ATX Auctions San Antonio – Terms & Conditions
By registering for and participating in this auction, you acknowledge and accept the following terms and conditions:
1. Payments
Automatic Charges: Your card on file will be automatically charged immediately after the auction closes. This includes a 15% buyer’s premium, Texas sales tax, and a 3% card processing fee.
Cash Payments: If you wish to pay in cash, notify us before the auction closes by emailing cssanantonio@atxauctions.com
or using the “Contact Auctioneer” option on any lot page. Cash must be paid during pick-up hours, or your card will be charged on the final pick-up day.
All Sales Final: No refunds, returns, or chargebacks are permitted.
2. Preview and Inspection
Previews are available upon request during business hours. Please call or text us.
Inspection at Pickup: Customers are encouraged to inspect items at pickup. Once items leave our facility, they are considered accepted. No refunds or disputes after pickup.
Transparency: We provide detailed photos and accurate descriptions, but all items are sold As-Is, Where-Is.
3. Pick-Up and Location
Pick-Up Times:
Friday (Auction Day):3:00PM – 7:00PM
Saturday (Following Auction Day):10:00AM – 2:00PM
Late Pickups (Tuesday & Wednesday Only) 10:00AM – 3:30PM
Closed: SUNDAY, MONDAY, and THURSDAY.
Location: ATX Auctions San Antonio, 610 Lanark Drive, Suite 206, San Antonio, TX 78218.
Note: This auction is for in-person pickup only. No shipping available.
4. Pickup and Loading Policy
Staff will assist by moving items to dock-high loading bays only.
Customers are fully responsible for loading, securing, and transporting purchases.
Bring proper vehicles, straps, blankets, and sufficient manpower.
Staff will not load items into vehicles beyond the dock area.
ATX Auctions assumes no responsibility for accidents, damage, or loss once items are released.
5. Efficiency and Staging
To speed up pickup, text us your Bid Card number at least 30 minutes before arrival so our team can stage items.
6. Storage and Late Pickup
All items must be removed by the final pickup day, which is the Saturday after the auction.
Storage is not guaranteed and must be arranged in advance.
Late Fees:
$50 minimum per invoice (covers up to 2 days late).
Day 3 onward: $20 per day.
Maximum storage: 5 business days past final pickup.
After 5 days: Items are abandoned.
Restocking Fee: 25 percent of invoice or $50, whichever is greater.
Fees must be paid before bidding in future auctions.
Example: Auction closes Saturday, Sept 27 ? Final pickup Saturday, Oct 4.
1 day late (Monday, Oct 6): $50 fee
3 days late (Wednesday, Oct 8): $60 fee
5 days late (Friday, Oct 10): $100 fee (final day held)
After Oct 10: Items forfeited plus restocking fee
7. Chargeback Policy (Fraud Prevention and Enforcement)
By registering and bidding, you agree to our strict no chargeback policy. All bids are binding contracts.
Agreement to Payment Terms: By placing a bid, you acknowledge that payment for all winning lots is due in full, and authorize ATX Auctions San Antonio to charge your card on file.
No Unauthorized Disputes: You agree not to initiate a chargeback or payment dispute under any circumstances once the auction has closed and invoices are issued.
Certified Notice of Default: If a chargeback is initiated, ATX Auctions San Antonio reserves the right to send a certified letter outlining your default and the seriousness of the matter.
Legal Implications: Please be advised that initiating a false or unauthorized chargeback may constitute:
Fraud
Theft by deception
Civil breach of contract
Such actions may result in both civil and criminal legal consequences.
Collection and Remedies: ATX Auctions San Antonio may pursue collection for the full invoice amount, late fees, attorney’s fees, and any associated costs through small claims court, collections, or other legal remedies.
Resolution Process: Customers with billing concerns are encouraged to contact us directly for an amicable resolution before considering any dispute.
Future Bidding Privileges: Any customer initiating a chargeback will be permanently banned from bidding at ATX Auctions San Antonio and may be reported to HiBid, AuctionFlex, and other affiliated auction houses.
8. Communications
You will only receive auction-related texts such as closing reminders and winning bidder notices.

9. Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed under the laws of the State of Texas. Any disputes shall be resolved exclusively in the courts of Bexar County, Texas.
10. Authority to Bid
By registering, you represent that you are at least 18 years old and have full legal authority to enter into this agreement and place bids on behalf of yourself or the entity you represent. You are responsible for all bids placed under your account.
11. Default and Collections
Failure to comply with these terms, including failure to pay for winning bids, may result in:
Forfeiture of items
Collection action for the full invoice amount plus costs
Recovery of attorney’s fees, court costs, and damages
Suspension or permanent loss of bidding privileges
12. Severability
If any part of these terms and conditions is found invalid or unenforceable, the remainder shall remain in full force and effect.
13. Agreement
By registering, you confirm that you:
Accept these terms and conditions.
Acknowledge all items are sold As-Is, Where-Is.
Are responsible for timely payment and pickup.
Understand that failure to comply may result in forfeiture of items, collection actions, and permanent suspension of bidding privileges.
