Auction Terms & Conditions for Meadow and Main Auction
1. Acceptance of Terms: By placing a bid, the bidder certifies that they have read, understood, and agree to abide by all terms and conditions as stated herein.
2. Online Soft Close Bidding: This is a timed, online-only auction. Bidding within the last minute before the closing of an item will extend the bidding time to prevent last-second bids.
3. Item Condition: All items are sold "AS IS, WHERE IS," with no warranties, expressed or implied. It is the bidder's responsibility to determine the condition, age, value, and any other determinative factor before bidding.
4. Invoicing and Payment: Successful bidders will receive an invoice via email. Payments are due on or before the time of pickup and only the credit card on file will be charged unless other arrangements are made in advance. A buyer's premium of 15% will be applied to all purchases unless otherwise noted. Credit card information is not retained by Meadow and Main Auction
5. Item Pickup: Items must be picked up at the designated time and location. Items not picked up will be considered forfeited, and charges will still be applied to the credit card on file. NO EXCEPTIONS.
6. Liability: Meadow and Main Auction, its agents, and the property owner are not responsible for accidents or injuries during pickup or inspection.
7. Disputes: Any disputes will be resolved by Meadow and Main Auction at its sole discretion. The company may assist in resolving issues between users but is not obligated to take part in such disputes.
8. Software and Technical Issues: Meadow and Main Auction will not be held liable for any end-user software or technical malfunctions that may affect the outcome of the auction.
9. Prohibited Uses: Users are prohibited from using bots, scripts, or other automated methods to access or manipulate the auction system.
10. Amendments to Terms: Meadow and Main Auction reserves the right to amend these terms at any time without prior notice. Changes will be effective immediately upon posting.
11. Reserve Prices: Items may be sold subject to a reserve price. Meadow and Main Auction reserves the right to disclose or not disclose the reserve price to bidders.
12. Cancellation and Withdrawal: Meadow and Main Auction may cancel an auction or withdraw items from sale at any time due to legal, technical, or operational considerations.
13. Data Privacy and Security: The privacy and security of bidder information are paramount. Data collected during the auction process will be used solely in accordance with our privacy policy and applicable laws, ensuring that no credit card information is retained post-transaction.
14. Governing Law and Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of the State of Iowa. Any disputes arising hereunder shall be adjudicated in the courts located in Iowa.
15. Indemnification: Bidders agree to indemnify and hold harmless Meadow and Main Auction, its agents, and affiliates from any claims, damages, or expenses arising from their use of the auction site. Shipping is possible, contact auctioneer for conformation.
