Terms and Conditions ________________________________________ 1. Payment / Buyers Premium Buyers Premium: A 20% Buyers Premium is added to the final bid price to determine the final selling price. Payment Terms: Hibid credit cards will be charged after the auction unless buyer reaches out prior to utilize alternative payment methods. Card fee of 3% will be applied. Payment must be made before items are removed by the specified date in the auction advertisement. All sales are final, with no returns, refunds, or adjustments. Accepted Payment Methods: Harris Real Estate & Auction accepts Cash, Wire Transfer, Cashier's Check, Money Orders, and Credit Cards. ________________________________________ 2. Load Out / Pickup Purchased Items: Buyers are responsible for ensuring all purchased items are accounted for before leaving the designated pickup location after the auction has closed. Personal Property Pickup: Items must be picked up from the auction location on the specified date after Harris Real Estate & Auction has received full payment. Items will not be released until payment is made in full. Buyer Responsibilities: Buyers are responsible for rigging, loading, and moving all purchased items without assistance from Harris Real Estate & Auction. For large items, buyers should bring help and equipment to load the items. Loading, Rigging, and Dismantling: Buyers assume all responsibility and liability for loading, rigging, dismantling, securing, transportation, and unloading of purchased goods. Harris Real Estate & Auction is not responsible for any damages or injuries related to these activities. ________________________________________ 3. Tax Exempt Tax Exemption: If a bidder is tax-exempt, they must email online@harrisauctions.com prior to the auction ending. The tax-exempt form must be submitted for each individual auction. ________________________________________ 4. Shipping Shipping Offer: Harris Real Estate & Auction may offer shipping depending on the auction and item. Items that qualify for shipping will explicitly state so in the lot description. Shipping Charges: If shipping is available, the bidder's Hibid card will be charged for shipping, insurance, and a $6.99 handling fee. Shipping Responsibility: Harris Real Estate & Auction is not responsible for damaged, missing, or broken packages. Filing for insurance is the bidder's responsibility. Address Accuracy: It is the bidder's responsibility to ensure their Hibid address is correct. ________________________________________ 5. Lot Condition No Responsibility for Missing/Incorrect Listings: Harris Real Estate & Auction is not responsible for missing or incorrect item information. Descriptions are provided in good faith but are opinions. "As is, Where Is": Items are sold in their actual current condition with all faults and defects. There are no warranties of any kind, express or implied. The only recourse for damaged or missing items is not paying for them. Buyer's Inspection Responsibility: Bidders should inspect items personally or online to determine conditions before bidding. All decisions are made based on the bidder's own evaluation. ________________________________________ 6. Auction Ending Auto-Extend Feature: Auctions have an auto-extend feature. Any bid placed within 2 minutes of closing extends the auction by 2 minutes. This applies to individual lots only. Outbid Notifications: Bidders will be notified via email if they have been outbid. It is recommended to place a max bid or monitor the auction close, as email notifications may be delayed. Bidding Increments: Bidding increments vary by auction. The software will automatically calculate the next bid amount. ________________________________________ 7. Credit Card Policy Credit Card Requirement: A valid credit card is required to set up a bidding account. Authorization: By registering, bidders authorize Harris Real Estate & Auction to charge their credit card for the full amount of the purchase, plus a $25 "No-Show fee" if the account is not settled by the pickup deadline. Surcharge: A 3% surcharge will be added to the invoice total. Over $2000 Policy: Credit card payments will not be accepted for invoices over $2000. ________________________________________ 8. Auctioneer's Discretion Modification of Sale: Harris Real Estate & Auction has discretion to modify the sale date, time, or details for any reason, including technical issues or emergencies. Right to Cancel: Harris Real Estate & Auction reserves the right to cancel, remove, or re-catalog any auction item before the close of bidding. Bid Rejection: Harris Real Estate & Auction reserves the right to reject any bids for any reason. An accepted bid is a legally binding contract. Seller and Bidder Liability: The bidder assumes responsibility for items upon payment receipt and agrees to hold Harris Real Estate & Auction harmless for any issues related to the sale, including resale of unpaid items. ________________________________________ 9. Acceptance of Bid Prices Subject to Seller Confirmation: All bids are subject to seller confirmation unless stated as ABSOLUTE. ________________________________________ 10. Bidder Responsibilities Confidentiality: Bidders must keep their username and password confidential and are responsible for all account activity. Age Requirement: Bidders must be 18 years of age or older. Username Policy: Offensive or inappropriate usernames may be deleted or changed by Harris Real Estate & Auction. Obeying Laws: Bidders must obey all local, state, and federal laws when using the auction website. Website Activity Monitoring: Harris Real Estate & Auction may collect information such as the number of page visitors and most visited pages. Waiver of Jury Trial: Bidders waive the right to a jury trial and agree to resolve disputes before a judge. ________________________________________ 11. Bidder Verification Identity Verification: Bidders' identities will be verified. Harris Real Estate & Auction reserves the right to reject bidders if verification is not possible. COVID-19 Waiver: By attending the auction or preview, bidders assume all risks related to COVID-19 and waive any liability against Harris Real Estate & Auction. ________________________________________ 12. Guaranty Agreement Business Entity Bids: By submitting a bid on behalf of a business, the individual submitting the bid personally guarantees payment for any outstanding amounts, including collection costs. ________________________________________ 13. Default Default Policy: If purchases are not settled by the pickup day, the bidder is considered in default and may be blocked from future auctions. Unpaid items may be offered to the next highest bidder. Collection Costs: The bidder agrees to pay all reasonable attorney fees and collection costs. ________________________________________ 14. Limitation of Liability Liability Limitation: Harris Real Estate & Auction's liability is limited to the return of paid money for undelivered purchases at pickup. ________________________________________ 15. Disputes Court Jurisdiction: Any dispute will be tried in a court of jurisdiction. ________________________________________ 16. Iran Divestment Act Certification: The buyer certifies they are not on the list of organizations engaging in investment activities in Iran as per TCA 12-12-106. ________________________________________ 17.
