TERMS AND CONDITIONS
TERMS:
1. The property will offered for sale via a Public "online-bidding process" (online auction) with the bidding ending with both live and online bids on October 11, 2025. Lots will begin to close at 9:00 AM in the order the auctioneer chooses.
2. The property will be sold subject to seller's confirmation (sells with reserve)
3. Property sells As-Is with no warranties expressed or implied.
4. The auction is subject to prior sale.
5. The list price ($) is provided solely for filtering and opening bid purposes.
6. Interested buyers are required to review and sign the Terms and Conditions, Agency Disclosure, Fair Housing and Bidder registration form.
7. The sellers reserve the right to cancel the auction at any time prior to the final bid closing.
8. Buyers premium ** For personal Property, a 10% buyer's premium will be added to the final bid and charged to the buyer, the final bid price plus the 10% buyer's premium will establish the final sales price. For Real Estate, an 8% buyer's premium will be added to the final bid and charged to the buyer, the final bid price plus the 8% buyer's premium will establish the final sales price. A $350.00 closing fee shall be assessed by the closing attorney for real estate lots. Title shall be transferred free and clear of any encumbrances. Seller will be providing title insurance and will pay documentary stamp taxes on the deed.
9. For Real estate Lots- A non- refundable down payment of 5 % of the final bid must be paid by the successful bidder by direct wire transfer or ACH no later than Tuesday, October 14, 2025. The down payment deposit will be non-refundable; your bidding is not conditional upon financing, so be sure you have arraigned financing before you bid, if needed, and can pay cash at closing. The balance of the purchase price will be due at the Transfer of Title (closing).
For Personal Property lots- All lots under $7,000 must be paid for on Auction day. Payment method shall be in cash. Credit Cards will be accepted at a buyers request but are subject to a 3.5% transaction fee. Lots over $7,000.00 may have a 25% deposit placed on the day of sale and the remaining balance paid no later than Tuesday, October 14, 2025.
10. For Real estate, the Contract to Purchase will be signed before or at time the deposit is received.
" Final closing is NOT contingent on financing.
" A warranty deed will convey the property.
" Real Estate taxes: the taxes will be prorated the day of closing.
" Closing will be held at sellers Attorney. On or about November 11th, 2025.
" Possession will be granted at final closing.
" The successful bidder shall execute electronically a "Contract to Purchase", with Dicks Realty, LLC, for the property at once after being declared the successful bidder by the auctioneer (sample available in the bidder packet).
11. Each potential bidder is responsible for conducting at their own risk , their own independent inspections, investigations, and due diligence concerning the property, any and all inspections must be completed prior to your bidding. *** Further, property sells as-is with no warranties expressed or implied.
12. Auction is being conducted by Dicks Realty, LLC of 816 SW Main Blvd. Lake City, Fl 32055. Dicks Realty is an exclusive agent of the Seller.
13. All information was collected from reliable sources and is believed to be correct as of the date this material was published; however, the seller, auctioneer, and Licensed Real Estate Broker have not independently verified this information. Auction plats, drawings and maps are not to be relied on and are for representation purposes only. Its accuracy is not warranted in any way. 15. On Site Viewing- Real Estate may be viewed by appointment by contacting Auctioneer. Personal Property may be viewed Saturday , October 4, 2025 from 9:00-11:00 am and Friday, October 10 from 4:00 to 6:00 pm.
16. All items must be removed from the sale site no later than 6:00 on October 15, 2025 unless advance arrangements are made.
*** The viewing of the property will be at the viewer's own risk. The seller, Auctioneer nor licensed Real Estate Broker may not be held responsible for accidents. Registered bidders may contact Dicks Realty, LLC to coordinate access for professional inspections.
