurring after the item is sold.
8. Default
If the winning bidder fails to comply with these Terms & Conditions, the Seller and/or Auction Company may:
• Retain the deposit as liquidated damages
• Resell the property
• Pursue any legal remedies available to the fullest extent permitted by law
9. Limitation of Liability
To the fullest extent permitted by law, the Auction Company’s liability shall not exceed the amount paid by the bidder. In no event shall the Auction Company be liable for indirect, incidental, consequential, or punitive damages.
The Auction Company is acting solely as agent for the Seller.
10. Entire Agreement
These Terms & Conditions constitute the entire agreement between the parties. By bidding, registering or participating you acknowledge that you have read, understood, and agreed to these terms.
