Bidder agrees to comply with these Terms & Conditions defined below as a prerequisite for Auctioneer's acceptance of the Bidder's Registration and Bid Card ID. Bidders with NEGATIVE scores and UNPAID auctions will be REMOVED. ZERO Feedback or NEW HiBid registrations will have bids limited until IDENTITY is VERIFIED. Properties will only be sold to clients with valid United State citizenship. The total amount due will be the final 'hammer' price plus the buyer premium (10%). There is a $695 documentation/closing fee per Real Estate auction lot. If you are unfamiliar with real estate transactions, real estate terms or any aspect of sale, It is recommended that you SEEK LEGAL ADVICE before registering or BIDDING. Prior to bidding, each bidder is advised and responsible to conduct an independent due diligence to ascertain characteristics, attributes and condition of the property. Failure to conduct diligence activities shall not constitute a waiver of any sort. PAYMENT: All payments in GUARANTEED funds only. Wire Transfer, Certified Bank Check or Cash. Real property transfer, we CANNOT accept Credit Cards, Venmo or PayPal for Real Property. An earnest deposit is required for each lot at closing. Bidding will have one (1) business day to make deposit by Wire Transfer or Certified Bank Check or cash. Required deposit is $5000 per lot. Email statement with payment instructions will be sent to winning bidder at the close of the auction. FULL Payment is DUE within FIVE(5) business days of Auction Closing. No Exceptions. If you cannot meet this requirement please do not bid. All Title Closings and Recordings are executed by our staff in house. Deeds in less than 30 days in most cases. Earnest deposit is NOT refundable. If bidder fails to submit remaining balance due within 5 business days the earnest deposit is forfeit with no refunds or credits. The Earnest deposit will be accompanied by a non-contingent Purchase Agreement. Any bids or earnest money deposits are considered acceptance of aforementioned Purchase Agreement. 100% full Interest and ownership of the properties as described in each auction will be transferred to the winning bidder upon receipt of payment. This is FEE SIMPLE, ABSOLUTE INTEREST transfer. Free and clear title of described property shall be given by a standard quit claim deed free and clear of any encumbrances and liens. Special Warranty deed is available for $1795 on any property. TERMS and FEES: High bidder will receive deed(s) to the property as described in auction upon full payment, subject to clearing of funds. A 10% buyer premium will be applied to the hammer price. A $695 Documentation fee is added to each lot sold. CLEAR and UNENCUMBERED TITLE of ownership will be transferred by Quit Claim Deed. Special Warranty Deed is available for an additional $1795.00. By registering and bidding on this auction, the bidder agrees to receive text messages and email, that are directly related to Terra Firma Auctions. We do not sell any information. Your information will be kept confidential. CONDITION AND DILIGENCE: All properties are sold in "AS-IS" condition with all faults and defects and without warranty or guarantee of any sort. TRANSFER OF OWNERSHIP. Conveyance of properties is completed by the Terra Firma Closing staff via registered and recorded Quit Claim Deed. By registering for auction, Bidder authorizes Auctioneer to act as Bidder’s agent to complete any closing documents, or any corrective documents thereafter. For each Lot, Bidder must specify the Deed Transfer Information. Should the Bidder fail to specify Deed Information within 10 business days after payment of balance, Bidder authorizes Auctioneer to convey each Lot using the Bidder’s name and address as registered in the auction.
