Auction Terms & Conditions AUCTION TERMS AND CONDITIONS:
AUCTION METHOD:
Property is being offered by online auction only sale ending on Saturday September 17'th, 2016 at 6:00 P.M. Offers can be made prior to auction and is subject to be sold prior to auction date. Auctioneer reserves the right to accept or reject any and all bids. Property sells with owner confirmation.
REGISTRATION:
Online bidder registration is open now. All bidders must provide a valid driver's license and current address. Online bidders must also provide a credit card to register. By registering, all bidders acknowledge having read and agree to be bound by the Auction Terms and Conditions.
DOWN PAYMENT:
The successful bidder shall be required to make a $15,000.00 earnest money deposit upon confirmation of acceptance of high bid. Earnest money deposit accepted by bank wire transfer, Cashiers check or by Certified funds and received no later than 5:00 P.M. Central Time on Tuedsay September 20'th, 2016. Earnest money deposit will be applied to final closing costs. Auctioneer will contact winning bidder with wiring instructions for earnest money deposit upon acceptance of bid. Deposit will be held with Security Abstract & Title located at 110 W. 7'th Street, Cassville, MO.
FINANCING:
Financing is not a contingency of sale in this offering. Therefore, it is strongly recommended that potential bidders ensure in advance that they are able to obtain the necessary financing to close the transaction. Deposit would be forfeited in the event that the buyer does not close on the property due to fault of the buyer.
CONTRACT SIGNING:
The successful bidder shall execute a purchase agreement immediately upon acceptance of highest bid from the seller.
CLOSING:
Closing will take place with Security Abstract & Title located at 110 W. 7'th St. Cassville, MO 65625. Buyer shall close within 45 days of the auction date. Possession will be delivered at closing. Closing fees will be split 50/50 between the seller and buyer.
EVIDENCE OF TITLE
Seller shall provide at seller's expense an Owner's Policy of Title Insurance in the amount of the total purchase price and shall execute a general warranty deed conveying the real estate to the buyer.
REAL ESTATE TAXES & ASSESSMENTS:
2016 taxes are to be prorated up to the closing date.
SURVEY
Buyer will be provided with a current land survey. Survey will include splitting property into 4 tracts. High bidder will be purchasing entire property including all 4 tracts. Property descriptions will be provided for each tract.
AGENCY:
AAA Real Estate and Auction Company represents seller as agent only.
BUYER'S PREMIUM:
A buyer's premium of Five percent (5%) shall be added to the high bid and included in the total purchase price to be paid by the successful bidder.
DISCLAIMERS AND ABSENCE OF WARRANTIES
All sketches shown upon google maps are approximate location of property only. All bidders are responsible for conducting their own inspections, investigations, inquiries and due diligence concerning the property. The property is being offered on an "AS IS", "WHERE IS" basis and no warranty or representations, expressed or implied, is made by the Seller or the auction company. All announcements made by the Auctioneer during the auction take precedence over any previously printed material or any other oral statements made. All information contained in the advertising and all related materials are subject to the terms and conditions outlined in the purchase agreement. The Property is available for and subject to sale prior to auction. All announcements made up to the final close of the Auction bidding take precedence over all advertising, oral or printed material.
By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them.
Auctioneer Reserves the right to reject any and all bids.
AAA Real Estate and Auction Co Reserves the right to cancel and or reopen the auction in the case of system failures.
In case of Court dispute the location of the court will be located in Cassville, MO.
VIEWING
Property will be open for viewing on August 20'th, 2016 from 10:00 AM to 2:00 PM. Call Auctioneer for details. The viewing of the property will be at the viewer's own risk. The seller, neither Auctioneer will be held responsible for accidents.
