Lake Effect Liquidation – Auction Terms & Conditions
By registering and placing a bid, you agree to the following terms:
1. All Sales Are Final
All items are sold AS IS, WHERE IS, with no warranties or guarantees expressed or implied.
It is the buyer’s responsibility to inspect all items before bidding.
While we strive to provide accurate descriptions and images, some items may be missing parts, accessories, or original packaging, and this will not be grounds for a return or refund. By submitting a bid/purchasing, the buyer acknowledges and accepts that items may be incomplete or non-functional, and that the seller is not liable for any such issues.
All sales are final – returns or refunds are not accepted unless the item is significantly not as described.
2. Bidding
By placing a bid, you agree to be bound by these Terms and Conditions.
The highest bidder at the close of each lot becomes the buyer.
Bid cancellations are not permitted once submitted.
The auctioneer reserves the right to resolve any disputes, and their decision will be final.
3. Shipping Payment Terms
Shipping is available—PLEASE indicate “Shipping Required” when registering and put your shipping address in the notes.
If shipping has been requested, you will receive an email and you will have 24 hours to confirm your shipping address. Once confirmed, your HIBID card on file will be automatically charged for your won lots plus shipping cost, buyers premium, taxes, and 3% credit card processing fee, and items will be shipped out that Friday.
4. Pickup Payment Terms
For in person pickup, accepted payment methods: credit/debit cards, cash, apple/android pay.
Failure to pick up and pay for your items by the pickup window provided will result in a 20% restocking fee automatically charged to your card on file, and forfeiture of won lots unless prior arrangements are made.
Pickup for this auction is available during the following window:
Tuesday - Thursday, between the hours of 10 AM – 3 PM and Friday from 2pm - 6pm.
Buyers are responsible for bringing their own help and tools for loading.
5. Item Descriptions
We strive for accuracy in our descriptions, but all information is provided for reference only and is not guaranteed.
Buyers are responsible for inspecting items prior to bidding.
6. Buyer’s Premium & Taxes
A 13% Buyer’s Premium will be added to the final bid price of each item.
New York State Sales Tax (8.75%) applies unless a valid resale certificate is submitted prior to bidding.
7. Liability
Buyers enter the premises at their own risk.
We are not liable for accidents, theft, or damage that may occur during preview, pickup, or transport.
We are not responsible for manufacturer defects, missing parts, or shipping delays.
Buyers assume all risk associated with item use, transportation, and installation.
8. Store Credit Policy
We do not offer refunds. In select cases, store credit may be issued at our discretion.
Store credit is tracked internally and must be used within a specified time frame.
No cash value, and cannot be transferred or exchanged.
9. Identification Requirements
Please bring a valid photo ID and a copy of your invoice when picking up items.
If someone is picking up on your behalf, you must provide written authorization in advance.
10. Bidding Approval
We reserve the right to approve or deny any bidder at our sole discretion.
11. Auctioneer’s Rights
The auctioneer or seller reserves the right to:
Accept or reject any bid
Withdraw any item
Reschedule or modify auction details at any time
12. Chargebacks & Disputes
By bidding, you acknowledge that all sales are final.
You agree to waive your right to chargebacks or payment disputes.
Any concerns must be resolved directly with Lake Effect Liquidation.
13. Auto Charge
All cards on file will be automatically charged if you have requested shipping at the close of the auction. No exceptions will be made after cards have been charged.
