Auction Terms & Condition All Bidders acknowledge to have read, comprehend, and agree to the following terms & conditions set forth by Jeff Boone Auction & Realty. ("Boone Auctions"). All bidders agree to be legally bound to these terms & conditions. All announcements made by the Auctioneer shall supersede any printed material. Boone Auctions reserves the right to deny and or terminate bidding privileges at any time. Buyers: Once invoiced, you have 24 hours to contact Boone Auctions to notify of payment arrangements. Please note that any purchase is subject to automatically be charged to your credit card on file. Boone Auctions has the right to charge your card on file if no communication has been made on payment preference. Payment Terms: Cash & Check accepted with no extra fee - Wire Transfer accepted with a $20 fee from the Auction company that will be added to your invoice before payment - Credit & Debit Cards accepted with a 3.99% charge in addition to the purchased amount. This applies to onsite and Internet bidders. There is no sales tax on this Live In-Person portion of this Retirement Auction! LIVE In-Person & Online NO Buyers Premium for In-Person bidders! Save money by attending this auction on-site! Buyers premium varies for online platforms. Use BidBoone.com for 5% BP with $2,500 cap. Use Equipment Facts or HiBid platforms for 7% BP with $7,500 cap. All bidders understand that they will be liable for payment of sales or use taxes which may become due for failure to comply with the provisions of federal, state, and local tax codes for any items sold as tax exempt or for resale. All bidders understand that it is a criminal offense to give an exemption certificate to the seller for taxable items that they know, at the time of purchase, will be used in a manner other than that expressed in this certificate and, depending on the amount of tax evaded, the offense may range from a class c misdemeanor to a felony of the second degree. All items must be paid for by Saturday, March 14th @ 5 PM EST unless prior arrangements have been made. Any unpaid bills will result in revoked bidding privileges/immediate legal action. There will be a Titled Vehicle Entry Fee added to all Titled items $20 Paid by Seller & $40 Paid by the Buyer. Fee includes: Title processing (paperwork filled out and documents needed to take to your local BMV), and USPS Priority Mail (with tracking number) delivery, if applicable. Cash buyers on titled items may take the title upon payment if the title is present. Those paying with checks will receive title upon check clearing. For items noted “Title to Arrive”, titles may take up to 30 days to come in if obtaining from a lender, and or waiting to receive from the BMV. Boone Auctions will secure titles and distribute as soon as possible for each titled item. Items that say "Title to Arrive" or "Title Present" will have a title. If it does not mention a title, assume that there is not one, and that is how that item is being sold. All items that need loaded by equipment must be be removed by Saturday, March 14th. Items being driven onto trailers or pulled away have more flexibility. All purchased items become the responsibility of the purchaser as soon as the item is sold. The Auction company is not responsible for lost, stolen, or damaged items. It is the buyers responsibility to insure purchases as needed immediately. Immediately when an item is Sold it becomes the property and responsibility of the Buyer. All items sell “AS-IS” “Where-Is” with no warranties or guarantees by the Seller(s) or the Auction company. All sales are Final. The described condition or representation of hours, use, and miles is provided as a courtesy, and not guaranteed by the Seller(s) or the Auction company. The Bidder is responsible for determining his or her opinion of the condition, and authenticity of an item before purchasing the item, not after. It is the buyers responsibility to inspect the item of interest prior to bidding on it. Online Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. (Boone Auctions) shall endeavor to describe in detail each item and any pertinent information about it. After a bidder has won the bid, all risk of loss and damage passes to the bidder, even though the bidder may have not paid for the item yet. Buyers should guard their items accordingly. The Seller(s) and the Auction Company and all of its Associates are not responsible for loss, theft, damages, or accidents. For Online Bidders: By placing bids you agree to follow all of the terms and conditions, agree to make payment, and to take possession of purchased items. Although we strive to provide the best internet connections and software available, please understand that internet speeds and reliability will vary. The Auction company is not responsible for lost connection or software failures that result in lost or unaccepted bids. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against (Boone Auctions) or anyone else if the Internet service fails to work correctly before or during the live auction. (Boone Auctions) will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should leave their maximum bid 24 hours before the auction begins, and confirm with the auction company if the bidder has any doubts about the process. Do not hesitate to bid or wait until the final seconds. This will be a fast paced auction and quick bidding will be required. All online bidders are responsible for complete control of their online bidding accounts. You are 100% responsible for every bid placed under your account, accidental and intentional. Online bidding is a serious matter. You must understand exactly what you are doing at all times. Although we strive to do this as little as possible, (Boone Auctions) reserves the right to withdraw or re-catalog items at any time. Boone Auctions will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as-is and that they may not return any item they purchase. This is a LIVE Auction with 3 competing online platforms and in-person bidders. You are not guaranteed a winning bid, even if it sellls for the amount you entered as a max bid. Max bids are like a safety net. We recommend watching live, in case you are outbid, or that the bid lands on your max bid with an in-person or competing online platform. All bidders agree to receive text, email, & or postage notifications about our upcoming events. All auctions are considered to be with reserve unless specifically stated otherwise.
