Terms & Conditions
By registering to bid with C.Lee Liquidation & Auction LLC (“Auctioneer”), bidders agree to the following Terms & Conditions for all auctions. Terms are subject to Illinois law, Federal regulations, and any Consignor/Seller requirements.
1. REGISTRATION & BIDDING
A valid name, address, email, phone number, and credit card are required to register. The Auctioneer reserves the right to decline registration to any person or entity. All bids are binding and final. The highest bidder at close is the purchaser. The Auctioneer reserves the right to settle bidding disputes at its discretion, including reopening or cancelling bids when necessary. Buyers are responsible for reviewing all bids before submission; no bids may be withdrawn once the auction has closed.
2. PAYMENT
Credit card information is required for bidder verification. Buyers may pay at pickup with cash or check if this preference is noted in their registration. Otherwise, all credit cards on file will be charged immediately after the auction closes. Buyer’s Premium is 10% and is added to all purchases. Credit card payments are subject to a 4% processing fee. Any invoice over $1,000 must be paid by cash, cashier’s check, or wire transfer. Invoices of $3,000 or more must be paid by wire transfer or cash, unless Auctioneer gives prior written approval. Returned checks are subject to a $45 fee. All transactions are in U.S. Dollars.
3. PICKUP, REMOVAL & STORAGE
All items must be picked up during the scheduled pickup times, unless prior written approval is obtained from the Auctioneer. Buyers who fail to pick up items remain responsible for payment. Storage fees of $20 per day will apply. Items not removed within 7 business days will be considered abandoned and become property of the Auctioneer, who may dispose of or resell them without refund. The original purchaser of these items shall have no claim to any proceeds derived from their sale. Buyers must bring their own tools, equipment, and help for removal. Auction staff are not required to assist.
4. WARRANTIES & INSPECTION
All items are sold “AS IS, WHERE IS” with no warranties or guarantees expressed or implied. Photos and descriptions are provided for guidance but are not guaranteed. Buyers are strongly encouraged to inspect items in person before bidding. No refunds, exchanges, or credits will be issued.
5. DEFAULT & NON-PAYMENT
Buyers who fail to complete payment may be banned from future auctions. The Auctioneer may resell unpaid items. Buyer remains liable for any deficiency between original purchase price and resale price, plus collection costs and fees.
6. PERSONAL & PROPERTY RISK
All persons attending preview, pickup, or removal do so at their own risk. The Auctioneer, Seller, and Property Owner are not liable for accidents, injuries, or damage to personal property. Children and pets are not permitted on premises during preview or pickup.
7. INTERNET & TECHNICAL ISSUES
The Auctioneer is not responsible for internet connection issues, platform errors or delays, or bids not executed, recorded, or recognized due to system failures. Auctions will proceed as scheduled regardless of bidder connectivity.
8. RESERVES & AUCTIONEER RIGHTS
Unless noted otherwise, auctions are conducted without reserve. The Auctioneer reserves the right to reject any bid, reopen bidding, or remove items at its discretion. Consignors may withdraw items prior to closing.
9. GOVERNING LAW
These Terms & Conditions shall be governed by the laws of the State of Illinois. Any disputes shall be resolved in the courts of Clinton County, Illinois.
10. SALES TAX
IF TAX IS BEING CHARGED IT WILL BE CLEARLY STATED - MOST AUCTIONS ARE NOT REQUIRED TO CHARGE TAX. Illinois sales tax will be applied when required by law. Buyers claiming exemption (resale, farm, or nonprofit) must submit a valid certificate before the auction closes. Without it, sales tax will be charged and the buyer must seek refund directly from the State.
