TERMS OF SALE We advise all prospective bidders to read the Terms & Conditions of the Auction Sale before bidding in an A&M Auctioneers and Appraisers, LLC Auction. By placing a bid, the bidder is bound by those Terms and Conditions of the Sale, as amended by any oral announcement or posted notices, which together form the contract of the sale between the successful bidder (purchaser), A&M Auctioneers and Appraisers, LLC and the seller (consignor) of the lot(s). All property is sold "As Is, Where Is", and All Sales are Final. There will be no bid reversals, cancellations, chargebacks or refunds of any kind. 1. BIDDER REGISTRATION: Bidders must be 18 years of age or older and are required to register for each auction. To participate in the auction, prospective bidders must register and provide identification information to verify their validity as bidders. At the time of registration, information is collected to confirm identity before bidding is allowed. Bidders must submit information that is current, complete, and accurate for proper identification. Credit card information is collected to ensure that bidders are qualified buyers. Bidders are responsible for the security of their bidding number, username, and password, and any bids placed under the assigned number/ID. Auctioneer and Auction Host Site (HiBid) should be notified immediately if a bidder believes their bid number, account, or password has been compromised. There is no cost to register for an auction (a $1 authorization will be charged when initially registering to validate the credit card by HiBid). The authorization is never deducted from the account but verifies that the card being placed on file is legitimate. HiBid's computer system performs an address verification check (AVS) on the registered card. The billing information provided will be validated with the card issuer through this authorization. If the billing information on the card doesn't match the actual billing address information, the card may be rejected for potential fraud activity. Some lenders/credit card companies don't participate in this AVS check. If the HiBid computer system doesn't receive a satisfactory response, it may reject the credit card. Try another credit card, preferably through a different lender if this happens. Highbid User Ratings. Every bidder starts with a reputation of 0 and, with activity, this score goes up or down to a value between -100 (very bad) and 100 (very good). Any bidder with a reputation lower than +1 will have their auction bid permission set to pending. We will verify your information if you are a new bidder with a reputation of "0". Once approved or declined you will receive an email confirmation. If you have a negative user rating/score on Hibid or Proxibid the Auction Co. at its sole discretion may decline any and all bids placed by your account. As a last resort, if we find you to be a non paying bidder or using fraudulent registration and/or credit card information, you may be permanently declined from bidding at our auctions. Once a new HiBid customer has participated/purchased items in a few auctions you will start to build up positive feedback with a successful pay and pickup transaction. Once you have a positive feedback rating, your account will normally be automatically approved for auctions conducted on HiBid by A&M Auctioneers for a preset bidding amount. That amount is normally equal to the highest priced item in the Auction. If we have a vehicle that is worth $4,000 we would say that $5,000 would be the maximum high bid that would automatically be approved on your account. Anything above that would require approval. NOTE: If you are a new bidder to HiBid/A&M Auctioneers with a "0" feedback rating we will verify your registration information and assign your account a Maximum Preset High bid (Per Item) amount. This amount will be a Maximum of $500 per item and will depend on the Auction. This pre-approval amount will be reflected in the Bidder Acceptance email once your account has been approved. We recommend that when bidding place your bids early so that you will know that your bid will be accepted. Don't wait until the final minute before the item closes to try to bid. In this scenario for example if you had been approved for a $500 max high bid per item and the bidding is already over $500. If you bid $750 your bid will be set to pending, a notification is sent to us, and it is nearly impossible to act upon that in less than 60 Seconds. If you know you will be bidding higher than the amount that you were approved for in the email, contact us prior to the item ending and we can make a manual change. NEGATIVE FEEDBACK NOTE: If a bidder has a Negative interaction with an Auction Co., that Auction Co. may leave Negative Feedback on the bidder's account. Other Auctioneers including A&M Auctioneers can view this feedback on the bidder's account. A&M Auctions keeps careful watch over prospective bidder's feedback during the registration and online bidding process. We will generally not allow a prospective bidder to register that has negative feedback on their account. This is especially true if the feedback mentions Non Payment, Credit Card Declines, Customers not picking items up and Chargebacks. A&M Auctions reserves the right to deny and or revoke the bidding privileges for any prospective bidder at any time during or after the registration process & up to the time that an Auction Item is scheduled to close. A&M Auctioneers and Appraisers, LLC reserves the right to terminate any registration, deny any person permission or access to bid, reject any and all bids, and suspend or ban bidders from bidding in auctions conducted by A&M at any time. Bidder registration is not transferable or assignable. If you are not comfortable or willing to register online which includes placing a credit card on file on our Secure Web server, you may enter bids in person at our facility. Bids must be in writing and are legally binding. A Valid Credit Card will still be required on the bid form. Valid Identification will also be required if you are unknown to the Auction Co. We will upload the bids placed by you on your behalf onto the online bidding server. By registering for the Auction you hereby agree to receive mail and/or email correspondence from the auction Co. from time to time. Auctioneer uses email mailing lists to notify customers about online and live auctions. Customers who do not wish to be notified should contact the office of the Auctioneer and request removal from the email mailing list. You can unsubscribe at any time. 2. INSPECTION: The property is open to public inspection. Bidders are encouraged to inspect the property before bidding. Property will be available for inspection at specified places and times. It is the bidder's responsibility to determine the condition, age, genuineness, authenticity, value, or any other determinative factor before placing a bid. The bidder shall be the sole judge of value. A&M Auctioneers and Appraisers, LLC may describe merchandise in advertising, on the internet, over the phone, and at the auction but makes no representations. Attendees during inspection, sale, or removal of merchandise assume all risks of damage or loss to persons, property, or merchandise and must exercise proper precautions at all times for the protection of persons and property and comply with all safety and health requirements as directed by the auctioneer, and local, state, and federal regulations. The auctioneer, its agents, employees, and representatives shall not be liable for any defect in or about the condition of the premises where the auction is held. Buyers specifically release the auctioneer, its agents, and representatives from all liability. A&M Auctioneers and Appraisers, LLC does not make or imply any warranty of merchantability or fitness for a particular purpose. Information in brochures, catalogs, and other advertisements is believed to be reliable; however, prospective purchasers should inspect the inventory or property to satisfy themselves as to condition, model, manufacturer, year, features, mileage, survey, acres, etc. Neither the auctioneer nor our client guarantees, and they are not responsible for listing or advertising inaccuracies or discrepancies. 3. CATALOGUE ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. If you find an error, please contact the Auction Co. and we will attempt to rectify it. All items are sold on an "as is, where is" basis, with all faults. In the event an item was listed in error, or an item can't be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain binding. By bidding, you are acknowledging agreement with the terms above. Do not bid unless you agree to all of these terms. The Bidder is responsible for knowing which item is being bid on. If the Bidder is unsure, they should inquire or not bid. Winning an auction creates a contract, obligating you to pay for the items you bid on successfully. Auctioneer will not honor "mistakes". Should a dispute arise, you agree to accept the accuracy of the information documented in our records. 4. AUCTION PROGRESSION: Auctions are generally uploaded to the HiBid Auction Platform 30-45 days before their scheduled end date. Short notice auctions may be online for only 15-30 days. Each auction will have a predetermined time when the items will begin closing. When an auction starts closing on a Wednesday night at 5 PM, the first lot will be scheduled to close at that time. Depending on the quantity of items in the auction, lots may be scheduled to end anywhere between 20 to 60 seconds apart. Each lot will display a scheduled ending time. If no one bids in the final minute before a lot is scheduled to close, that lot will close out. If someone bids within the final minute before that lot is scheduled to close, one extra minute will be added to that lot to allow additional time for bidding. The remaining lots will continue to close as scheduled unless someone bids in the last minute on those specific lots as well. Any bids made in the last minute of the auction will keep the item open for an extra minute, allowing other bidders to increase their bids if they wish to prevent 'sniping' any bids. This repeats until no one bids within the added minute. The Auction Co. reserves the right to extend the bidding time if an error should occur with the online server. 5. REVIEWING YOUR BIDS: During an auction you can check the status of your bids at anytime by logging into the online server. Please be careful when placing bids. Placing a bid is a two step process. Clicking the bid button opens a window for confirmation. You can use this screen to increase your bid amount. Ensure you enter the correct bid amount. If you make an error, contact Auction Co. at 410-835-0384 immediately for timely correction before the item closes. Our staff is available during all online auctions. You are responsible for your bids, and no bids can be withdrawn after the auction. 6. BIDDING NOTIFICATIONS: You can opt for email notifications if you're outbid. Please note that these are not sent in the last two hours of the auction. During the auction, you can watch each item end; if you're the high bidder, it will be highlighted in green. If it turns red, you've been outbid and need to bid higher. It will turn back to green once you surpass the highest bid. 7. BID INCREMENTS: Items have a minimum starting bid displayed online. Bids below this minimum aren't accepted unless the Auctioneer decides to accept bids in an increment that benefits the Seller. Auctioneer may reject bids from anyone whose behavior is deemed unsuitable 8. RESERVE: Some items may be sold with a reserve, which will be clearly marked. To win a reserved item, you must meet the minimum price. For example, a titled vehicle with a lien requires a sufficient price to pay off the lien and provide marketable title. 9. ADDITIONS & DELETIONS: We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction. 8. PAYING FOR YOUR PURCHASES: An "UNPAID" Auction Invoice will be sent via email immediately following the sale, detailing Auction Pickup information. You must check your email or log in to HiBid to verify if you won items. Charges are processed to the Credit Card on file by 10 AM the morning after the auction. You will receive your "Paid in Full" invoice at the scheduled pickup date/time. Upon arrival at the pickup location, find the Registration table (usually inside the home/building) where you will sign your invoice. The A&M Staff will then assist you with your items and provide you with your paid invoice. You must ensure you collect all your items from the auction site. The Auction Co. is typically present at the auction site for 2-3 hours on a specified date and time. We usually have an agreement with the property owner to conclude the Auction pickup at that designated date & time. Unsold items, trash, or items left behind are bagged and disposed of at the discretion of the Auction Co. At the end of the pickup, keys are returned to owner and access to the property is closed. You must ensure all your purchases, packing materials, etc. are loaded before leaving. Any remaining items will be considered abandoned and may be removed by the property owner. Effective immediately, we only accept credit card payments via HiBid for online auctions. Alternate forms of payment are no longer accepted. All invoices must be paid in full before the Auction Pickup date. Please ensure funds are available on the registered credit card. Purchases will be charged to the card chosen during registration. You may have multiple cards on your account, but we can only access the one you selected at registration. If you want to change your card, you must contact us BEFORE we process payments. Effective immediately, a $30 service charge will be added to any auction purchase with a declined card. Payments can also be made via Paypal at jeff@amauctions.com. You must make your Paypal payment by 10am the next morning after the auction and inform us when it is completed if you decide on this method. 9. SALES TAX POLICY: Sales tax will be applied to all taxable items purchased. Dealers purchasing for resale must provide their resale permit numbers. Maryland dealers are required to hold a valid Sales & Use Tax License from the State of Maryland, which we must verify before exempting sales tax. We will confirm the Tax Number provided and prepare a Blanket Resale form for signing. This must be completed prior to initiating the billing process. The use of another individual's Sales & Use License is prohibited. Bidders from other states must provide a copy of their State Business License/Tax License as mandated by the State of Maryland to avoid sales tax charges. 10. BUYER'S PREMIUM: A premium of 20% of the bid price will be added to the price of each item purchased. Taxes are calculated AFTER the buyer's premium. The Bidders Payment Type will not affect the Buyer Premium at an Online Only Auction. The buyer's premium includes commissions and/or fees retained by the Online Bidding Platform company. The Buyers Premium will be listed in the Advertisements, in the information packet and in the bidding platform. 11. TITLES: Titles will be disbursed on Auction Day/Auction Pickup Day only if payment is made in Cash, Cashiers/Certified Bank Check or Credit Card. If you pay with a Personal of Business Check the Title will be mailed to you or you can pick the Title up when the check clears the bank. This will take approx.10 days for a personal or business check. If you replace a personal check with a local bank/cashier's check we will be able to hand you the title at that time. If Seller cannot deliver good and marketable title, Seller, in Seller's sole discretion, will have 45 days from the date and time of notification to correct any title defect or flaw. If Seller is unable to convey marketable title at the conclusion of the 45 Days, Buyer's sole remedy shall be the return of the purchase price upon return of said merchandise. This can include the creation of a Bill of Sale through the MD Department of Motor Vehicles or MD Department of Natural Resources if it is required. 12. REMOVAL OF ITEMS: Our staff is there to help locate items but not to assist in removal. You must remove items using your own tools, equipment, and labor. You are responsible to bring necessary materials like boxes, tape, and dollies for timely item removal. Turn off plumbing and cap electrical connections before disconnection. Items will be in condition they were photographed in. Unremoved items by the end of pick up time are considered abandoned. If you cannot pick up the items yourself, notify the auction company by replying to the invoice email with the name and cell phone number of the person who will pick them up for you. If you need your items brought back to the AM facility in Parsonsburg, you must coordinate this with the auction company before pickup. We will determine the hauling fee and process it with your payment. We'll arrange trailer size, packing materials, padding, and manpower needed to remove your items safely and securely before local attendees arrive. We pack items for transport in plastic totes, wrapping fragile items in bed/puppy pads. At the UPS Store, they will repackage these items using their own materials to ensure safe shipment. If you buy large group lots (e.g., a room, closet, or shed lot, contents of a china cabinet), ensure you can pick them up at the auction site during the designated time. We can transport small lots in a 12-gallon tote but not large room lots due to logistics and costs. Large glassware groupings are impractical for us to wrap and move. Please check about hauling before bidding or be prepared to remove them from the auction site during scheduled pick up date/time. Again…You must notify us if you need your items brought back to AM Facility or dropped off at a shipper. Do not assume that we are aware of your needs. If we are not informed before the Auction Pickup day, this will be considered a "no show". 13. NO-SHOW VIOLATION: There will be a minimum $15 charge per lot for a no-show at the scheduled pick-up site. If a bidder does not show up at the auction pickup and we subsequently bring their items back to the auction facility or dispose of them, there will be a minimum charge of $15 per small item. This fee will correspond to our return fee depending on the size of the lot. It will be determined by A&M Auctions whether items are brought back or disposed of. Customers who consistently fail to show up without prior notification will be tracked. For these customers, the no-show fee will increase by $5 for each subsequent violation. The fee is $15 for the first violation, with an additional $5 added for each subsequent no-show violation. 14. FORFEITURE OF ITEMS: Due to ongoing issues with item pickups, you have one week from the auction date to pick up items brought back to our facility if you requested this service or shipping arrangements need to be made. Items not picked up or arranged for shipping will be forfeited after 7 days of auction date. That means if the auction took place on Wednesday, you have until the following Wednesday to pick up your items. You must notify us immediately if changes occur so we can try to accommodate you. If you don't communicate and if emails and calls from us go unanswered, we cannot accommodate you. 15. SHIPPING: A&M Auctioneers and Appraiser's does not ship general auction merchandise, however shipping is available through one of four 3rd Party Shippers. The 3rd party shippers we utilize are UPS Pack and Ship Store of Salisbury, MD/Delmar, DE & the Parcel Plus Store in Rehoboth Beach, DE & Craters & Freighters of Baltimore. We can't provide you with shipping estimates as we don't ship items. We deliver items once a week typically on Tue/Wed. You will pay the shipper directly for any and all costs associated with getting your items to you. Most auctions are held on Wednesdays. Local pick-ups at the auction site are typically scheduled for Fridays or Saturdays following the auction. If you have requested shipping, your item(s) will be collected during this pick-up period. We transport the items back to our auction facility and deliver them to a shipper of our choice, generally once a week typically on Wednesday/Thursday depending on our schedule. Upon delivery, we usually email customers to inform them that their items have been delivered and provide contact information for the third-party shipper. After this notification, the Auction Company will not have further information regarding the status of your item. The shippers will generally box the items and then contact you via phone or email to provide a shipping estimate. They will collect payment information at that time. Customers are responsible for paying the third-party shipping company directly for all costs associated with boxing and shipping the item. Please direct all inquiries regarding their services, tracking information, or other concerns to the shipper. There may be large items in this auction that are not shippable by regular means and will require local pickup or for you to arrange a freight hauling/Professional moving service. If for any reason should you choose not to pay to have your items shipped, you will be responsible for arranging to pick up your items or have them picked up from at the shipper location they were delivered to. There will be no refunds, cancellations chargebacks of any kind if you choose not to have your items shipped. Please be informed that shipping is available for most items being sold, with some exceptions. Large or oversized items will require specialized handling and may incur significant shipping costs. For large furniture-sized items, crating and freight shipping may be necessary. Craters and Freighters of Baltimore (located in Halethorpe, Baltimore County) can provide these services. They are situated 121 miles from our auction facility and can collect items, crate them, and prepare them for freight shipment. Please note that this type of shipping is very costly, and we advise bidders to consider this when placing bids. Our Auction Company is able to deliver items to the aforementioned service provider, but please be aware that this involves a round trip of approximately three hours each way. The associated costs include road time, a DOT-qualified driver, diesel fuel, truck and trailer usage, and tolls, all contributing to extremely significant delivery expenses. For extremely large or oversized items, it is the responsibility of the buyer to arrange for a professional moving or hauling service for shipping. Examples of such items include, but are not limited to: vehicles, trucks, boats, tractors, agricultural implements, pianos, fuel/liquid tanks, sheds, and other similarly sized items. *FIREARMS: The Auction Company will handle the shipment of all firearms, including handguns, rifles, and shotguns. In compliance with ATF regulations, we are responsible for shipping these items to another FFL in your state, where applicable. The Auction Company will also manage the shipping of high-capacity magazines. Please note that any magazine over 10 rounds is considered high capacity in Maryland and must be shipped to a jurisdiction where it is permitted by law. *HIGH-END JEWELRY, GOLD/PLATINUM ITEMS: The Auction Co. will handle shipping for high-value items like Gold/Platinum jewelry, rare gemstones, and gold coins. Due to recent fraudulent bidding, we may delay shipments to verify the purchase. Verification involves contacting the card issuer to confirm with the buyer. Items will only be shipped to the credit card's verified address. ***SHIPPING HAS BECOME VERY EXPENSIVE. A&M AUCTIONS HAS NO CONTROL OVER THE COST OF SHIPPING ITEMS. PLEASE BID ACCORDINGLY. 16.
