1. REGISTRATION & BIDDING
Registration: All bidders must register prior to bidding. By registering, you agree to be legally bound by these Terms & Conditions.
Bidder Responsibility: Bidders are responsible for all bids placed under their account/number.
Binding Agreement: Each bid constitutes a binding contract to pay the full purchase price plus buyer’s premium.
No Bid Retractions: All bids are final and cannot be retracted or canceled.
2. INSPECTION & CONDITION OF ITEMS
Inspection Encouraged: Please inspect vehicles and items in person prior to bidding.

AS-IS, WHERE-IS: All vehicles and items are sold AS-IS, WHERE-IS, WITH ALL FAULTS AND DEFECTS.
No Warranties: Estate Trader Promotions LLC and Consignor Legacy Used Auto make no representations or warranties, express or implied, including merchantability or fitness for a particular purpose.
No Rescission or Refunds: All sales are final. No returns, rescissions, chargebacks, or exchanges will be permitted.
3. BUYER’S PREMIUM & PAYMENT TERMS
Titled Vehicles & Heavy Equipment:
10% buyer’s premium applies.
A $515 deposit per vehicle ($500 + $15 credit card fee) will be charged at close of auction.
Balance due by cash, certified funds, cashier’s check, or wire transfer.
All Other Items:
13% buyer’s premium applies.
Sales Tax:
PA residents pay 6% sales tax plus applicable title, registration, and county fees and will be completed at the local tag office
Out-of-state buyers do not pay sales tax until you register outside of PA. Dealer exemption certificates or dealer licenses must be presented before auction close to be tax-exempt.
Title & Registration Service Fees:
Title Fee: $72 (PA)
Registration Fee: PA rate per vehicle
County Fee: $5 (if applicable)
Clerical/Processing Fee: $125 (PA residents) / $30 (out-of-state)
Notary Fee: $15
Messenger Fee: $45
Online Fees: $21 (if applicable)
Onsite Title Transfers:
All Pennsylvania title transfers handled by Local Tag and title company - Gibbons.
Payment Default: Failure to pay in full results in forfeiture of deposit, flagging as a non-paying bidder (Bidwrangler, Hibid, Proxibid, PAA), and potential legal action for full purchase price, buyer’s premium, attorney fees, and collection costs.
4. SHIPPING & PICKUP
Pickup: All items must be picked up in person within 3 days of auction close.
Buyer-Arranged Shipping: Buyer must arrange shipping within 3 days and prepay before release of vehicle/item.
Auction-Arranged Shipping: Estate Trader Promotions LLC can provide delivery within 100 miles for $450, prepaid.
5. AUCTION FORMAT & EXTENDED BIDDING
Timed Auction: Lots close sequentially every 30 seconds. The entire event may take several hours to close — plan accordingly.
Soft Close: If a bid is placed in the final minute of bidding, the lot extends for 2 minutes until no further bids are received.
6. OWNERSHIP TRANSFER
Risk of Loss: Ownership transfers and risk of loss pass to the buyer immediately upon the auctioneer declaring “SOLD.”
Title Delivery: Title or bill of sale will be released only after payment clears (up to 21 banking days for checks).
7. DEFAULT & REMEDIES
Estate Trader Promotions LLC may:
Cancel the sale and retain payments as liquidated damages
Resell the vehicle/item at buyer’s expense and pursue deficiency
Buyer remains liable for full amount, storage fees (5% per month), and attorney’s fees.
8. LIMITATION OF LIABILITY
Estate Trader Promotions LLC acts solely as agent for Legacy Used Auto and is not responsible for descriptions, title history, mileage, or condition.
Liability is strictly limited to the earned commission portion of the sale.
9. GOVERNING LAW & VENUE
This auction is conducted under the laws of the Commonwealth of Pennsylvania.
Venue for all disputes shall be the Court of Common Pleas, Montgomery County, PA.
Buyer agrees to pay all attorney’s fees, witness fees, and costs incurred by Estate Trader Promotions LLC in enforcement.

By registering and placing a bid, you:

Waive any right of rescission, refund, or credit card chargeback
