Manz Auctions LLC Terms and Conditions for Bidding:
By registering to bid with Manz Auctions LLC ("Auctioneer"), each Bidder agrees to abide by these Terms and Conditions as a condition for receiving a Bidder Number and participating in the auction.
Payment Terms:
The total amount owed ("Payment Due") consists of the final bid price ("hammer price"), plus a 15% internet premium and a $595 documentation/processing fee per lot won. Full payment is required within 72 hours of the auction's conclusion.
For invoices exceeding $5,000, payment must be made via wire transfer or cashier’s check unless the Auctioneer grants prior approval for alternative methods. If credit card payment is permitted, a 3% processing fee may apply. Insufficient funds or inability to pay the full amount owed is not a valid excuse for non-payment.
Invoices under $5,000 may be paid via PayPal.
Financing and Contract for Deed:
For any lot requiring financing, the Bidder agrees to enter into a Contract for Deed with detailed terms. By placing a bid, the Bidder agrees to be bound by the terms of the Contract for Deed, whether or not the Bidder formally signs it afterward.
Marketing Communications:
By participating, the Bidder authorizes the Auctioneer to send text messages and emails regarding additional real estate opportunities.
Non-Payment Consequences:
If a winning Bidder fails to make the Payment Due within the specified time, the Bidder agrees to pay the Auctioneer one-third of the Payment Due (including any financed amounts) as liquidated damages or agrees to specific enforcement, plus 150% of the Auctioneer’s legal and collection costs. Unless otherwise stated, the Bidder is responsible for any applicable taxes or fees on purchased properties.
Property Condition:
All properties are sold "as is," with all faults and defects, without any warranties or guarantees. The Auctioneer makes no claims regarding the suitability of any property for a specific purpose.
Bidder’s Due Diligence:
Bidders are solely responsible for conducting their own due diligence before bidding, including investigating the property’s characteristics, such as location, taxes, encumbrances, access, mineral rights, and water rights. Failure to inspect a property in person constitutes a waiver of any claims related to its condition or attributes. Bidders are strongly encouraged to consult with an attorney prior to bidding.
Property Photos:
Some photos may depict the general area or prior condition of a property and may not accurately reflect the specific lot or its current state. Bidders are responsible for visiting the property to confirm its condition.
Transfer of Ownership:
Unless the Bidder requests and the Auctioneer agrees to a title-insured closing in advance (with costs borne by the Bidder), conveyance of properties will not include title insurance. The Bidder authorizes the Auctioneer to act as their agent to execute any closing or corrective documents.
For each lot, the Bidder must provide the grantee’s name and address for the deed within one week of full payment. If this information is not provided, the Auctioneer may convey the lot using the Bidder’s registered name and address.
Credit Card Chargeback Prohibition:
Bidders agree not to initiate credit card chargebacks for any charges incurred. If a chargeback is initiated, the Bidder must, upon the Auctioneer’s request: (1) withdraw the chargeback and request the card issuer to restore the funds to the Auctioneer’s account; and (2) cover all related costs, including legal fees, incurred by the Auctioneer in contesting the chargeback.
Bidder Accountability:
Each bid constitutes an irrevocable offer to purchase the lot. Bidders are responsible for all bids placed using their account and Bidder Number. If a Bidder suspects unauthorized use of their account, they must immediately notify the Auctioneer via email at ManzAuctions@gmail.com and report the incident to law enforcement, providing a copy of the police report to the Auctioneer. Failure to do so will result in the Bidder being held liable for all purchases.
Jurisdiction and Dispute Resolution:
Bidders consent to the exclusive jurisdiction of Minnesota state courts or, at the Auctioneer’s discretion, binding arbitration at the Bidder’s expense. Bidders waive any jurisdictional defenses to legal actions filed in Minnesota and agree to accept service of process via email or certified mail.
Any property maybe removed from sale by the seller for any reason.

Manz Auctions LLC is owned and operated by Ryan Rich Moe who is a licensed REALTOR in Minnesota, North Dakota and Wisconsin.
