Julie's Resale and Auction LLC will hereby be referred to as "THE COMPANY".
By submitting a bid, bidder affirms they have inspected all items or has waived their right to do so prior to bidding. Bidder shall be deemed to have relied entirely upon their own inspections and investigations. All property is sold as is/where is.
No statement in the auction catalog, bill of sale, invoice, or elsewhere by any representative of THE COMPANY shall be deemed to be a warranty, representation, or assumption of liability with respects to: age, condition, size, quality, variety, importance, provenance, or historical relevance. Descriptions shall not be relied upon by bidder for accuracy or completeness.
THE COMPANY will not be responsible for any errors or failures in executing bids of any kind due to technical or other failure associated with an internet auction.
THE COMPANY does not allow for the retraction of bids.
If a bidder places a bid and wins; the bidder is expected to pay. By placing a bid, the bidder has entered a legal promise to pay. Bidder agrees to pick up and pay during the designated time frame.
THE COMPANY does not provide moving and packing services.
The bidder is responsible for providing moving and packing materials. THE COMPANY does not provide moving and packing materials. The bidder is responsible for moving property won at auction.
If the pickup time is missed or if the bidder is unable to move the property in the allotted time frame, bidder is still liable for amount owed.
THE COMPANY will charge the credit or debit card on file for the amount due if bidder does not pick up lots won during the designated pick up time frame.
THE COMPANY will disallow all bidding from bidder profile and alert all other local auctioneers of bidder behavior.
If bidder does not pickup property in allotted time frame a fee of $2 per lot per day past pickup up to 7 days will be applied to the invoice. The fee will be no less than $5. For large items the fee is $10 per lot per day past pickup up to 7 days. The determination of where property is considered large will be made by the auctioneer at close of auction.
If the bidder does not pickup items won at auction during the designated time frame, they forfeit ownership of said property. THE COMPANY has the right to resell or dispose of forfeited property.
If THE COMPANY is unable to present an article sold to bidder due to fire, theft, or any other reasons whatsoever, THE COMPANY shall reimburse bidder for all monies paid in respect to the auction. THE COMPANY shall have no further liability to the bidder arising from or relating to such loss, including without limitation any damages for loss of profits.
All sales are final. No refunds.
A buyer’s premium will be charged on all invoices. A buyer’s premium is calculated by a designated percentage of the total invoice price. This percentage is determined by the auctioneer and will be provided in the auction details. The minimum charge of the buyer’s premium will never be less than $1.00.
THE COMPANY will allow bidders to pay with cash, check, or credit cards. The bidder shall not attempt a charge-back from a credit card payment when the amount is justly owed. The bidder shall present their drivers license when paying with a check. THE COMPANY will record information on driver’s license to keep on record in case of an insufficient payment.
The bidder will be responsible for all shipping and handling fees involved in shipping articles won. The buyer must have no outstanding balances with THE COMPANY before articles will be shipped. THE COMPANY will place insurance on packages sent, paid for by the bidder, up to the limit of the buyer’s purchase, or the maximum allowed by the carrier if purchase amount is greater than the carrier will allow.
Once the item has been confirmed received by the carrier, THE COMPANY is no longer liable for the buyer’s property. If the package or packages are lost, stolen, or damaged, it is the buyer’s responsibility to make a claim to the insurance policy placed on the shipment. In the event of a covered or non-covered loss THE COMPANY will not be liable for the decisions of the insurance policy. THE COMPANY will not issue any refunds for any reason.
THE COMPANY reserves the right to correct any mistakes or typographical errors made on its behalf in any of its written communication.
If any provision of these Terms and Conditions shall be held invalid, illegal, unenforceable or inoperative, the balance of Terms and Conditions shall remain in full force and affect as if such provisions had not been included.
All written and verbal announcements made prior to the close of bidding take precedence over any and all written or verbal statements.
THE COMPANY reserves the right to refuse any bid for any reason. This includes disallowing a single bid and/or a bidder account. Per Arkansas state law the bidder is not entitled to an explanation, though one is usually provided.
THE COMPANY reserves the right to cancel and/or reopen the auction in the case of system failures, direction from government agencies, or any other reason deemed appropriate.
