By registering for and participating in any auction conducted by Scarlet Begonias Trading Company (“Company,” “we,” “our”), you (“Bidder,” “you,” or “your”) agree to be bound by the following Terms and Conditions (“Agreement”). These terms are legally binding and govern your participation in our auctions.

1. Eligibility
• You must be at least 18 years old and legally able to enter into a binding contract.
• By registering, you warrant that all information provided is true, correct, and complete.

2. Auction Process
2.1 Bidding
• All bids are final, irrevocable, and legally binding.
• The highest bid at the close of the auction shall be deemed the winner, subject to Company approval.
• The Company reserves the right, at its sole discretion, to reject any bid, bidder, or registration.
2.2 Buyer’s Premium & Fees
• A 12% Buyer’s Premium will be added to all winning bids.
• Payments by credit card will incur a 3% processing fee.
• Payments made by Zelle, money order, or bank transfer incur no additional fee.

3. Payment Terms
3.1 Payment Deadline
• All invoices must be paid in full within 48 hours of auction close.
3.2 Accepted Payment Methods
• Accepted forms of payment: Cash, gold, silver, Zelle, money order, approved bank transfer, and credit/debit cards.
• Credit card payments will not be accepted without government-issued photo identification matching the cardholder’s name and the shipping address.
• No single credit card transaction exceeding $500 will be processed without verification.
3.3 Chargebacks
• By registering, you waive all rights to file chargebacks. Chargebacks are strictly prohibited.
• Any attempt at a chargeback will be deemed fraudulent. Company will provide GPS delivery data, signature confirmation, shipping records, and this Agreement to the relevant financial institution, law enforcement, and—if necessary—the FBI.
3.4 Failure to Pay
• Failure to pay within the stated terms will result in forfeiture of the lot, negative bidder history on HiBid, permanent ban from Company auctions, and potential legal action.

4. No Refunds or Returns
• All sales are final. Items are sold as-is, where-is, with no warranties expressed or implied.
• Scarlet Begonias Trading Company makes every effort to provide accurate descriptions, including detailed photographs and videos when available.
• No refunds, returns, or exchanges shall be granted for:
• Item condition, description, or representation
• Buyer’s remorse
• Shipping delays or carrier issues

5. Chargeback & Fraud Policy
• By bidding and submitting payment, you authorize Company to charge your selected payment method.
• Fraudulent chargebacks will be aggressively contested. Company may submit this Agreement, auction logs, IP addresses, identification records, and shipping confirmations as evidence.
• Company provides GPS coordinates of delivered packages and will place this data into the hands of local authorities, financial crimes divisions, and federal law enforcement, including the FBI, if required.
• You agree to indemnify Company for all costs, including legal fees, incurred as a result of any chargeback or payment dispute.

6. Inspection and Descriptions
• All items are described to the best of our ability. Descriptions, photographs, and when possible, videos are provided as a courtesy.
• Prospective bidders may request virtual inspection appointments via FaceTime or Skype prior to bidding.
• It is solely the bidder’s responsibility to determine condition, value, and authenticity before placing a bid.

7. Shipping and Pickup
Scarlet Begonias Trading Company Shipping Policy
All packages are shipped via USPS Priority Mail, insured, and signature required. This protects both buyer and seller against loss, theft, and credit card chargebacks. A handling fee of $5–$10 per invoice is applied to cover packaging materials and labor.
We recognize that this method can be more expensive if you purchase only one item. For that reason, we strongly encourage buyers to contact us in advance to discuss less costly shipping options. If we do not hear from you, shipments will default to Priority Mail insured with signature, as this remains the safest way to protect everyone involved.
8. Limitation of Liability
To the fullest extent permitted by law:
• Company shall not be liable for direct, indirect, incidental, or consequential damages arising out of participation in any auction.
• Company’s maximum liability shall not exceed the purchase price actually paid for the disputed item(s).

9. Indemnification
You agree to defend, indemnify, and hold harmless Scarlet Begonias Trading Company, its owners, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from:
• Your participation in any auction,
• Any breach of this Agreement, or
• Any fraudulent or meritless chargeback.

10. Governing Law and Jurisdiction
• This Agreement shall be governed by the laws of the State of California.
• Exclusive jurisdiction and venue shall lie in the courts of Calaveras County, California.

11. Modifications
• Company may amend these Terms at any time without prior notice.
• Continued participation constitutes acceptance of all modifications.

12. Entire Agreement
• This Agreement constitutes the entire understanding between you and Scarlet Begonias Trading Company and supersedes all prior agreements, written or oral.
