1. General Auction Terms & Conditions
All items are sold strictly “AS-IS, WHERE-IS”, without warranties of any kind (express or implied).
All images and descriptions provided are referential only. Alpine makes reasonable efforts to describe
items as accurately as possible; however, actual conditions may vary. Buyers accept this risk as a
condition of participation.
By placing a bid, the buyer acknowledges and accepts the risks related to product condition,
completeness, and functionality.
All bids are binding and irrevocable. No returns, refunds, or credits will be issued.
2. Payment & Penalties
All invoices must be paid in full within 48 hours of auction close.
A 15% Buyer’s Premium will be added to all winning bids, plus applicable Utah State Sales Tax
(8.45%), unless a valid exemption certificate is provided prior to bidding.
Accepted payment methods: credit/debit cards, ACH, wire transfer, or other methods as announced.
Payments are processed through secure third-party providers using industry-standard safeguards.
Non-payment consequences may include: suspension or permanent termination of bidding privileges,
forfeiture and resale of items at Alpine’s discretion, and collection efforts including legal action.
3. Item Condition Disclaimer
Items may be open-box, used, incomplete, damaged, or in unknown condition.
Photographs and descriptions are referential only and may or may not faithfully represent the product’s
condition. Alpine will make reasonable efforts to provide accurate information; however, conditions may
vary.
Buyers accept the risk of hidden or undetectable defects.
Once pickup or delivery occurs, no claims will be accepted regarding product condition.
Buyers may conduct a visual inspection at pickup. By signing the release, the buyer confirms full
acceptance of the item.
4. Consignment Agreement
Consignors guarantee legal ownership and authenticity of all goods provided.
Consignors agree to indemnify and hold Alpine harmless against any claims related to ownership
disputes, counterfeit goods, or trademark/copyright violations.
Alpine retains a standard commission (%), defined by product category.
Proceeds will be settled within 7 business days after buyer payment clears.
Unsold items must be removed by consignor within 10 days, or may be resold, donated, or destroyed at
Alpine’s discretion.
All consignments are sold AS-IS, NO WARRANTY, NO RETURNS.
5. Copyright & Trademark Policy
Any references to third-party brands, companies, or trademarks are made solely for descriptive and
informational purposes under the doctrine of nominative fair use.
Such references do not imply any endorsement, sponsorship, authorization, affiliation, or contractual
relationship with those brands or companies.
Every listing must include the disclaimer: 'All brand names, logos, and trademarks are the property of
their respective owners. Alpine Wholesale Auctions is not affiliated with, sponsored by, or endorsed by
these companies.'
Product images must be original photographs taken by Alpine or authorized consignors. Catalog or
stock images may not be used without prior written authorization.
All content created by Alpine (photos, videos, descriptions, logos) is protected by copyright.
Unauthorized use is prohibited.
IP Takedown Procedure: Any inquiry must be submitted to sales@alpine-sales.com with subject line 'IP
Inquiry – Auction Lot #[number]'. Alpine will investigate and respond within 48 business hours.
6. Pickup & Shipping Policy
Pickup: Items must be collected at the designated address within the posted schedule. Items not
collected within 7 days will be considered abandoned and may be disposed of without refund.
Third-party pickup: Written authorization is required for carriers or third parties. Alpine is not responsible
for damages caused during or after pickup by third parties.
Shipping: Coverage: 48 contiguous U.S. states only. Exclusions: No shipping to Alaska, Hawaii, Puerto
Rico, U.S. territories, Canada, Mexico, or international addresses.
Flat Rate shipping applies based on box size/weight. Oversize items require special arrangements.
Insurance: All shipments include basic $100 insurance. Additional coverage may be purchased by the
buyer.
Liability: Risk transfers to the buyer once items are delivered to the carrier. Alpine is not liable for
delays, losses, or damages in transit.
7. Pickup Waiver & Liability Release
At pickup, the buyer or authorized carrier must sign a waiver confirming: Items accepted AS-IS, without
warranty; Buyer assumes full responsibility for loading, transport, and handling; Alpine is released from
all liability once items leave its premises.
Signed waivers will be stored by Alpine as legal evidence.
8. Privacy & Data Protection
Information collected: identification, contact details, billing records, IP logs, and transaction history.
Purpose: verification, payment processing, invoicing, legal compliance, and business communication.
Alpine does not store full credit card numbers or CVV data. All transactions are processed securely by
third-party providers.
Alpine applies industry-standard safeguards but is not PCI DSS certified at this time. Participation in
PCI DSS certification is optional and not currently in force.
Alpine does not sell or trade personal data. Services are restricted to individuals 18 years or older.
Alpine is not responsible for data breaches, downtime, or failures attributable to third parties.
9. General Clauses & Governing Law
Jurisdiction: All disputes between buyers, consignors, and Alpine will be governed exclusively by the
laws of Utah, Salt Lake County.
Dispute Resolution: Parties agree to attempt mediation or arbitration before pursuing litigation.
Limitation of Liability: To the maximum extent permitted by law, Alpine disclaims liability for any indirect,
incidental, or consequential damages, including loss of profits, business interruption, reputational harm,
or issues arising from third-party platforms or carriers.
Updates: Alpine reserves the right to update these policies with notice via its website or email.
This consolidated policy replaces all prior versions. By registering, bidding, consigning, or
otherwise participating in Alpine’s auctions, all parties acknowledge and agree to these terms in full.
