AUCTION TERMS & CONDITIONS
Terms and conditions to bid and buy. Please read these terms carefully. These terms, as modified or amended from time to time, are a binding contract between Rightside Auctions ("Rightside Auctions") ("we" and/or "us", etc.) and you ("you", "bidder", "purchaser").
The act of registering for our auction is a legally binding contract pertaining to the Terms & Conditions outlined in Rightside Auctions Brantford AUCTION TERMS & CONDITIONS. The act of registering means that you have read fully and agree to all Terms & Conditions within.
REGISTRATION & ELIGIBILITY TO BID
To bid with Rightside Auctions, you must be at least 18 years old and legally able to enter into binding contracts. During registration, you are required to provide accurate personal information, and Rightside Auctions may request additional documentation to verify your identity.All bidding is conducted through HiBid, our auction software provider. Click the “Register to Bid” button or link on our auction page to be redirected to HiBid, where you’ll create an account, add a valid payment method, and agree to the seller’s Terms & Conditions. HiBid may charge a temporary $1.00 USD verification fee to confirm your credit card, which is automatically reimbursed. Once registered, you’ll be ready to start bidding.
PAYING FOR YOUR PURCHASES
Rightside Auctions accepts the following forms of payment: E-Transfer, Cash, Visa, Mastercard, AMEX, and PayPal.Payment Deadline: All invoices must be paid in full no later than 4:00 PM EST on the Sunday following the auction close. Any outstanding balance after this time will be considered past due and the credit card on file will be charged automatically. By registering to bid, you expressly authorize Rightside Auctions to charge your credit card for any purchases made.
Customers may choose from the accepted payment methods, subject to the following conditions:
Friday pick-ups must be paid by E-Transfer or Cash only.
Past due balances will be charged automatically to the credit card on file.
Shipping and/or transfer invoices will be charged automatically to the credit card on file if unpaid at the time of order preparation.
Security Notice: For your protection, credit card information cannot be accepted via email or telephone.Detailed payment instructions for each payment type will be included with your invoice.
BUYERS PREMIUM
A 16% Buyers premium and 13% HST is applied to all invoices. Additional charges may be applied for items held or abandoned as outlined in the PICKUP & REMOVALS section of the terms and conditions.
BIDDING POLICY
Right to Void or Cancel Bids: Rightside Auctions reserves the right to void, cancel, revert, or delete any bid (winning or otherwise) at any time and for any reason, including but not limited to situations where a bid (i) is not made in good faith, (ii) violates these Terms & Conditions, or (iii) appears intended to manipulate the auction or our Services. This right applies regardless of whether the auction lot is open or closed.Max Bids: You may place a maximum (“max”) bid on listed items. By doing so, our bidding technology will automatically bid on your behalf in the lowest increments necessary to maintain your position as the high bidder until your max bid has been reached.Competing Bids: If another bidder has placed the same bid before you, or has submitted a higher max bid, you may be outbid. In such cases, the system will attempt to notify you so you may submit a new bid before the auction closes.
BIDDER RESPONSIBILITY AND ACCOUNT SECURITY
Account Security:
Rightside Auctions is not responsible for the security of your HiBid account. All bids placed through your account that result in an invoice are binding and are the sole responsibility of the registered account holder.
Unauthorized Use:
Any use of your account by another party, with or without your knowledge or consent, is not the responsibility of Rightside Auctions. Invoices generated from such use remain fully binding, and payment will be charged in full to the account holder.
Buyer Responsibility:
Bidders are fully responsible for:Securing their account credentials and preventing unauthorized access.Reviewing all bids carefully before submission to avoid bidding on the wrong item or incorrect amounts.Reading all item descriptions and viewing all photos prior to placing a bid.
Enforcement:
No exceptions, cancellations, or adjustments will be made regarding bids placed under these circumstances. All invoices remain due in full to the account holder.
PROHIBITED BIDDER CONDUCT
Any deliberate attempt to artificially influence the sale price of any listed item(s), whether directly or indirectly, is strictly prohibited. This includes, but is not limited to:
-Bidding through a secondary account, agent, or representative;
-Placing bids on items you are selling;
-Coordinating or communicating with other bidders to affect bidding outcomes;
-Engaging in shill bidding or any other manipulative practices.Violations of this policy may result in the cancellation of bids, suspension or termination of bidding privileges, and/or other remedies available to Rightside Auctions at law or in equity.
BIDDING STATUS AND FINALITY
Bid Status: During an auction, you may check the status of your bids at any time through the bidding platform.No Bid Withdrawal: Once placed, no bids may be withdrawn after the auction for any reason.As-Is Condition: All items are sold “as is, where is,” with all faults, defects, and imperfections, and without any warranty, representation, or guarantee of fitness for a particular purpose.Binding Effect: All bids are legally binding and enforceable obligations of the bidder.
OUTBID NOTIFICATIONS
Bidders may choose to receive email notifications if they have been outbid during an auction. Please note that outbid notifications are not sent during the final two (2) hours of the auction. It is the sole responsibility of the bidder to monitor the auction and ensure their bids remain active.
INVOICING AND BUYER RESPONSIBILITY
Invoice Delivery:
All winning bidders will receive an email invoice within 24 hours of the auction closing. Invoices are sent to the email address associated with the bidder’s HiBid account.
Email Security:
Rightside Auctions is not responsible for the security of bidders’ email accounts. Please note that email security settings may cause invoices to be filtered into junk or spam folders. Bidders are encouraged to mark Rightside Auctions’ email address as “safe” to ensure receipt of communications.
Invoice Verification:
It is strongly advised that bidders log into their HiBid account directly to confirm whether they have won items. A status of “May Have Won” means you have won, but only after the auction has officially closed and been finalized in our system.
Auction Completion:
Once invoices are issued, the auction is considered fully complete and closed. It is the sole responsibility of the bidder to identify and verify any items won.
PICK-UP POLICY
Posted Pickup Times:
Dates and times for pickup will be listed in the auction details for each auction and included on your invoice. It is the bidder’s responsibility to review the pickup schedule prior to placing any bids.
Office Hours vs. Pickup Schedule:
Pickup hours are specific to each auction and differ from general office hours listed on our website.
Shipping:
Shipping services may be available. Please refer to the Shipping section of the auction for details.
Failure to Pickup:
Do not bid if you are unable to pick up your items during the posted dates/times.Any item(s) not picked up during the designated pickup window will be considered abandoned, forfeited, and disposed of promptly after the final pickup day.Abandonment or failure to pay will result in a ban from future auctions.All items are sold “as is, where is” with all faults.
Alternative Pickup Arrangements:
Alternative dates/times may be arranged only in advance and prior to the applicable auction’s closing date.Approval is subject to Rightside Auctions’ schedule availability and must be confirmed by email at Rightsideauctions@gmail.com.
A taxable holding fee of $20.00 per week will apply, in addition to the invoiced cost of items.Alternative pickup cannot extend beyond fourteen (14) days from the auction close.If items subject to an approved alternative pickup are not collected within the agreed time, they will be considered abandoned, disposed of, and the bidder will be banned from future auctions.
You are required to bring any assistance you will need to pick up your items. Rightside auctions staff and affiliates of Rightside Auctions will not assist in lifting, loading, fixing, packing or unpacking any of your item(s) or any piece or part of your item(s).
PICK-UP LOCATION
Successful bidders are required to pick up their item(s) at:434 Lynden Road East (Building #3), Brantford, Ontariounless otherwise specified in the auction details. Alternate pickup locations cannot be arranged.
SHIPPING POLICY
Availability: Rightside Auctions currently ships Canada-wide. Shipping is available on all lots unless otherwise specified in the auction listing.
Shipping Costs & Handling Fees:
-Shipping costs are determined solely by the shipping company and are based on package location, size, and weight.
-A $6.00 handling fee + applicable tax will be added to each shipment.
-Shipping costs are non-negotiable and non-refundable.
-Some large items cannot be shipped. If applicable, this will be noted in the item description or advised by email
Carriers:
All orders are shipped internally by Rightside Auctions using the most economical option, with tracking provided, through:
-Purolator
-FedEx
-Canpar
-NationEx
-Other 3rd party carrier, if applicablle
U.S. Shipping Suspension:
Rightside Auctions has suspended all shipments to the United States. This policy supersedes any prior or contradictory information published on our website or other platforms. U.S. customers must provide a valid Canadian shipping address in advance; otherwise, Rightside Auctions reserves the right to decline bids associated with U.S. accounts.
Requesting Shipping:
To request shipping, bidders must either:
-Add an auctioneer note upon registration stating “SHIPPING REQUIRED,”
-Select the 'Shipping Required' button upon registering
-or Email bid@rightsideauctions.com with the invoice number.
The buyer is responsible for providing the correct shipping address. If the shipping address differs from the HiBid account address, notification must be provided immediately.
Rightside Auctions cannot ship to P.O. Boxes, as all shipments require a signature.
Payment for Shipping:
-Upon placing a successful bid, the buyer is bound to pay in full for both the invoice total and all associated shipping fees.
-Shipping invoices will be automatically charged to the credit card on file on the Monday following auction close, unless payment has been received by other means.
-Shipping fees will be processed as a separate transaction once items are prepared for delivery.
Estimates:
Shipping estimates can be requested up to 4:00 PM EST on the Wednesday prior to auction close by email or phone (address and item numbers required). Requests received after this time will not be answered.
Refund Policy & Shipping:
Due to logistical considerations, all shipped items that qualify under our Refunds Policy are eligible for auction credit only. Shipping and handling fees are strictly non-refundable. All refund decisions are at the sole discretion of Rightside Auctions management.
GUELPH & HAMILTON TRANSFERS
Upon request, items may be transferred to our Guelph or Hamilton Rightside Auctions locations for pickup. This service is subject to the following conditions:
-A fee of $10.00 + applicable tax ($11.30) per invoice will apply.
-Full payment of the invoice must be received before any transfer is processed.
-Transfers are completed on a bi-weekly schedule.
-Requests must be submitted either via email or through auctioneer notes at the time of registration/bidding.
-All payments must be made to and in accordance with the payment terms and policies of the specific auction for which registration was completed.
ITEM REPRESENTATION AND CONDITION
Accuracy of Listings:
Rightside Auctions makes every effort to ensure that all items are represented accurately in both photographs and descriptions. However, all items are sold strictly “as is, where is” with all faults, and no guarantees are made as to condition or completeness. No responsibility is assumed by Rightside Auctions or the seller for any errors or omissions in descriptions or images.
Bidder Responsibility:
Bidders are strongly encouraged to read the full description of each lot and carefully review all in-house photographs (those following any stock or retail photos) prior to bidding.Bidders must form their own opinions as to condition based on the in-house photos provided.
Returned Merchandise Auctions:
Please note that these auctions consist of returned merchandise. Items may be:
-Missing parts,
-Damaged,
-Different than what appears on the retail packaging,
-or In some cases, fully functional with no issues at all.
Condition References:
References to condition are based on the auctioneer’s opinion only:
NEW – Item appears to be unused, but this does not mean it is factory sealed.
USED – Item shows signs of previous use.
FACTORY SEALED – Item arrived sealed and unopened.No condition listed – No opinion provided, or the condition is self-evident from photos.
Inspection & Final Sale:
While Rightside Auctions inspects items to the best of its ability, not all items are fully inspected. All items are sold as is and are final sale.
Food & Beverage Items:
Rightside Auctions makes no warranty regarding shelf life, quality, or food safety of any consumable products sold. The buyer is solely responsible for ensuring food safety and compliance with applicable laws and regulations. Rightside Auctions and the seller are not liable for any damages, medical issues, or losses resulting from the consumption or use of food and beverage items sold.
RETURNS POLICY
By registering for our auction, you agree to comply with the following Returns Policy without exception.
General Rule:
All items are non-refundable.In limited cases, auction credits may be issued, subject to the terms below. Auction credits do not expire and may be used at any future Rightside Auctions (Brantford) auction.
Eligibility for Returns:
Returns will only be considered in cases of:
-Gross misrepresentation of item details i.e. different size than listed, or Complete non-functionality of the item i.e. a table missing a leg.
-Items explicitly listed as “Sold As Is” or 'Salvage' are non-returnable under all circumstances.
Return Process:
All return claims must be submitted within four (4) days of auction close.Requests must be sent by email to rightsideauctions@gmail.com and must include:Invoice number,Item number,A clear and precise description of the issue, andSupporting photos wherever possible.
-Returns will only be settled in the form of auction credits. No exceptions.
-We do not offer monetary refunds
-No auction credits will be issued until the item is physically returned to Rightside Auctions’ facility.
-Buyer Responsibility:
-The buyer is fully responsible for physically returning items to our facility. Rightside Auctions will not retrieve items on behalf of buyers.
-All costs associated with return shipping are the buyer’s responsibility.
-Buyers are strongly encouraged to inspect all items before leaving the premises to avoid unnecessary returns.Distance from our warehouse or inability to return items does not exempt buyers from this policy.
Non-Eligible Return Reasons
Items cannot be returned and will not be accepted for any of the following reasons:
-Personal preference or indifference (e.g., wrong size, wrong color, not needed, does not match).
-Missing hardware, missing instructions, or minor imperfections (scratches, dents etc.).
-Items requiring assembly. Assembly is the sole responsibility of the buyer.
PHOTOS AND DESCRIPTIONS
Buyers are strongly encouraged to review all lot details and photos before bidding.
-Retail photos (generally the first photo(s) shown) are provided by the merchant for marketing purposes only. They are examples and may differ from the actual item being sold.
In-house photos show the actual item being sold and take precedence over all other images.
In cases of conflicting information:
-In-house photos prevail over all other lot information and retail photos
-In the event an in-house photo is not available, the written description will prevail
-Retail photos hold no weight as they are only a representation of the item
Final Discretion
The decision to approve or deny any return request rests solely with Rightside Auctions management.
SHIPPING/TRANSFER RETURNS

All refund requests must be emailed to rightsideauctions@gmail.com with clear and precise description of the issue and pictures wherever possible. These requests MUST be made 4 days after receipt of items. All general returns procedures are still applicable. Any & all returns will be offered as ONLY auction credits which can be used towards future auctions. Shipping costs & fees are non-refundable.
CLAIMS
No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an 'as is, where is' basis, with all faults.
PERSONAL & PROPERTY RISK
The Buyer expressly agrees to indemnify and save Rightside Auctions and their Sellers/Consignors harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including negligent acts or omissions of Rightside Auctions, or anyone acting on his/her behalf in connection with or arising out of an auction.
ADDITIONS & DELETIONS
Rightside Auctions reserves the right to withdraw, postpone, or cancel any Listed Item(s), in our sole discretion, with or without notice. We shall have no liability to you as a result of any withdrawal, postponement, or cancellation.
RESERVE
Seldom are items sold with a reserve. If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a 'reserve', you will be required to pay a minimum amount in order to enter a bid. Any reserves are between the consignor & the auctioneer and are subject to the consignor's approval. The Auctioneer reserves the right to reject any bid at their sole discretion.
AUCTION RECORDS
In the unlikely event of a dispute, you agree to accept as true the information that we have in our records.
ONLINE BIDDING
For online bidding, please keep in mind that the connection to the internet is not absolutely reliable. Connection problems can happen between or within our office, between or within the software servers, and/or between or within bidders and potential bidders. We cannot be held responsible for any of the above possible issues, or for your bids not making it into the system. Rightside Auctions takes no responsibility for technical faults.
SOFT CLOSE
Items close at regular intervals. To prevent a bidder from 'sniping' all bids made in the last minute of the auction will force an item to stay open for an additional 3 minutes. This will continue until all bidding has ceased.
STRATEGY
We recommend that all bidders put in their maximum bid when placing a bid online. This does not mean you will have to pay the maximum amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.
CATALOG ERRORS & OMISSIONS
Written and oral descriptions are the opinions of Rightside Auctions and should in no way be construed as a guarantee of any kind as to authenticity, age, model, make, materials, condition or any other feature of items being sold. Rightside Auctions attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog, item descriptions or pictures within. Questions regarding item(s)/lots can be asked by emailing Rightsideauctions@gmail.com. Questions will only be answered if received at least 24 hours prior to applicable auction closing. By placing a bid, in any capacity, you signify that you have examined the items as fully as you desire and have had the opportunity to ask questions and receive answers from Rightside Auctions that you deem adequate. If you are not satisfied with the information provided regarding any items or lots, do not bid on the item(s)/lot in question. All items are sold on an 'as is, where is' basis, with all faults.
Any listed retail values and/or prices are approximations only. It is your responsibility to do your own due diligence in researching values.
Buyers are strongly encouraged to review the details of any lot they intend to bid on. Bids cannot be retracted. Be aware that photographs may differ slightly from the actual item(s). Where there is conflicting information between the item(s) details and the photograph, the posted written details prevail.

PRE-PAID INVOICE PICK UP:
Pay your invoice on the evening of auction close (E-Transfer) and we will prepare your order first.
It will be ready for Friday Pick-up 1:00pm-4:00pm. Please note: No pymts will be accepted on premise on Friday. Orders paid on Friday will not be ready for pick-up until Saturday. Friday pick-up is for pre-paid orders ONLY.
GUELPH TRANSFER
You can have your items transferred to our Rightside Guelph location and can pick them up from there!
-The transfer fee is a flat rate of $10.00 plus tax/per invoice.
-Transfers are done on a Bi-Weekly Basis
